A routine welfare check quickly escalates into a serious legal confrontation as a driver's suspected impairment leads to an arrest. On a bright morning, an officer was dispatched to investigate a report of a suspicious individual. The encounter led the officer to a residential property where a woman, later identified as Jessie Stevens, was seen exiting a vehicle. The officer's suspicion of impairment was immediately raised when he observed a white powder residue in her nostrils, despite her denial of alcohol consumption. Due to concerns about her ability to operate a motor vehicle safely, the officer initiated a series of standardized field sobriety exercises. During these tests, Jessie displayed significant signs of impairment. She exhibited a noticeable circular sway during the Modified Romberg Balance Test and misjudged the 30-second estimation by nearly 10 seconds. The Horizontal Gaze Nystagmus (HGN) test revealed a lack of smooth eye pursuit and distinct nystagmus at maximum deviation, further indicating impairment. She struggled with the Walk and Turn test, failing to maintain a straight line, count her steps, or execute a proper pivot. Finally, during the One Leg Stand test, she was unable to raise her foot correctly and nearly lost her balance, stumbling backward. Based on her attempt to operate a motor vehicle (physical control) and her inability to adequately perform the field sobriety exercises, the officer placed Jessie under arrest. She was subsequently transported to a local detention facility, where she admitted to having snorted Neurontin earlier but refused to submit to chemical testing for alcohol.
