Police Report: BOCA RATON, Florida "On 11/11/2021, at approx. 0035 hours, I responded as a back-up Officer for a traffic crash. Upon arrival, I observed a black BMW sedan and a white Ford transit van appear to have been involved in a crash. The black BMW was parked facing west. The white van was facing east in the middle of the street. Both vehicles had damage to the front passenger side consistent with a head on collision. The owner of the M+BMW advised that the vehicle was parked and unattended at the time of the crash. According to officer Crawford, he observed W/M Luke sitting in the driver seat of the white Ford when he arrived. Officer Crawford also informed me that Luke told him he had been drinking at “Shanigan’s” (possibly Flanigan’s). I then made contact with Herzog and immediately observed that he was barefoot, his eyes were red and glossy, his speech was thick and slurred, and he had an overwhelmingly strong odor of alcohol emanating from his breath when he spoke. [After conducting field sobriety tests] Based on my investigation, and the totality of circumstances, I found probable cause to believe that, at the time of the crash, Luke was operating a vehicle within the state while impaired by alcohol. Luke was transported to BRPD booking for post arrest processing and the administration of a breath test. Luke provided two breath samples of .051 and .046. Luke was later asked to provide a urine sample. Luke agreed and provided a sample [results not public yet]."
