[Disclaimer: This video content is intended for educational and informational purposes only] Calgary, Alberta, Canada — On March 28, 2019, officers from the Calgary Police Service (CPS) conducted a traffic stop during a drug trafficking investigation. Footage of the arrest was captured by Constable Steve Kelly's body-worn camera, which was later revealed to have been accidentally activated. This footage was originally obtained by The Star (voice-over audio has been cut out to retain authenticity). Const. Kelly's body-worn camera footage depicts several officers approaching both sides of a grey Volkswagen SUV that had pulled over to the side of the road. The driver, Joshua Saunders, partially rolled down the window to speak with the officers. Officers then attempted to open the door before Const. Kelly reaches in and grabs Saunders by the head. In just a few seconds, the driver's side window breaks as Const. Kelly punches the driver in the head several times before the door is opened, and at least three officers lean in to pin down and subdue the driver. The next clip in the published footage shows a handcuffed Saunders standing at the hood of an undercover police car. One officer begins questioning him before Const. Kelly approaches Saunders from behind, bends him over the hood, and yells at him. Another officer then says, "This can go really easy for you or a lot harder. Okay, you make the choice." In the final clip, Const. Kelly is using another officer's phone to call the station and ask if he left his cellphone there. During this conversation, he says, "I just f**cking beat the sht out of this kid and now my phone's not in my pocket." Officers later found nearly 100 grams of cocaine and $5,850 in cash. Saunders was then charged with possession of cocaine for the purpose of trafficking, possession of the proceeds of crime, and unlawfully resisting arrest. Following a judicial review, an Alberta Court of Queen's Bench judge found that the officers committed multiple and serious breaches of Saunders’ rights under the Canadian Charter of Rights and Freedoms, including the right to be secure against unreasonable search and seizure (Section 8) due to the arbitrary arrest and the excessive force used. The judge specifically cited Const. Kelly's casual admission of the assault as evidence of flagrant misconduct. The judge ruled that admitting the subsequently discovered drug evidence—obtained as a result of the illegal arrest and force—would bring the administration of justice into disrepute. Consequently, the court excluded the cocaine and cash evidence under Section 24(2) of the Charter, resulting in all criminal charges against Joshua Saunders being dismissed.
