Just before noon, an on-duty detective sergeant spotted a gas-powered moped traveling illegally inside a marked bicycle lane while improperly passing vehicles stopped at a traffic light. When the officer stepped into the roadway, raised his arms, and issued a clear verbal command to stop, the rider refused. Instead, the driver accelerated to evade police, veering the moped directly onto a pedestrian sidewalk where he lost control and crashed. A retired police officer who happened to be nearby stepped in to help the detective detain the 34-year-old driver until backup units arrived. The investigation revealed the moped had an expired registration and belonged to a third party. The driver was transported to headquarters, charged with eluding, and issued numerous summonses for sidewalk driving, improper passing, and operating an unregistered vehicle without a license. The registered owner of the moped was also cited for allowing an unlicensed operator to take the vehicle on the road. These charges are merely accusations and the defendants are presumed innocent until proven guilty. An arrest is not a finding of guilt: that’s something for a court to decide.
