Around 3:03 AM on February 29, 2024, officers with the Galloway Township Police Department responded to the scene of a motor vehicle crash on W Jimmie Leeds Drive near the on-ramp to White Horse Pike (Route 30). As they arrived on scene, they observed that a white Ford 2005 pickup truck had crashed into a wooded area after striking the curb and narrowly missing a utility pole. They made contact with the driver inside the residence nearby, and she was identified as 19-year-old Emma. Emma informed the officers that she had left her father’s house after having an argument with him because he had been drinking. She stated that she was headed to her mother’s house. She was asked if she had anything to drink. While she initially denied consuming alcohol, she later admitted to having a few sips of vodka earlier that evening. Since she appeared injured and she was going to be transported to the hospital, an officer decided that he would only perform the horizontal gaze nystagmus (HGN) test. The HGN test yielded indicators of impairment. The officers also located a bag with a notebook that appeared to belong to Emma, and the bag had alcohol inside. Based on the motor vehicle crash and her admission to consuming alcohol earlier, Emma was placed under arrest. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John’s Law. Emma was issued the following citations: Operating under the influence, reckless driving, traffic on marked lanes, open container, and violation of restrictions on provisional driver Emma had previously been cited for failing to report an accident and failure to keep right in Egg Harbor Township on August 21, 2023, and that case was adjudicated in court on April 23, 2024. She pleaded guilty to failing to report an accident while the other citation was dismissed, and she had to pay a total of $140 in fines for that case. As of October 21, 2024, her DWI case is still pending in court. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
