The incident began when a patrolman observed a vehicle traveling 85 MPH in a 55 MPH zone on Route 15 North, necessitating another officer to initiate the stop at the 14-mile marker. Upon approaching the vehicle, officers quickly detected the distinct odor of an alcoholic beverage emanating from the driver. The driver admitted to consuming approximately two glasses of wine earlier and, significantly, also revealed she was pregnant, adding a layer of concern to the roadside encounter. This admission, coupled with the observed signs of impairment, prompted officers to offer standardized field sobriety exercises to assess her ability to operate a vehicle safely. Despite her expressed anxiety and a moment of terror fearing passing traffic during the roadside evaluation, she verbally agreed to perform the structured tests. These included the Horizontal Gaze Nystagmus, the Walk and Turn, and the One Leg Stand, administered by Patrolwoman Lippencott and observed by Patrolman Poon. Following her inability to adequately perform most of these exercises, exhibiting clear indicators of impairment, she was formally placed under arrest for driving under the influence. Subsequent processing at police headquarters confirmed her impairment, with Alcotest results showing a blood alcohol content of 0.14%.
