Around 2:58 PM on October 31, 2024, Patrolwoman Tina Pothos with the Edgewater Police Department responded to a motor vehicle accident involving a blue 2009 Nissan Altima on Route 5 in the vicinity of Undercliff Road. When she arrived on scene, she noticed that car had collided head-on with one of the boulders on the road and sustained severe front-end damages. She immediately made contact with the driver of the vehicle, and she was identified as Ashley. Patrolwoman Pothos administered oxygen to Ashley, and Ashley admitted to consuming alcohol before operating a motor vehicle. Patrolman Evan Bringas and Patrolwoman Gillian Cabrera arrived on scene to assist. Around this time, Ashley became uncooperative and told the officers that she was headed to pick up her children from school. She also indicated that she wanted to take her children trick-or-treating. Based on her apparent injuries, field sobriety exercises were not administered. First responders arrived on scene, and Ashley was placed inside the ambulance rig. Patrolwoman Cabrera rode with Ashley and she was transported to Englewood Hospital for further evaluation. At Englewood Hospital, Detective Sergeant Jorge Vanegas and Patrolwoman Cabrera asked Ashley to submit a blood sample, but she refused. However, her blood had already been drawn by hospital staff for medical reasons and the hospital informed the officers that they would test it for blood alcohol content. Ashley was later transferred to Hackensack Medical Center for further care. Since she refused to submit blood samples, the officers returned to police headquarters and began the process of obtaining a Dyal subpoena for the results of her blood test. Patrolwoman Cabrera issued Ashley the following citations: Operating under the influence, reckless driving, and careless driving ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. South Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
