Incident Report: On 08/04/2025 at approximately 11:10 PM, I, Trooper M.W. Peachman #5342, responded to a BOLO regarding a stolen vehicle traveling southbound on US 41 (SR-739). I was operating a marked patrol vehicle equipped with a light bar and push bumper. While en route on State Road 78 (SR-78), I observed a dark SUV traveling with its hazard lights activated at a high rate of speed westbound on SR-78. I attempted to catch up and observed the vehicle brake hard and drift approximately one-third into the left lane before correcting back into the right lane and coming to a complete stop. I believed the driver may have been in medical distress, attempting to reach a hospital, or recognized me as law enforcement and stopped to gain my attention and request help. I initiated a welfare check. Once I activated my emergency lights and sirens, the driver fled westbound on SR-78 at approximately 82 MPH. The driver attempted a U-turn on SR-78, at which time I initiated a PIT maneuver followed by intentional contact to force the vehicle into the curbed shoulder. The driver recovered and continued west on SR-78 at a high rate of speed. The driver then turned onto US-41 northbound, initially traveling north in the southbound lanes before correcting into the northbound lanes. The driver reached speeds between 75 MPH and 108 MPH before turning onto Del Prado Boulevard westbound and reaching speeds between 100 MPH and 110 MPH. The driver returned eastbound on SR-78, traveling between 100 MPH and 133 MPH, weaving through traffic without headlights or taillights. While on SR-78, just east of SR-31, I initiated a second PIT maneuver followed by intentional contact to assist the vehicle off the roadway. The vehicle came to rest on the shoulder, and the driver was ordered out at gunpoint and taken into custody without further incident. During a search of the driver's person, a glass pipe containing burnt residue was located in his front left pocket. A firearm was also recovered from the vehicle. The driver was identified as Colton Dean Smith via Florida Identification Card and corresponding photo located in his wallet. The driver was read Miranda warnings at approximately 11:31 PM. Post-Miranda, he admitted to fleeing because he is currently on probation and does not have a valid driver's license, stating he feared going to jail. He further stated the vehicle was a rental borrowed from a friend. The driver claimed to have consumed cocaine at approximately 6 PM but denied alcohol use. EMS evaluated the driver on scene for reported neck and back pain. I transported him to Lee Memorial Hospital, where he was medically cleared. He was then transported to Lee County Jail without incident. A DAVID query of Smith returned a total of at least 7 active driver license suspensions and 2 cancellations. Additionally, per DAVID, Smith has 3 convictions for driving while suspended. All events occurred in Lee County, Florida.
