On May 13, 2024, Las Cruces Police Officers responded to Apodaca Park after receiving a report of a domestic dispute. When the first officer arrived, witnesses described a man assaulting a woman. When the witnesses tried to intervene, the man allegedly pulled a firearm and pointed it at them. The vehicle with the man and woman sped off shortly before officers arrived. A description of the vehicle was broadcast on the police radio frequency and assisting officers located the vehicle and initiated a traffic stop. It turns out the driver with the firearm was an unlicensed 16-year-old boy. The victims did not want to press charges, so the aggravated assault charges were not investigated. However, the young man's girlfriend told police that the 16-year-old had been drinking and an open container of alcohol was found in the vehicle. Officers administered field sobriety tests on the driver and he was eventually placed under arrest for DUI. He went from a tough firearm-carrying 16-year-old, to a drama queen crybaby very quickly. He was taken to the Las Cruces police station where he submitted to an evidential breath test. He was later released to the custody of his guardian, who turned out to be his older brother. The 16-year-old was charged with Driving While Intoxicated, Having an Open Container of Alcohol, Being an Unlicensed Driver, No Insurance, and No Vehicle Registration.
