Prior Arrest: https://www.youtube.com/watch?v=mp0RDAR5iOc Around 10:50 PM on March 27, 2023, Patrolman Evan Sicknick with the Berkeley Township Police Department responded to a motor vehicle accident in the area of Hickory Lane and Atlantic City Boulevard (US-9). The officers noticed that a 2020 Toyota Corolla was disabled in a wooded area east of Hickory Lane. It would later be determined that the driver was headed eastbound on Hickory Lane while disregarding a stop sign and driving straight into the woods. The officers made contact with the driver, who was identified as 19-yaer-old Nadia. There were 2 juvenile passengers inside the vehicle at the time of the crash. Nadia told the officers that she continued straight after being told to do so and as a result she drove into the woods. The officers observed indicators of impairment, and they asked Nadia to perform field sobriety exercises. Patrolman Sicknick started with was the Walk and Turn test. During the Walk and Turn test, Nadia failed to touch heel-to-toe on each step, turned improperly, and used her arms for balance. The second exercise was the One Leg Stand test, and Nadia failed to raise her foot in the proper fashion and put her foot down before the test was complete. Nadia was then asked to recite the alphabet from “A” to “Z,” without singing it, but she could not do so satisfactorily. The final exercise was the Horizontal Gaze Nystagmus (HTN) test that was administered by another officer. Based on the motor vehicle crash and her inability to satisfactorily complete the field sobriety exercises, Patrolman Sicknick placed Nadia under arrest for driving under the influence. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John’s Law. Patrolman Sicknick transported Nadia to the Berkeley Township Police Department for further processing. At police headquarters, Nadia was read the Standard Statement for Motor Vehicle Operators, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.19%, which was more than double the legal limit of 0.08% and 19 times the legal limit of 0.01% for drivers under 21. Nadia was photographed and fingerprinted following the Alcotest. After the officers were finished with processing her, she was transported to Community Medical Center in Toms River, New Jersey for further evaluation based on some concerning remarks that she had made. Patrolman Sicknick issued Nadia the following traffic citations: -Operating under the influence -Reckless driving -Careless driving -Disregarding a stop sign Nadia was also criminally charged with 2 counts of endangerment under 2C:24-7.1A(2) because both her passengers were minors. On January 3, 2024, Nadia was found guilty of operating under the influence. As a result of being found guilty, Nadia had to spend 12 hours at an intoxicated driver resource center, use an ignition interlock device for 9 months, and pay a total of $690 in fines. The other 3 traffic citations were dismissed as part of a plea agreement. Court records indicate that Nadia has previously been arrested for DWI in Middletown Township, New Jersey by the State Police on January 13, 2023. Prior to that, Nadia had also been arrested for another DWI in Barnegat Township, New Jersey on December 2, 2022. Following this arrest, Nadia was charged with shoplifting (2C:20-11B(1)) on January 31, 2024 in Stafford Township, New Jersey. She was later charged with the allegations of criminal mischief (2C:17-3A(1)) and simple assault (2C:12-1A(1)) in Stafford Township, New Jersey on May 28, 2024. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. Central Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
