On October 26, 2023, Rio Rancho police responded to a motor vehicle accident with possible injuries. When they arrived, two females were out the vehicle and the Fire Department had already arrived. The 23 year-old driver indicated that the car was not hers and that it apparently belonged to her boyfriend's father. Officers noticed signs or intoxication and there was an open container of alcohol in the vehicle. They requested her to perform standardized field sobriety tests. However, because of a pre-existing injury, she was unable to complete the walk-and-turn test or the one-leg stand test. She was given alternative tests, such as reciting the alphabet and counting backwards, which she failed miserably. She was arrested for DUI and was transported to the Rio Rancho police station, where she submitted to an evidential breath test. The result was 0.19% BAC. She then stated she wanted to exercise her right to have a secondary test conducted by a qualified person of her own choosing. Because of this, she was released with citations, instead of being taken to jail, which is standard practice in New Mexico. One the way out of the police station, she got into an argument with the officer, who said hello to a co-worker. Her charges are discussed at the end of the video. All suspects are presumed to be innocent until proven guilty in a court of law.
