On November 11, 2023, Wayne County Deputy Derflinger observed a vehicle commit numerous traffic violations. He also observed the vehicle pull into a local McDonald's and sit in the drive-thru line, even though the fast-food restaurant was closed. When the vehicle pulled out of the parking lot, Deputy Derflinger initiated a traffic stop. He tells an Ohio State Trooper, who showed up as backup, that the 25-year-old woman has slurred speech, but he can't smell alcohol on her breath. He asks the woman if she had consumed any alcohol and she denies it multiple times. She agrees to perform standardized field sobriety tests (FSTs), but when it comes time to offer her a portable breath test (PBT), she refuses. Deputy Derflinger placed her under arrest for DUI and transports her to the local Ohio Highway Patrol post in Wooster, Ohio. She agrees to submit to an evidentiary breath test (EBT) and the result is more than 4 times the legal limit. Even the Supervisory Trooper, who administered the test, was surprised by the result.
