Please like, comment, and SHARE! 🙏 🔍 Episode Overview: At about 6:03 PM on March 5, 2023, Sergeant Anthony Steneck from the Belmar Police Department was on patrol when he saw a Nissan Altima stopped on the railroad tracks at the corner of 7th Avenue and W Railroad Avenue. The car had hit a railway signal. He called dispatch to have NJ Transit halt all train traffic and then approached the driver, who was identified as Rosemary. The sergeant noticed that the airbags in the car had deployed, so he requested EMS to come and check on her condition. While waiting for the emergency responders, he also smelled alcohol. Belmar EMS arrived to assess Rosemary, while Sergeant Steneck looked for her documents in her car. During his search, he discovered an open container of High Noon vodka. After Rosemary chose not to receive additional medical care and refused to go to the hospital, Sergeant Steneck initiated his DWI investigation. Rosemary was asked to do some field sobriety tests. The first test was the Horizontal Gaze Nystagmus (HGN) test. Sergeant Steneck managed to assess her gaze until she leaned back, prompting him to make sure she wouldn't fall. Next, he tried the Walk and Turn test, but Rosemary did not cooperate. Since the tests could not be finished, Sergeant Steneck decided to arrest her for driving under the influence. This decision was based on the traffic accident, the smell of alcohol on her, an open container of alcohol found in her car, and signs that indicated she was impaired. After Rosemary was arrested, a female officer from the NJ Transit Police searched her and found a bottle of fireball whiskey in her pocket. Her car was also searched and taken for a mandatory 12-hour hold under John’s Law. Sergeant Steneck took Rosemary to the Belmar Police Department for processing. At the station, the sergeant explained the Standard Statement for Motor Vehicle Operators to her, but she refused to provide breath samples for testing. Rosemary was charged with refusal and placed in a holding cell until someone could pick her up. She received several summonses, including operating under the influence, refusal to submit to a chemical test, reckless driving, traffic on marked lanes, and having an open container of alcohol. Court records show that on October 4, 2023, Rosemary was convicted of reckless driving and having an open container, receiving a $240 fine for each charge. Her citation for driving in marked lanes was combined with the other charges, and she was also found guilty of refusing a chemical test, resulting in a $340 fine. Due to this refusal, she was ordered to complete 12 hours at a resource center for intoxicated drivers and to use an ignition interlock device for 7 months. On January 4, 2024, Rosemary was again found guilty, this time for operating under the influence, and she faced a $640 fine. In total, she paid $1,460 in fines from these citations.
