It really helps us do original reporting like this. 🔍 Episode Overview: At 11:05 PM on February 11, 2024, Patrolman Erik Macarico from the Hopatcong Police Department noticed a white 2017 BMW drift over the fog line while driving south on Lakeside Boulevard. As he followed the car, he saw it weaving in and out of its lane. He decided to pull the driver over just past the town line in Roxbury Township. Once the vehicle stopped, he asked the driver to park in the lot near the Liquor Factory store. Patrolman Macarico approached her to request her documents, identifying her as 21-year-old Liana. Liana told Patrolman Macarico she was leaving a Super Bowl party and heading home. While they talked, he noticed the smell of alcohol and other signs of impairment. When asked about her drinks, Liana claimed she had only one beer earlier that night. However, she later confessed to another officer, after doing field sobriety tests, that she had actually drunk more. Due to his concerns about her impairment, he asked Liana to step out of the car and perform field sobriety exercises. The first test was the Horizontal Gaze Nystagmus (HGN) test. Patrolman Macarico noted that Liana did not follow smoothly with her eyes. He saw clear signs of nystagmus when her eyes reached their limit and noticed it began before she turned 45 degrees. He also found vertical nystagmus in both of her eyes. Next came the Walk and Turn test. Liana struggled here as well, failing to touch her heel to her toe with each step. She also did not take the correct number of steps. Finally, there was the One Leg Stand test. Liana could not lift her foot properly and had trouble balancing. Liana was arrested for driving under the influence after Patrolman Macarico noticed her erratic driving. He detected the smell of alcohol and heard her admit to drinking before getting behind the wheel. Liana struggled to complete the field sobriety tests, which led to her arrest. Her car was towed by J.C. & Daughters Towing and held for 12 hours due to John’s Law. She was then taken to the Hopatcong Police Department for processing. Liana went to the Hopatcong Police Department, where officers explained the Standard Statement for Motor Vehicle Operators. She agreed to take a breath test, which showed her blood alcohol content was 0.18%. This was over twice the legal limit of 0.08%. After finishing their paperwork, the officers released her to her aunt, who signed the Potential Liability Warning Form for her. Liana received several summonses for operating under the influence, reckless driving, and improper lane usage. On June 19, 2024, court records show that Liana was convicted of operating under the influence. As part of her sentence, she must use an ignition interlock device for ten months. Additionally, she is required to attend a 12-hour program at an intoxicated driver resource center and pay fines totaling $690.
