*** CASE UPDATE *** The 20-year-old student was indicted on 3 felonies: 2 felony counts of assault on a police officer and 1 felony count of attempting to commit tampering with evidence. He pled guilty to the attempting to commit tampering with evidence charge (a felony). The other 2 charges were dismissed. He was sentenced to 5 years of probation. He also agreed to pay $200,000 to the female police sergeant who broke a bone in her hand. Also, as an interesting side note, the Foundation for Individual Rights and Expression (FIRE), an organization that strives to protect individual freedom of speech rights, wrote a letter to the University of Dayton and the Department of Public Safety stressing that the University should not be taking any action against the students for their protected free speech. That letter can be found here: https://www.thefire.org/research-learn/fire-letter-university-dayton-august-15-2024 It is important to note that FIRE does not take a position on any punishment the University of Dayton assesses against the 20-year-old male student for making contact with the officer. On September 2, 2023, University of Dayton Police Officers were handling a grand theft auto call when college students living in an off-campus house allegedly began shouting at the officers. After the call was handled, Sergeant Oldham and Sergeant Pullin decided to knock on the door of the house that they believed the shouting was coming from. Initially, they chose the wrong house, but were redirected to the adjacent front door. When the 20-year-old woman answered the door, Sergeant Pullin asked for her college ID in order to give her a "referral" for breaking a university rule. While she was attempting to locate her college ID, the two Sergeants noticed what they believed to be a fake state ID. She was placed in handcuffs and detained. A 20-year-old male student then appeared at the doorway. He left, but quickly reappeared and got into a physical confrontation with Sergeant Pullin. The police report indicates that during the struggle, Sergeant Oldham suffered a displayed fracture in her fifth metacarpal bone, which would require surgery to repair. Sergeant Pullin eventually deployed pepper spray in order to gain control of the male student. The female student was eventually charged with underage drinking and the male student was indicted on three felony counts, including two counts of assault on a police officer. All suspects are presumed to be innocent until proven guilty in a court of law.
