Around 4:50 PM on June 29, 2023, Patrolman Giovanni Santiago of the Westlake Police Department responded to a call of a reckless operation involving a 2010 Jeep Patriot in the parking lot of 29979 Detroit Road (US Bank). He was able to locate the Jeep and make contact with the driver, who was identified as 36-year-old Dominique Howell. As he approached the vehicle, he noticed that her vehicle had struck the 2021 Chevy Blazer in front, and Dominique was slumped over on the steering wheel. Dominique’s speech was slurred and her eyes were watery and bloodshot, so Patrolman Santiago suspected that she was impaired. Patrolman Santiago asked Dominique where she had been, and she told him that she was coming from Crocker. When he subsequently asked her how much she had to drink, and she responded by saying that everyone drinks these days. She seemed unaware that she had struck another parked vehicle and her statements were inconsistent. Based on his suspicion of impairment, Patrolman Santiago afforded Dominique an opportunity to perform standardized field sobriety exercises, and she agreed to do so. Around this time, Patrolwoman Victoria Kirby and Patrolman Richard Dudas arrived on scene to assist. The first field sobriety exercise was the Horizontal Gaze Nystagmus (HGN) test. During this test, Patrolman Santiago observed a lack of smooth pursuit, but he was unable to complete the test because she was not cooperative. The second exercise involved the Walk and Turn test. During the Walk and Turn test, Dominique failed to walk heel-to-toe and did not take the correct number of steps. After conferring with Patrolman Dudas, Patrolman Santiago determined it would not be safe to attempt to One Leg Stand test, while concluding that Dominique was impaired. Based on the traffic accident, Dominique’s incoherent speech, and her inability to adequately perform the field sobriety exercises, Patrolman Santiago her under arrest for Operating a Vehicle Impaired (OVI). After she was placed under arrest, Patrolman Santiago and Patrolman Dudas searched her vehicle, and they found a crack pipe along with marijuana and open containers of alcohol. All of the contraband was inventoried, photographed, and some items were placed into evidence. Dominique was subsequently transported by Patrolwoman Kirby to the WPD Jail for processing. Once she was at the jail, Patrolman Santiago read her the BMV 2255 ALS form, and she continued interrupting him. Dominique continued to be uncooperative, and she ultimately refused to submit breath samples for testing. After Dominique was processed, she was cited for OVI and driving under suspension. She was also charged with having an open container of alcohol and being in possession of marijuana. ----------------------------------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
