On November 8, 2025 around 1:57 AM, Patrolman Hunter Votjko with the Belmar Police Department was on patrol near the 500 block of Eighteenth Avenue in the neighboring town of Lake Como. He observed a white 2020 Mazda SUV blow through a stop sign near the 400 block of Eighteenth Avenue and blow through another stop sign at Eighteenth Avenue and B Street. After the driver turned left onto Ocean Avenue, he activated his emergency lights to initiate a traffic stop. The driver pulled over on Ocean Avenue in the vicinity of Fourteenth Avenue. He exited his patrol car and initiated contact with the driver, who was identified as 24-year-old Maggie Sullivan. Maggie told him that she was headed back home after leaving her brother’s house. As he was speaking with her, Patrolman Votjko detected the odor of alcohol and observed other indicators of impairment. She only admitted to consuming 1 drink during the traffic stop, but she would later admit to consuming a Fireball shooter as well as a tequila soda. Based on his suspicion of impairment, Patrolman Votjko called for Patrolman Kevin Poppert to arrive on scene and assist. After Patrolman Poppert arrived on scene, Maggie was asked to exit the vehicle and perform field sobriety exercises. Patrolman Poppert started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Patrolman Poppert observed 6/6 indicators of impairment. The second exercise was the Walk and Turn test. During the Walk and Turn test, Maggie failed to touch heel-to-toe on each step and turned improperly. The final exercise was the One Leg Stand test. During the One Leg Stand test, Maggie failed to raise her foot in the proper fashion and put her foot down before the test was complete. Based on her traffic infractions, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily perform the field sobriety exercises, Maggie was placed under arrest for operating under the influence. Her vehicle was impounded by for a mandatory 12-hour hold under John’s Law. Maggie was transported to the Belmar Police Department for further processing. The Standard Statement for Motor Vehicle Operators was read to her, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.178%, which was more than double the legal limit of 0.08%. Once they finished processing her, Maggie was eventually released to her brother pending her court appearance after he signed the Potential Liability Warning form on Maggie’s behalf. Maggie was issued the following citations: -Operating under the influence (39:4-50) -Reckless driving (39:4-97) -Disregarding a stop sign (39:4-144) As of January 1, 2026, Maggie’s case is still pending before the Lake Como Municipal Court. ------------------------------------------ Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. Central Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
