He turned on his emergency lights and pulled the car over. When he reached the vehicle, he identified the driver as 22-year-old Arielle Nelson. While talking to her, he smelled marijuana and noticed a front seat passenger as well as a child in the back who was not wearing a seatbelt. When asked about her alcohol consumption, the driver admitted to having taken 2 shots. He requested Arielle's identification and went back to his vehicle to check her license. The system indicated that her license was suspended, and her passenger had outstanding warrants. Suspecting that Arielle might be impaired, he instructed her to step out of the vehicle for field sobriety tests. Officers Brown, Wagner, and Hermerlein soon arrived to help. Before starting the sobriety test, Patrolman Cervik asked Arielle to take a breathalyzer test, which showed a blood alcohol concentration of 0.143%. The first field sobriety test conducted was the Horizontal Gaze Nystagmus (HGN) test. In this test, Patrolman Cervik noted that the subject could not smoothly follow movement. Additionally, there was noticeable shaking in her eyes at the farthest point of gaze and shaking began before reaching a 45-degree angle in both eyes. The second test was the One Leg Stand. During this test, Arielle wobbled and set her foot down several times. The third test was the Walk and Turn. In this exercise, Arielle failed to place her heel directly in front of her toes, stepped off the line multiple times, and did not turn correctly. Patrolman Cervik arrested Arielle for Operating a Vehicle Impaired (OVI) due to her speeding and poor performance on field sobriety tests. After her arrest, Officer Cervik searched her car and discovered marijuana and a bottle of tequila. She was then taken to the Solon Jail for processing. At the jail, Arielle was informed about BMV Form 2255 and consented to a breath test, which showed a blood alcohol content (BAC) of 0.14%. Jasmine Moore, a passenger in the vehicle, had outstanding arrest warrants from Bratenhal, Ohio, specifically for not showing up for an OVI charge. However, at that moment, the Bratenhal Police Department chose not to take her into custody. Instead, the Solon Fire Department transported Jasmine and her child to Ahuja Hospital for further evaluation. After her processing at the jail, she appeared in court for a bond hearing and was released on a personal bond of $1500. Her court date is scheduled for May 26, 2023, at 1:30 PM.
