Around 1:44 AM on August 15, 2022, Officer Patrick Barry with the Hillsborough Township Police Department observed a 2017 Hyundai Tucson parked in the westbound lane of Old Camplain Road with its hazards on. As he approached the vehicle, the vehicle began heading towards Route 206. The vehicle failed to make a complete stop at a stop sign before making a right turn on to Route 206 northbound. As the vehicle approached Park Avenue, it began drifting over the double yellow lines. Officer Barry proceeded to activate his emergency lights to initiate a traffic stop on Route 206 in the vicinity of Brooks Boulevard. He proceeded to make contact with the driver, who was identified as 28-year-old Ariana Acunavargas. He asked Ariana where she was coming from and Ariana asked Officer Barry if he spoke Spanish. She was able to tell Officer Barry that she was coming from Hillsborough and heading towards her boyfriend’s place in Elizabeth, New Jersey. Officer Barry radioed for Officer Dennis Rivera to come on scene to translate for him. After a short wait, Officer Rivera arrived on scene and asked Ariana in Spanish whether she had been drinking. She denied consuming alcohol, but Officer Barry wanted to examine her eyes because he detected the odor of alcohol in her vehicle. Based on their suspicion of impairment, the officers asked Ariana to exit the vehicle and perform field sobriety exercises. Officer Barry started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Ross observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test. During the Walk and Turn test, Ariana was unable to maintain her balance, did not walk heel-to-toe, and failed to turn properly. The third exercise was the One Leg Stand test, and Ariana put her foot down multiple times while raising her arms for balance. Based on her erratic driving patterns, the odor of alcohol on her person, and her inability to adequately complete the field sobriety exercises, Officer Barry placed Ariana under arrest for driving under the influence. Her vehicle was searched and impounded for a mandatory 12-hour hold under John’s Law. Officer Barry subsequently transported Ariana to the Montgomery Police Department for initial processing because the Alcotest machine was not functioning at the Hillsborough Township Police Department. At the station, the Standard Statement for Motor Vehicle Operators was played for her in Spanish, and Ariana agreed to submit breath samples for testing. Officer Thomas Ward of the Montgomery Police Department administered the Alcotest machine after a 20-minute observation. Ariana’s Alcotest results indicated a BAC of 0.20%, which is more than double the legal limit of 0.08%. After Ariana was processed, she was transported to the Hillsborough Township Police Department for further processing. She was subsequently released to her boyfriend pending her court appearance after he signed the Potential Liability Warning on her behalf. Ariana was issued the following summonses: Operating under the influence, open container of alcohol, failure to keep right, failure to possess insurance card, and failure to observe stop sign Court records indicate that on March 27, 2023, Ariana pleaded guilty to operating under the influence and paid a total of $740 in fines. Her license was revoked for 4 months and she was also required to use an ignition interlock device for 9 months and spend 12 hours at an intoxicated driver resource center. The other 4 citations were dismissed as part of a plea agreement. ------------------------------------------------------------------------------------------------------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
