The car was going the wrong way and then turned onto Hudson Street, heading west against the one-way traffic that flows east. Officer Bonilla turned on the emergency lights to pull the vehicle over. When questioned, the driver, 22-year-old Nicole Giraldo, appeared confused about the reason for the stop. She first said she was going home, then mentioned she was on her way to Birch to get her driver’s license, and finally said she had picked up her friends at Fat Taco. Officer Bonilla observed that Nicole's speech was unclear and her eyes were watery and red. Despite this, she claimed she had not been drinking. He reported to Officer Rivera that she likely showed signs of impairment. Officer Anthony Rutkowski then arrived to conduct field sobriety tests. Following this, Officer Rivera asked Nicole to step out of the vehicle, and Officer Rutkowski began the sobriety exercises. The first test conducted was the Horizontal Gaze Nystagmus (HGN) test. Officer Rutkowski observed that there was a lack of smooth eye movement, noticeable and persistent nystagmus at maximum deviation, and the appearance of nystagmus before the eyes reached a 45-degree angle. The second test was the Walk and Turn test, where Nicole struggled with her balance. While performing the test, she took 11 steps forward and 10 steps backward without placing her heel to toe, and she failed to count out loud as required. The final test was the One Leg Stand, and during this exercise, Nicole did not lift her foot correctly and swayed her arms to maintain balance. Due to her erratic driving, inconsistent comments, and failure to perform the field sobriety tests properly, Officer Rivera arrested Nicole for driving under the influence. Officers Rutkowski and Rivera took her to the patrol car, while Officer Bonilla stayed at the scene and instructed the other passengers to call an Uber since Nicole was being arrested. Nicole was taken to Hoboken Police Headquarters by Officers Rutkowski and Rivera. After arriving at the station, Officer Rivera searched her again and handcuffed her to a bench. Officer Rutkowski informed Nicole about the Standard Statement for Motor Vehicle Operators, and she consented to provide breath samples. Because the Alcotest machine in Hoboken was not working, they needed to take her to the Weehawken Police Department to complete the breathalyzer test. At the Weehawken Police Department, Nicole agreed to answer questions during a 20-minute observation period. She confessed to drinking margaritas earlier at Fat Taco. After this period, Nicole provided breath samples, which showed a blood alcohol concentration (BAC) of 0.18%, more than twice the legal limit of 0.08%. After she was processed, a sober person took responsibility for her by signing the Potential Liability Warning form. Officer Rivera then issued her summonses for operating under the influence, reckless driving, and driving the wrong way on a one-way street. On March 29, 2023, court records show that Nicole was found guilty of driving under the influence. She received a $690 fine and her license was suspended for 12 months. Additionally, she was required to complete 12 hours at a resource center for intoxicated drivers. As part of her plea agreement, two other citations against her were dismissed. 1:53 what's that hhhonnnk hhhonnk sound please? 5:00 here comes the crock tears.... 15:46 plz ban tobacco and alcohol If you enjoyed this BodyCamBust video .
