Around 2:14 AM on January 27, 2024, Patrolman Matthew Schou with the Eatontown Police Department responded to the Avenue of Memories near the intersection with Route 35 in a report of a female that was passed out behind the wheel. He arrived on scene and noticed that female behind the wheel of a white 2019 GMC Acadia was slumped over. The officers knocked on the window, but she did not immediately awaken. The other officers used a vehicle lockout kit and opened the passenger side doors before she was awakened. As she awakened, she lifted her foot from the brake pedal, which caused her to strike a police vehicle that was parked in front. Patrolman Schou then made contact with the female, who was later identified as Erin Busby. As he was speaking with Erin, Patrolman Schou detected the odor of alcohol and observed other indicators of impairment. Based on their suspicion of impairment, Erin was asked to exit the vehicle and perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Erin failed to touch heel-to-toe on each step and turned improperly. The final exercise was the One Leg Stand test, and Erin failed to raise her foot in the proper fashion while putting her foot down before the test was complete. Based on her falling asleep in her car, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily complete the field sobriety exercises, Erin was placed under arrest for DWI. Her vehicle was impounded for a 12-hour hold according to John’s Law. Patrolman Schou transported Erin to the Eatontown Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to her, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.15%, which was nearly double the legal limit of 0.08%. She also admitted to consuming beer and margaritas at Baseline Social in Oceanport earlier that evening. After they finished processing Erin, she was released to her husband pending her court appearance after he signed the Potential Liability Warning on Erin’s behalf. Patrolman Schou issued Erin the following traffic tickets: -Operating under the influence (39:4-50) -Reckless driving (39:4-96) -Careless driving (39:4-97) ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. Central Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
