on the evening of November 28 2022 in Stock Island Florida Deputy Tanisha multi was on a routine Patrol when she noticed a man operating a black electric scooter bike with no lights the subject was wearing a long blonde wig topped with a gray hat and his bike had a distinct sticker on the back the following night or rather in the early morning hours of November 30th she spotted the subject again recognizable by his gray hat and the sticker on the back of the scooter the man still had no lights and was crossing a highway Deputy Tanisha and another deputy now enroute flashed their lights to conduct a traffic stop but the man continued to ride the scooter over a bridge a stop like this is technically legal as an officer is only required to possess a reasonable suspicion that a traffic violation or crime has been committed in Florida as of 2019 electric scooters are treated similarly to bicycles like bicycles they must follow certain rules of the road and therefore the operator is subject to any violations that may arise including the act of operating them in a manner that does not comply with the vehicle laws scooters need to follow bike laws in between sunset and sunrise bikes and scooters must display a front white light in a rear red reflector the subject pointed his finger toward the other side of the bridge and the deputy assumed that he intended to stop there but things are about to take an unexpected turn once over the bridge the subject dropped his scooter and ran into a hotel garage and out towards the water off the bike get out the water now get out I don't do nothing get out get out the water again I'll beat me up again bro no I'm getting the dog I'm getting the dog now gonna beat me up again bro get out the water y'all gonna beat me up again no 11 28 we're in the Water behind Beachside the man is about 25 feet out in the water and will not cooperate with police as he moves further out his hands go below the water and the officer draws his taser and prepares to discharge it get out the water get out the water let me see your hands in your pocket let me see your head get out the water now it likely didn't help the suspect's state of mind or willingness to cooperate when the officer deployed a taser in an attempt to subdue him since the suspect had nowhere to run or hide and was otherwise Cooperative by keeping his hands in plain view the situation could have likely been maintained without the additional escalation walk towards me now and start walking Out start walking 11 28 male's still in the water refusing commands the man identifies himself as Jose vigil but still refuses to cooperate unless the police call a family member to act as a witness police call for a K-9 unit and boat to collect them from the water along with a sergeant he is familiar with this is an interesting scenario that we don't often see as he wanted a particular Sergeant present at his arrest apparently someone he knows and trusts to treat him fairly nope that's fine like they said they got a boat and a dog in route bud [Music] we got somebody on Shore over there anyway you can get nowhere I mean all he's going to do is go to jail tired so far you haven't replied with any commands sir I have no idea yeah [Music] so right now you're resisting investors so so we call him and say what your cousin's in the water what is resisting what are you doing but you're not complying with lawful commands and you you fled from a traffic stop so what's he gonna do because you know what he's gonna tell you stop being a stupid ass and get on the dirt exactly but I don't want somebody I know this here again it don't matter yet it doesn't matter what he's got he's not coming out because they know me yet first [Laughter] time I know and one of y'all know me ain't nobody here know me no no again man but that's not how this works you don't get to run I don't feel safe bro okay I'm gonna try to get violent I don't feel safe after Jose was in the water for approximately 15 minutes he only finally came out when the sergeant he requested arrived on scene all right look there's your uh there's your requested Sergeant he's on scene so now will you step out on the dirt please not gonna tackle you're coming out on your own right so yesterday what's in these Pockets anything well I think that apartment has some weed on me that's it okay I got beat all last time all right listen we're gonna detain you real quick okay okay but then we're gonna have a seat right there in the chair so that way I can talk to you all right okay any weapons no weapons and then we're gonna we're gonna get you right here to the chair we can talk to you for a second Deputy multi the officer that first attempted the traffic stop performs a search of his belongings and finds some interesting items so that's interesting appearance what's this yeah cause look at that wigs and sunglasses that's a very interesting did you guys find the marijuana no I haven't found it oh where you keep it Jose come on you won't be telling myself I mean either you tell me now or they find it at the jail and you catch another charge that's all you just said you did man that's all yeah okay so maybe you dropped it on your your uh jump from the street the street to the beach I don't know okay deputies find his marijuana and other substance related items in the bushes and in his personal belongings Jose has a long list of arrests that include charges of battery tampering with evidence Grand Theft possession of Narcotics without a prescription and drug possession with intent to sell Jose is taken by medical transport to be evaluated and then brought to the county jail where he is charged with fleeing a traffic stop resisting arrest marijuana possession and Drug equipment
