Trooper's Report: On April 8th, 2023, at approximately 11:18 pm, I was investigating a DWI crash on Interstate 530 North at the 7 mile marker with Trp. Joseph Killian #34. There was also a fire fighter and a tow truck driver, Mr. Dallas Ballard, on scene. As I was interviewing the crashed driver involved in the crash, a red 2005 Dodge 1500 pickup, bearing Arkansas license plate M9963, was traveling Northbound on Interstate 530 and stopped in the inside and outside traffic lanes of Interstate 530, blocking traffic for no reason. After almost causing a collision, the Dodge moved to the East shoulder just ahead of our location. Soon, the driver of the Dodge, Mr. David R. Stanley (2/4/1957, W/M), was walking among the crash scene, inspecting the crashed vehicle. Mr. Ballard had talked to Mr. Stanley and told me he thought that Mr. Stanley was the brother of the individual I was already investigating for DWI. Mr. Ballard also stated that he believed that Mr. Stanley was also intoxicated. I observed Mr. Stanley to have sagging knees and walk unstably. I gave Mr. Stanley verbal commands to stop, but he disobeyed and began to run back to his pickup truck. I ran on foot after him, but he was able to get inside his vehicle before I could reach him. He closed his door and aggressively accelerated his vehicle in a fleeing manner. I had given him several verbal commands to stop. I entered my patrol car and activated the emergency blue lights and siren. I positioned my patrol car behind the Mr. Stanley’s Dodge, but Mr. Stanley accelerated to speeds up to 85-90 miles per hour. I communicated to the Troop A Communication Center that I was in pursuit. The fleeing Dodge passed several motorists while fleeing. Due to the fact that Mr. Stanley was fleeing at a high rate of speed while reasonably believing that he was intoxicated, I performed a Tactical Vehicle Intervention (TVI) by placing my front left quarter panel on the Dodge’s rear right quarter panel and turned, causing the fleeing Dodge to rotate clockwise. The pickup travelled off the roadway on the East grassy roadside before striking roadside trees and coming to final rest within the tree line, ending the pursuit. I exited my vehicle and started to perform a felony traffic stop by giving Mr. Stanley verbal commands to raise his hands and exit the vehicle. Mr. Stanley did not obey verbal commands and sat down on the grass beside his vehicle. I waited for assistance from Sgt. Nicholas Brown #288, before approaching Mr. Stanley. He continued to disobey verbal commands. I placed Mr. Stanley on his stomach and pried his arms behind his back to put handcuffs on and double locking them for his securement. I observed Mr. Stanley to have water bloodshot eyes. His knees were still sagging, and he swayed as he walked. Mr. Stanley’s speech was slurred and often incoherent. The smell of alcohol was also coming from his person. I read Mr. Stanley his Miranda Rights, which he indicated he understood. When I asked him how much alcohol he had to drink that night, he said to have had just a beer. I asked him why he didn’t stop when I was behind him, and he replied that he was trying to get to the hospital to see his brother. His brother was still at the crash scene I was originally at. Due to Mr. Stanley having a cut on his head, he was transported by MEMS to UAMS. There he refused medical treatment and verbally abused the medical staff that encountered him. I contacted Judge Wayne Gruber of the Pulaski County District Court and was granted a search warrant of Mr. Stanley’s blood. Medical staff repeatedly attempted to take Mr. Stanley’s blood, but he threatened violence. For the safety of the medical staff and Mr. Stanley, I decided not to take a blood sample. Mr. Stanley was then transported to the Pulaski County Regional Detention Facility and booked into jail for the following charges: A.C.A. 5-54-125(d)(2): Fleeing-Felony-Vehicle or Conveyance-Substantial Danger of Death FD A.C.A. 5-54-125(c): Fleeing- On Foot A.C.A 27-50-308(b)(1)(B) 1st: Reckless Driving-1st A.C.A. 27-37-702: No Seatbelt A.C.A. 5-54-103(a): Resisting Arrest A.C.A. 5-54-102: Obstructing Governmental Operations A.C.A. 5-71-207: Disorderly Conduct A.C.A. 5-65-103 1st: Driving While Intoxicated- DWI 1st A.C.A. 5-65-205: Refusal To Submit To Chemical Test A.C.A. 27-14-701: Owner Fail To Register Vehicle-Expired Tags A.C.A.27-14-716: Improper Display of License Tags A.C.A. 27-35-110: Spilling Load on Highway A.C.A 27-50-302(A)(7): Speeding- More Than 15 MPH Over Limit
