On October 27, 2024 at approximately 12:00 AM, Officer Donna Zorbas with the Wauconda Police Department observed a white 2018 Chevy Silverado swerving across lanes and speeding excessively while headed northbound on Highway 12 in the vicinity of Patten Drive. She began pursuing the vehicle and initiated a traffic stop prior to the Route 176 overpass. As she activated her emergency lights, she observed the driver throw a can out of the vehicle. The driver eventually stopped after making a right turn onto Pine Street. Officer Zorbas made contact with the driver, who was identified as Lucia De La Torre. There were 2 children in the backseat of the pickup truck, and they were not wearing seat belts. Lucia was asked for her license, but she only provided her Illinois State ID card since her license was revoked due to a prior DUI. As she was speaking with Lucia, she detected the odor of alcohol and observed indicators of impairment. After Officers Robert Pet and Jonathan Finze arrived on scene to assist, Officer Zorbas asked Lucia to exit the vehicle and perform field sobriety exercises. The first field sobriety exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Zorbas observed the lack of smooth pursuit and distinct, sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. After some hesitation, she refused to complete any additional field sobriety exercises. Based on her erratic driving, her indicators of impairment, and her inability to adequately perform the field sobriety exercises, Officer Zorbas placed Lucia under arrest for driving under the influence. Her brother was called to come to the scene and take responsibility for her 2 children. She was handcuffed, placed in the patrol car, and transported to the Wauconda Police Department for further processing. A search of her vehicle incident to arrest later yielded an open can of White Claw. At the Wauconda Police Department, Lucia was read the Warning to Motorist form, but she refused to provide breath samples. It was mentioned that she already had a prior DUI from 2017. Officer Zorbas spoke with the Assistant State’s Attorney and Lucia was subsequently charged with the following: -Aggravated DUI – Third or Subsequent Time (625 ILCS 5/11-501(d)(1)(A)) -Aggravated DUI while suspended or revoked (625 ILCS 5/11-501(d)(1)(G)) -Causing a child to be endangered (720 ILCS 5/12C-5(a)(2)) – 2 Counts -Causing circumstances that endanger a child (720 ILCS 5/12C-5(a)(2)) – 2 Counts -Child restraint violation (8625 ILCS 25/4) – 2 Counts -Transportation or possession of open alcohol by driver (625 ILCS 5/11-502(a)) -Littering from motor vehicle (415 ILCS 105/5) -Improper traffic lane usage (625 ILCS 5/11-709(a)) ------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
