RATON, NM - At 9:24PM on January 10th, 2020, Raton Police witnessed a driver traveling 15 mph on a main road in town and while being unable to stay in their lane. After the officer explained to the suspect what he had done, the suspect stated, "I don't think so." The officer asked how much he had had to drink for the night and the suspect said he had drank one alcoholic beverage. The suspect claimed that he left from a VFW and was on the way back to an RV park. When asked if the suspect had any conditions where he would be unable to perform field sobriety tests where mobility was necessary, the suspect indicated that he could not due to having a medical disability. Although originally asked to sit on the rear bumper of his vehicle, the officer told the suspect to sit in the driver seat of his vehicle to perform a horizontal gaze nystagmus test. The suspect claimed to be blind in with one of his eyes, but could still perform the test. The officer observed that the suspect was unable to follow the his finger and when tracking did occur, the suspect was unable to follow the officer's finger smoothly. The suspect was visibly confused and was under the impression that he was performing the test as instructed. The suspect was then asked to count backwards from the number 84 to 69. The suspect was unable to count in a continuous manner, repeated several numbers multiple times, and counted down to 60. The suspect asked the officer when he had to stop before completing his count. The officer then instructed the suspect to recite the alphabet from "K" to "Y." The suspect was unable to do so and failed to recite many of the letters. The suspect explained to the officer that he had mental problems and that he did not, "remember too good." The suspect then performed the finger count test correctly for one iteration, but was ultimately unable to complete. A second officer questioned the suspect who confirmed that he had stopped at the local VFW as well as another local bar and had been drinking immediately prior to driving. When being told that he was being placed under arrest for driving under the influence (DUI), the suspect became upset and in disbelief. The suspect was taken into custody with the officer placing his handcuffs in the front to accommodate for the driver's disability. Nothing evidentiary was found while searching the suspect person's. The suspect refused to provide a breath alcohol sample and was subsequently arrested and charged with aggravated driving while intoxicated (DWI).
