First DWI Arrest: https://www.youtube.com/watch?v=lKzupZwhwVo Around 3:48 AM on January 31, 2026, Officers Michael Merli and Courtney Dembkowski with the Rutherford Police Department were dispatched to a call involving a disabled motor vehicle on Chestnut Street near West Passaic Avenue. They arrived on scene and noticed that a black 2019 Chevrolet Equinox had apparently struck a parked 2019 Honda HR-V as well as a parked 2023 Mercedes GLA-250. They made contact with the driver of the Chevrolet, and she was eventually identified as 20-year-old Elizabeth Mizerek. As they were speaking with Elizabeth, he detected the odor of alcohol and observed open containers of alcoholic beverages inside the vehicle. Elizabeth told the officers that she and her sister Molly were coming from a rave at the Williams Center in Rutherford. Officers Alvarez and Ahearn arrived on scene shortly afterwards and asked Elizabeth to perform field sobriety exercises. Her poor performance on the field sobriety exercises confirmed the officers’ suspicions of impairment. Based on the motor vehicle crash, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises, the officers placed Elizabeth under arrest for driving under the influence. The vehicle was impounded for a mandatory 12-hour hold under John’s Law. Elizabeth was initially transported to the neighboring Lyndhurst Police Department for the administration of the breath test. At the Lyndhurst Police Department, Elizabeth was read the Standard Statement for Motor Vehicle Operators, and she agreed to submit breath samples. Since their Alcotest machine malfunctioned, she was transported to the Hasbrouck Heights Police Department. Her Alcotest results at the Hasbrouck Heights Police Department indicated a BAC level of 0.16%, which was double the legal limit of 0.08% for drivers over 21. Elizabeth was then transported to the Rutherford Police Department for further processing. After they finished processing her, Elizabeth was eventually released to her mother Colleen Mizerek pending her court appearance after she signed the Potential Liability Warning form on Elizabeth’s behalf. Officer Alvarez issued Elizabeth the following citations: -Operating under the influence (39:4-50) -Operating under the influence underage (39:4-50.14) -Careless driving (39:4-97) -Open container (39:4-51B) Elizabeth has previously been arrested for driving while impaired in Morris Township, NJ on July 30, 2023. Court records indicate that as of July 27, 2026, her most recent DWI case from Rutherford, NJ is still pending in court. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
