As he neared milepost 33, he spotted a semi-truck in the southbound lane, followed closely by a 2016 Toyota Tacoma that was swerving dangerously into his lane. To avoid a head-on crash, Sergeant Jordan had to quickly steer his patrol car into the ditch on the southbound side. After making a U-turn and turning on his emergency lights, he attempted to pull over the Toyota Tacoma, but the driver kept swerving and ignored his signals. He radioed Whitcom, informing them he was in pursuit and requested an additional unit. Sergeant Jordan followed the swerving vehicle for about a mile until the driver finally stopped near milepost 32. Sergeant Jordan approached the car and spoke with the driver, a 38-year-old woman named Heather Bryan. She explained that she was on her way to visit her sister in Idaho. As he talked to her, Sergeant Jordan noticed a strong smell of alcohol coming from the vehicle, and her eyes were red and watery. When he asked her if she had been drinking, she denied it at first. Just then, Deputy Cory Alcantar arrived to help with the traffic stop. Sergeant Jordan suspected that Heather might be impaired, so he gave her a chance to take some voluntary field sobriety tests. First, there was the Horizontal Gaze Nystagmus (HGN) test. During this test, he noticed that Heather had trouble moving her eyes smoothly, showed noticeable nystagmus when her eyes were fully turned, and began to show signs of nystagmus before reaching the 45-degree angle with both eyes. Next came the Walk and Turn test. Heather struggled to walk heel-to-toe in a straight line, unable to follow the directions properly. Lastly, Sergeant Jordan asked her to do the One Leg Stand test, but Heather chose not to participate in that exercise. After completing the field sobriety tests, Heather was asked to take a breath test, but she declined. Given her erratic driving, her admission to drinking alcohol a few hours earlier, and her struggle with the sobriety exercises, Sergeant Jordan arrested her for driving under the influence. While Deputy Alcantar searched her car, he discovered four bottles of Jim Beam whisky on the passenger seat and floor. Sergeant Jordan took Heather to the Whitman County Jail for processing, while Deputy Alcantar stayed with the vehicle and the dog until Heather's sister arrived to pick them up. At the jail, Heather first wanted to talk to a lawyer, but Sergeant Jordan couldn't reach the attorney she wanted. Instead, he offered her a public defender, which she chose to decline. After that, Sergeant Jordan went over the Implied Consent Warnings with Heather, but she refused to provide breath samples for testing. Nevertheless, she still answered his questions, even though she had asked for legal help earlier. During the questioning, Heather admitted to having a few shots of alcohol earlier that day but couldn't remember how many. Since this was her second DUI arrest, she couldn't bail out until she saw a judge. She was charged under RCW 46.61.502 for driving under the influence and for refusing to take the breath tests, which is against RCW 46.61.5055. Heather was booked into jail at 4:28 AM and awaited her DUI hearing. On July 4, 2021, at 11:39 AM, records show that Heather posted bail. A few months later, on October 7, she entered a guilty plea and was found guilty. As a result, she received a sentence of 28 days in jail, followed by 60 days of electronic home monitoring and 36 months of supervised probation. Heather was also ordered to pay a fine of $1,250, along with a $43 Criminal Conviction Fee and a $600 Supervised Probation Fee 0:12 poor pup 1:41 look at the dog side eye like b*tch, you lying 5:47 I don't...I don't see well in this ear.
