Police report: "On 11/9/21 I, Deputy Gaddie, conducted a traffic stop at Wawa. While at the Wawa gas station I observed a silver ford pull into the gas station with no visible light passage through the side windows, parked in the front row of the gas station. While sitting at the gas station we observed several vehicles in the parking lot alarms begin to sound. We also observed no occupants of the new vehicle exit their vehicle or observe any car alarm issues prior to that vehicle's arrival. We made contact with the employees of Wawa who confirmed the vehicles in the parking lot with the car alarms belonged to no one in the store and possibly belonged to the occupants of the silver ford that entered the parking lot just prior to the anti theft alarms sounding. Upon making contact with the occupants of the silver fordI identified myself and was wearing a standard class B sheriffs uniform with visible five point star on my hat and cheesy. I told the operator I was contacting him regarding window tints and needed to see his license. The operator laughed and said the vehicle wasn't his and that he did not have his license with him. Upon confirming he did not have his license with him he took the license out of his pocket and asked why I was requesting to see it. I once again explained his vehicle was in violation of Florida code and I was requesting his ID. He once again refused stating the vehicle isn't his and he didn't need to give me his license. I requested the operator exit the vehicle, he refused saying he did not need to exit the vehicle. I explain Pennsylvania V. Mimms and that law enforcement may request the operator to exit a vehicle at any time. The operator once again refused. I explained to him if he refuses to step out he would be placed under arrest. I asked the operator to step out and face away from me. Upon the operator stepping out of the vehicle I could see he was visibly nervous and attempted to walk between the vehicle and myself, once again not listening to my request to face away from me and raising my suspicion further. I redirected the operator's body movements back to the area around the driver's door after being told three times to face away from me. I reached for the operator's right hand to conduct a pat down based on the totality of the circumstances. The operator pulled his right arm away from me and lifted it over his head telling me I was not putting on cuffs (it should be noted prior to this statement it was not my intention to secure the subject in handcuffs). Based on my experience with subjects acting similarly involved in greater criminal activity than is known to me and the totality of his previous refusals, it raised my caution with the subject's behavior again. At this time, the operator placed his hands in front of him and began placing tension in his arms, resisting me freely moving them behind his person. Upon finally getting his arms behind him, I clasped his hands together for the terry frisk and began removing the objects he was holding from his hands. The operator then began to pull his right hand from my grasp. Concerned he was attempting to further resist me I grabbed his hoodie to prevent any fighting. The operator exclaimed the fast movements due to attempting to catch a vape pen he dropped and began telling other vehicle occupants to call his mother “because we about to handle this, dea a**”. During my investigation David began screaming the lyrics to the song wrecking ball across the parking lot. David's actions continued to interfere with the safe expeditious completion of the traffic stop. After David was secured with server deputies standing by I was able to determine the window tints on the vehicle to be 5% and the occupants of the stopped vehicle were the owners of the various other vehicles in the parking lot causing their anti theft alarms to sound. The owner of the ford was one of the seven occupants inside. Charged with resisting officer without violence” How to Turn Window Tints into an Arrest
