If the rules are counter to the Constitution, are they valid? >> I'm not here to argue that with you. I've told you what we have a directive and that's what we're going by. >> You're trying to bait us into something or whatever. >> He's already touched me as weird. You're grabbing my arm right now. I know you're under arrest. >> Welcome back to the Van Balion channel, guys. Today we head to Virginia Beach Courthouse, courtesy of 757 Police Videos on Facebook, where a sovereign citizen {slash} so-called constitutionalist tries to get through a security checkpoint without going through the proper procedures. So, let's see how well that works out for him. >> No, I'll go ahead and ask you your question again. >> Is that normally only turned on after >> You seem like you want to have an in-depth conversation with all kind of hypotheticals, so I'm going to make sure I have it recorded. >> Right. So, go ahead. So, I So, again for the for your camera, you're allowed to have these cameras out? >> It's not part of that uh part of that legal >> read the exceptions, yeah. I have my my cell phone camera here. I'm not recording or anything on my cell phone. Just here. I'm putting it in my pocket. And my question to you, standing at the you know, the lobby we're in the the lobby right now. >> That looks like a publicly accessible hallway. >> It is. If I go past you with the cell phone in my pocket, what then happens to me? >> I will advise you again of what our rules are and that you don't meet the criteria for bringing one of those in. >> Okay. >> Okay. >> And then what? >> And then you'll either put it where it's supposed to be or you'll leave the building. Those are your options. >> And what if I don't? >> See, there you go. You keep wanting to do all these hypotheticals. I don't want to get into with you. >> Okay. >> You can be arrested. >> For what? What would be the crime? >> Trespassing at that point because I'll have advised you you can't have that with you in the building. I've already told you where you can have it and you seem to want to keep pushing the issue. So I will ask you to leave. If you refuse to leave, then it'll be trespassing. >> So you're trespassing trespassing from the public lobby of the public building? >> want to follow the rules. >> Yes, this guy is about to find out the hard way and then again later when he takes this to court that the government can regulate public spaces to prevent disruptions such as the one he is creating. >> What if If the rules are counter to the constitution I would think >> I'm not here to argue that with you. I've told you what we have a directive and that's what we're going by. >> You don't need to comply with your criteria for the exceptions to that. >> So those are your options. >> And how do you get an exception? >> You want to take it up with the chief judge of the circuit court. You can certainly do that. >> How does a lawyer get an exception? >> Well, they generally they have a bar card. >> Okay. And if a pro se litigant >> earlier, we're blocking a door. Let's step over here and we can continue this conversation. Step over here. >> I'm blocking this door. >> I stepped out of the door. I'm Could you not touch >> I'm asking you >> Step over here. >> Could you not touch me? >> All right, this conversation is done and I'm asking you to leave. >> Please don't. >> I'm asking you to leave. >> You can ask all you want. If you are If you are telling me to leave under threat of arrest, I will leave. Okay? But that that is where I will be. I'm not blocking the door. It's wide open. Thank you for having your body >> here talking to you is blocking this door. I simply asked you to move over here. >> stand wherever you want. >> He says the doorway is wide open while literally blocking the doorway. Also, he promised to leave under the threat of arrest. Let's see if he follows through on that promise. Spoiler alert, he doesn't. >> All right. I need you to put the cap the the cap the phone in a locker or you can leave. So, phones can come into this public lobby and be put into that locker, is that correct? >> I've already explained that to you. >> Okay. So, me having this right here is not a violation. I'm in the lobby still right now. I'm not in these doors or whatever. >> What are you trying to accomplish today? >> I'm trying to see if you will violate my rights or uphold my rights. >> Oh, so you're trying to goad us into violating your rights? >> No, I'm trying to actually go see Tracy to fill out the yellow form. >> And how you can do that is by locking that up and coming on in. >> Right. And your position is I cannot record government officials in the course of their duties. >> Right. >> Which is again the Supreme Court has ruled we're allowed to do that. >> Feel free to take it up with the Supreme Court. >> He did actually go on to challenge this in court, but lost because the court system court view security screening and storage as a valid administrative burden. But, more on this at the end of the video. >> Okay. >> Okay. >> Yeah. So, may I go in there? >> You lock that up. >> Okay, I'm not going to lock it up. Could I please >> You put the phone in the locker and then you're more than welcome to come in or you can take the phone and You're more than welcome to come in. >> Okay. >> I've already explained to you that the phone is not coming into this building. >> Okay. >> We're just going around and around. So, we got to make a decision about whether you want to put it in the locker or you want to put it in your vehicle or you're more than welcome to come in. And that's where we're at. We're We're not going to go back around and around. >> Yeah, I don't want to go around and around. What I >> What are we doing? >> What? >> It's like we're going around and around because you've already explained everything. >> No, no, no. What I'm trying to do is be able to use my phone to record government officials >> And no, it's not going to happen. >> Can I Can I you know, finish >> explained No, you can't. That's your option. You can put it away or you can leave. Options. >> Yeah. >> We're not explaining this all again for somebody that just entered the conversation. We've done this. Those are your options. >> two quarters and you can lock your phone up. >> Thank you. >> We're trying to work with >> That's correct. >> Okay. >> So >> If you need two quarters, you can go ahead and lock your phone up in that locker. You can come in the building. You don't do the screening process, you can come in the building, take the whatever goods you need to take care of. >> Yeah, I've already been through the screening process. >> So here's two quarters. If I give you these two quarters, I'm going to put your phone in a locker. >> Two quarters for the lock boxes a generous offer, but I think it's going to take a lot more than that. I a pair of handcuffs to get rid of this guy. >> No, I put it in my car if I need to. >> I appreciate that, honestly. >> Is that what we're doing right now? >> Yeah. So >> Okay. We're We're out of options, sir. We're either going to put your phone in the locker >> Yeah. >> or you're going to put your phone in the vehicle or you're going to leave. But right now, we've already explained to you everything. You're trying to either bait us into something or whatever, but >> No. >> we're not going to go that route. >> It's not about baiting. So what I would like to do, just so you got his name. >> Here we go. >> I I would like to record Tracy when she tells me that >> not going to happen. That's not >> Can I Can I please finish what I'm saying? >> already said that's not going to happen. >> We're just continuing to go in a circle here. >> Excuse me, can I talk to you? >> Hello. No. >> Can I get your name, please? >> I'm I'm Sergeant Weldon. >> Weldon? >> That's Sergeant Weldon. >> That's Sergeant Weldon. >> Could Could you say it >> Weldon. >> Weldon? >> Yes, sir. >> Okay. So Sergeant Weldon. He's already touched me. It's weird. >> If you seriously think a deputy slightly touching you to get you to move away from a door you still seem to be blocking is weird, you're really not going to like what's coming. >> All right. What I'm trying to tell to anybody that's willing to listen, all right, is this As soon as I say video, you guys are like, "Be quiet. Be quiet." Please listen to the full the full statement if you will. >> You've already heard it. We've already given you the options. We told you you're not authorized to bring those recording devices in. >> I understand. I'm just trying to let you know what my intention is to be able to record Tracy when she tells me that this is what you need to do. This is fill out this yellow form to get permission to a media member to be able to record inside the court house. That's what I did back on December 12th. I'm trying to see if she has a result for that one and to find a new one for this year. All right. That is my intention and she is a government official. >> Is that the whole thing? >> Yes. I would like to I would like >> can't. >> So, let me get this straight. You're demanding access to a restricted area so you can record the filling out of a form requesting permission to record in a restricted area. And you're seriously wondering why you're not allowed to do this. >> Okay. >> That's what I told you. >> All right. >> And so since you've told me that I can't, I'm saying well, can I What happens if I walk past you? >> You're not going to walk past us. >> What would you do if I hurt >> So, that's where we come into where we sometimes have to use force with people and you're putting it to that point where we're going to have to use force. We've explained to you your options and you're refusing >> When When are you allowed to use force? >> I'm not getting into this conversation with you. >> Please do. >> No. >> You're only allowed to use force No, you're only allowed to use force when a crime has been committed. So, when you think a crime has been committed and you can reasonably articulate that a crime has been committed. I've explained to you what your options were and you didn't >> Then you touch me earlier. >> Earlier, you were trying to push on me. >> If you didn't want to follow them, >> Please don't touch me. >> trespass. >> That's assault. >> to trespass? >> What do you mean am I ready to trespass? >> I think you know exactly what he means. He's telling you not for the first time to either follow the rules, leave, or be arrested. But, I think we can all see where this one is headed. >> Are you coming in or are you leaving? >> I'm trying to come in. Absolutely. >> explain you how you can do that. But you don't want to not seem to follow those rules. >> Well, I mean, if you're telling me I'm going to be arrested unless I leave, then I'll leave, you know. >> All right, you're going to be arrested unless you leave. >> Are you sure about that? >> Yes. Are you ready? >> Do you know that's against the law? >> Okay. >> You're grabbing my arm, right? >> I know, you're under arrest. >> Where are you going? >> Place your hands on the wall. >> Place your hands on the wall. >> Hands on the wall, now. Stop. Tried to explain this to you, but you just want to be hard-headed. >> I was leaving. >> You weren't leaving. >> You You gave me a warning that if I don't leave, you would >> And you said you weren't leaving, so you're under arrest. >> warnings. Sat there for like >> Can I talk to my lawyer, Mr. Violator? >> You can call whoever you want when you get to the jail. >> Just for the record, demanding to speak to your lawyer, even though earlier in the video you claimed you were going pro se, does not intimidate or stop law enforcement in forcing the law, especially after countless trespass warnings. >> All right. >> Do you have anything in your pockets that's going to stick me, hurt me, or poke me? Is that an answer? >> I did not consent to you searching my pockets. >> Your consent to my search is not consequential anymore. >> anything in your pocket that's going to stick us? Yes or no? I'd like to call my lawyer at this time. >> You can call your lawyer anytime you want once you get to the jail. >> You're violating my rights right now. >> I know. >> You are losing your qualified immunity. >> Okay. >> I would like to call my lawyer at this time. >> Okay. >> I'm on body cam. >> Message to this and other like-minded individuals, the threat of a lawsuit does not intimidate, nor will it stop law enforcement from performing their duties. >> Excuse me? Can you just preserve the audio? >> All right, come on this way, sir. >> Because you are allowing him to violate our laws. You will be sued, officer. You also assaulted me earlier. >> Okay. >> You are not upholding your oath to defend the Constitution. You are what is known as a tyrant. >> Hang on right here. >> You did that though. This way, sir. >> You are deliberately violating >> Come on over here. Hold on right here. >> All right, so according to 757 Police Videos on Facebook, he was arrested and charged with trespass after forbidden under Virginia Code 18-2-119. A General District Court Judge found him guilty. He appealed for a new trial in Circuit Court and was convicted again after a bench trial in September 2024 and sentenced to 30 days in jail with one day suspended and 12 months of unsupervised probation. He appealed once more arguing the evidence didn't support the conviction and that the statute couldn't constitutionally be applied to his conduct. Specifically, he claimed he had a good faith right to remain in the courthouse lobby because it was open to the public and that trespass law couldn't be used against the citizen on public property at all. Of course, the Virginia Court of Appeals rejected both arguments noting claim contradicts settled law that trespass statutes do indeed apply to public property other than fair affairs affirming the conviction on May 19th, 2026. An appeal to the Supreme Court of Virginia is pending. Right, thank you so much for watching guys. If you enjoyed this video, please leave me a like, share the video, and subscribe to the channel.
