got you I got you have you had any recent head injuries no do you wear eye contacts nope give me a favor put your feet together all the way together hands real quick aside I'm gonna need you remain in that position there do you understand yeah I'm gonna start the tip of my right index finger with your eyes and do not move your head do you have any questions completely understand my instructions bring your chin down a little before please follow my fingers yeah yes ma'am stand directly in my finger please as smart as you need to stay on my finger okay okay five forty two come on turn four so I can tell when you're looking at it and I can tell when you're looking past it okay okay so on the same page you understand yes right from the finger okay continue where I left off okay okay is my head good sorry okay cool okay directly my fingertips please [Music] foreign a little bit okay all right [Music] boy it's income for Orlando New Mexico let me ten six fields I'm pretty sure okay man so I don't want you to stand right here on this line because if you accidentally step off you're going to end up twisting the ankle okay okay so we don't want that let's have you stand right here we're gonna face your vehicle so this is a paper surface there's nothing that's going to twist your ankle harm you anyway correct normal sandal there's nothing like a hill or anything like that we do there's a map you picture an imaginary line put your feet together just like mine yep I'm gonna have you put your imaginary line on the ground from where your left foot is straight out in front of you to my right foot can you put your straight line on the ground yes or no yeah okay this Line's gonna be approximately the width of your shoe do you understand that sure yes or no yes well maybe do is I'm having to take your left foot place on that line take your right foot place it directly in front of your left foot touching Heel To Toe hands Drake that you're done yes ma'am all right I'm gonna need you remain in that position there until I'm done give me all the instructions you're not going to start the test till I tell you do so do you understand yes so not till I tell you do so you're going to take nine steps forward on this imaginary line okay you're going to look downward at your feet count each step out loud touch heel to tone each step and keep your hands directly inside at all times if you have any questions does this count as one so the first one's gonna be with your left foot when we turn back to that position yes ma'am so I'm going to demonstrate it's gonna look like this man yeah one two three see I did that you cook your beef yes ma'am I took three steps you're gonna continue all the way to nine do you understand I'm only gonna take three steps so on your ninth step your front foot's gonna stay planted on the ground when we turn back to that position please on your nightstep your front foot's gonna stay planted on the ground with your back foot which is your opposite foot you're gonna take a series of small steps just like this turn yourself up to the opposite direction you see I turn around give any questions on the training process and what was that I'll show you again so leave that front foot planter on the ground with your opposite what you're gonna take a series of small steps just like this okay even that front foot planted you understand got you now you're gonna be facing the front of my petroleum approach you back nine steps on the same line like so and one two three continue all the way to nine once again I took three steps how many steps you're gonna take nine once you start this test you cannot stop until it's completed fully if you have any questions you completely understand my instructions Gonna Keep Your Hands right good decide and go and begin them yes ma'am let him again I want you planted and then right foot starts one two three four five six okay one stand right here for me please ma'am yes facing me I'm taking a little step backwards for me please put your feet together just like mine hands regular side I'm gonna need you remain in that position there do you understand yes sir so you're not going to start the test I tell you to do so okay but when I do tell you do so you're gonna pick the foot of your choice you could be your right foot or your left foot okay approximately six inches from the ground okay I'm gonna keep your foot parallel to the ground okay keep your hands dragged inside both legs straight you're going to look down at your raised foot and you're going to count and upper mounted by one thousand similar to this one thousand one 1002 1003 and continue counting upward by one thousands until I die to stop okay do you have any questions completely understand my instructions yeah so I'm gonna demonstrate this test is gonna look like this man I'm gonna pick my right foot for my demonstration you're gonna lift that foot approximately six inches from the ground you see I'm doing it and keep your foot parallel to the ground don't point it up this is parallel the instant hands record side both legs straight yeah you're going to look down at your raised foot and you're going to count in the upper mounted by one thousand seven minutes one thousand one one thousand two one thousand three you continue counting upward by one thousands until I tell you stop giving questions completely understand my instructions and what leg did you say you had to pull muscle in you left your left leg okay so I highly recommend you pick that one up but it's ultimately your choice you understand I think it's okay I'm doing my right is that okay it's ultimately your choice man okay no questions on you man I'm gonna begin um I think your full muscle wasn't bothering you not bad okay do you feel like you should be driving right now not specifically but I am close to my destination why are you sure you should be driving right now I did have a drink earlier so I don't know how much that impaired me to be honest with you I'm not do you feel like you're impaired no not too bad but I know that I do feel a little bit something okay you feel a little bit something okay I don't feel like you should be driving I really don't okay don't know if you walked to the front of my uniform please okay just walk straight to the front bumper please do not move okay okay time is 12 47 okay okay you're being arrested for DWI at this time okay do you have anything that's gonna stab me Pokemon anyway so what I'm gonna do is I have to conduct a pad search on you okay what I'll do is I'll walk you through it before I actually do it okay I'm gonna have your face in front of my petroleum where there's a camera okay I'm gonna realize the back of my hand will go down the side of your breasts I'm also going to go underneath your breasts and apply pressure upward and towards the direction I'm standing okay do you have anything I need to stab me poke behind me when anyway if you have a brawl one yeah you have anything you brought money Keys anything okay and you said you had keys on your person is that the one right here right here in the pocket my left okay don't take a step back for me please face in front of my patrol unit spread your feets on please I'm gonna do that now ma'am okay I'm gonna grab a hold of the ball sorry if I pinch you okay I need you to underneath and in between kids are in here uh no it's pocket it's in my belt loop on your belt loop yeah they're hooked okay you want to check it foreign underneath in between okay okay anything it's on Pockets rear pockets okay listen to me I've got to tell you something important okay you're under arrest for driving onto the influence I've been toxic in the grand old drugs the New Mexico act requires you to submit to a breath test to determine the alcohol content of your blood after you take our tests you have the right to choose an additional independent test if you choose to take this additional independent test you have the right to reasonable opportunity range for physician a licensed nurse laboratory technician or technologist who is employed by a hospital or physician of your own choice to perform additional chemical tests because of this additional test we behave by the law enforcement agency which is New Mexico State Police do you agree to take our tests yes or no yes okay so I'm not going to continue reading since you're going to be tested is that correct okay man listen I'm gonna have you open your mouth for me please stick your tongue out lift it up to the sky you have anything in your mouth that you eat drink or smoke anything on your personal cheeky drink or smoke time is 12 50 a.m going to walk through my vehicle please and have a seat just this way yes ma'am okay and then just bring your feet in okay you're gonna have to squeeze in and the belt will go over you don't worry we'll get a little bit more comfortable right now once you get in okay there you go your car's gonna have to get towed okay so we're gonna make sure your friend gets uh she can't drive it no unfortunately not gonna lean back home please okay um please I won't call him until we get to where we need to get to and then see the office okay on anything else I have your idea ready give me one second okay fight for reaching them can you make a note at 12 47 a.m going to show the driver 10 15 for 10 47 and Pike the same was red she was verbally agreed to be tested mouth is free and clearly external Deputy base period at 12 50 a.m and roll 46 please if you haven't foreign how do you read them all right pretty you're a lot I'm sorry I can't hear you 10 4 can you just make a note at 12 47 a.m I'm gonna show the driver 10 15 for 10 47. like the same was red she has verbally agreed to be tested mouth is free and clear my deprivation Spirit at 12 50 a.m rule 46 please so I'm gonna need you to call for a ride Yes Man your cell phone please and then her wallet please no wallet please my wallet I didn't bring my wallet it's in the other car her wallet I have an oh thank you ma'am how old are you I'm 19. you're 19. yes okay are you gonna be able to get a ride that's a call I have no idea do you have your phone that's my phone I said her phone didn't cannot get her phone here you go I don't need your phone oh sorry no worries okay um yeah just call somebody to come pick you up okay okay we're right here on Sunport just by uh the airport okay okay and the key where's the key at to keep up should be somewhere right here yeah I see the key fob with her it might be in there but I don't think it's in here because it was in here before we got in the car no I don't think it's in here okay can you just ask her where it's at because I'm not sure yeah I'll get it no worse where is the key fob at man you have it I don't have it my key fob yeah no it's on my keys oh yeah it is it was on your person my bad yes it worked what happened with you what happens with me yeah very nicely yeah someone does my dad come when does my dad come [Music] this is a personal piece nobody else has ever used it as you can see there's air still in it I'll open it in front of you once I do open it I'll attach it to the machine once I do attach to the machine you'll take a deep breath you'll wrap your lips around this part of the mouthpiece here okay creating a tight so like if you're blowing up a balloon once you start blowing into it'll indicate a tune That Tune needs to be constant you'll be able to hear it and I'll tell you you keep on going until I need you to stop you need two breath samples do you have any questions on what I just explained to you [Music] I'll be in direct in front of you Lean Forward take a deep breath ready one two three good keep going stop [Music] one more just like that we'll let you know one more yeah one more [Music] [Music] foreign [Music] take a deep breath one more Lean Forward go you stop [Music] because your first one was .11 grams of alcohol per 210 leaves of breath the second one was 0.10 so that is above the crochet limit point zero eight that was a calibration check so it runs a calibration check to make sure the gas can understand you see that blue thing yeah that's the gas Hound gas cylinder so there's it's kind of it's a lot of science that goes into this but the calibration check has to be within the zero seven zero and zero nine zero So within that time frame um when it does a calibration check to make sure the stuff inside the blue bottle is working properly has to be between those two numbers okay so the calibration was within those numbers but the breast score itself is 0.11 and 0.210 so you are above the percent limit of zero eight okay so it is a DWI first offense um so you are going to be going and taken to jail um I'll leave you an opportunity to make a phone call here now um You can call whoever you want while I do the paperwork okay do you have any questions for me um talk to him and let them know what's going on um I could do that but um it's ultimately up to my Serge what he wants to do with that okay but I think I I know if it was my father you'd probably want to hear from me personally before somebody um from a different agency I think you could respect that right so what I'm going to do is I'm gonna let you you know get your hands from uncuffed um you've been nothing but respectful and I appreciate that and so if we're going to be cool people okay um do you have any questions on what's going on I know it's a crappy situation it really is okay um I have you I say yes and it could be a lie if I say no it could be a lie um I know it's tough field to get into we could all respect that we all know that um but it's not on your record as of right now it's just basically you're getting charged with it you still have to be found guilty of it and that's later down the road yes ma'am so it's going to happen approximately you know 180 days from now we'll meet up again here at the courthouse you'll get your attorney I'll have to be there and we'll have to go through the motions of what's going to happen with this um and it's ultimately going to be in the judge's hand what's going to happen okay so go and stand up do you have to use the restroom no okay everyone come over here so right now you're gonna go in front of the judge they work around the clock here what's going to happen is you're gonna be uh probably releasing your own reconnaissance and this is your first offense okay so what that means is you're just gonna have to promise the judge that you're actually going to show up to the court and not uh yeah exactly okay um I see that you have the nose piercing ears um I need those removed the ones that can because they're not allowed to have the jail okay any other piercings I cannot see I'll give you the opportunity to go to the restroom remove them and then just bring them out with you mm-hmm so right now it's ready 1 30 in the morning so you're gonna have to go in front of the judge most likely by tomorrow afternoon by about one o'clock you'll be released um maybe you could get that process a little bit faster depending on how busy it is over there but I recommend it's going to be about 12 hours roughly okay how do I how am I supposed to tell them so it's very difficult to understand um you can call your dad call your mom whoever you need to call let them maybe call in um but it's kind of one of those things I don't know if Costco will answer right now um I don't think they will either um but I would imagine you're not going to get out until tomorrow afternoon you know because it's already 1 30 in the morning right now so um I'm gonna have you move all your piercings first and then I'll give you an opportunity to make a phone call okay come over here okay no that's fine just want to make sure you get an opportunity um you can go the restroom if you need to you get into the belt um just double check your pockets make sure you don't have anything else okay thank you man and any questions before I put you in the Holy cell or do the paperwork um he most likely he's available he's still out waiting on your vehicle yeah I'm gonna give him a call right now let him know my parents can't pick up maybe it's really yeah it's already done you know for that portion of it um other than that I'm sorry I really am it's a bummer um so here's your phone okay I'm gonna put you in the whole detail here um yes ma'am it's gonna have a seat you right-handed or left-handed you're gonna see and see yeah sorry I'll be right back okay [Music] that's it now please back I'll walk out please make a left another left
