It really helps us do original reporting like this. 🔍 Episode Overview: At around 3:53 PM on May 11, 2023, Officer Christopher Hopf responded to a report about a concrete street sign post that had been knocked over. When he arrived, he spoke with two men working nearby. They told him a blue Mercedes had hit the sign and then driven off. As the officers talked, a blue 2017 Mercedes matching the description passed by and caught their attention. Hopf pulled the vehicle over and identified the driver as Michele. While talking to Michele, Hopf sensed alcohol in her breath. He also saw her 15-year-old son sitting next to her. Her car showed damage consistent with hitting a sign post. Hopf asked if she had been drinking, and she said she had not. But he called Sergeant Chris Irons to the scene because he suspected Michele was impaired. Hopf then asked Michele to recite the alphabet from “E” to “T” and count backward from 87 to 68. She could not do either task well. Hopf moved on to field sobriety tests, starting with the Horizontal Gaze Nystagmus (HGN) test. During the test, he saw her eyes struggling to follow smoothly, nystagmus at maximum deviation, and nystagmus starting before 45 degrees. She also failed the One Leg Stand and Walk and Turn tests. Because of the car crash, her smell of alcohol, and her poor performance on the tests, Hopf arrested Michele for DUI. Her husband took her vehicle away after the arrest. Hopf took Michele to the police station for processing. At the station, Michele was read the Standard Statement for Motor Vehicle Operators. She agreed to give breath samples. She provided one valid sample. It showed her BAC was 0.17%, more than double the limit of 0.08%. She kept coughing and refused to give a second sample. Police charged her with refusal. Her husband was given a form to sign for her but refused.
