They noticed a woman who was asleep behind the wheel of a 2011 Acura on Route 27, close to S Sixth Avenue. The police headquarters informed him about a driver in distress, and he quickly radioed back that he was already at the scene. Activating his emergency lights, he approached the vehicle to make contact with the driver. Brittany, the driver, regained consciousness after a few minutes. Patrolman Sica opened the door on the other side to shift the vehicle into park. While speaking with her, Patrolman Garrity noticed a smell of alcohol and asked how much she had to drink. She replied that it was “not too much.” Brittany mentioned she came from Atlantic Highlands and admitted to having a vodka club before getting behind the wheel. Due to signs of impairment, she was asked to take field sobriety tests. Patrolman Garrity began by conducting the Horizontal Gaze Nystagmus (HGN) test. During this test, he noticed that Brittany's eyes did not move smoothly. He saw distinct jerking in her eyes when they were at the maximum angle, and the jerking started before reaching 45 degrees. Next, they moved on to the Walk and Turn Test. Brittany struggled with this task; she failed to place her heel next to her toe on each step and did not turn correctly. Finally, they tried the One Leg Stand test. Here, Brittany could not lift her foot properly. Instead of focusing on her foot while counting, she kept looking at the officer. Brittany fell asleep while driving, smelled of alcohol, and admitted to drinking earlier. She couldn't complete the field sobriety tests, which led to her arrest. After her arrest, her vehicle was taken and held for 12 hours as per John’s Law. Patrolman Garrity took Brittany to the Highland Park Police Department for processing. At the station, he read her the rules for drivers, and she consented to give breath samples. The Alcotest showed her blood alcohol content was 0.13%, above the legal limit of 0.08%. After processing Brittany, authorities released her to a sober adult. This was done in preparation for her court date at Highland Park Borough Court on September 13, 2023. The adult signed a liability warning for Brittany. Patrolman Garrity issued several citations to her. These included operating under the influence, reckless driving, not wearing a seatbelt, blocking other vehicles, lacking liability insurance, failing to inform the DMV about her address change, and having touring privileges. On April 25, 2024, Brittany was convicted of driving under the influence. Because of this, she had to use an ignition interlock device for three months. She also had to spend 12 hours at a center for intoxicated drivers and pay $740 in fines. The other six charges against her were dropped as part of a plea deal. Brittany faced legal trouble on March 25, 2023, when she was arrested for driving while intoxicated in East Brunswick, NJ. Later, on November 7, 2023, she received a ticket for careless driving in Shrewsbury, New Jersey. 1:19 Love. by Kendrick Lamar! So vibey, so good. 8:27 she apologizes for her outfit.
