on Wednesday January 17th 2024 at around 11:15 a.m. New Mexico State Police dispatch received a call from a citizen reporting a man in a white Dodge Ram pickup with Texas plates had pulled over just east of Roswell after several marijuana packages had fallen out of the back of the pickup the caller stated that the driver was a white male wearing glasses and had a a gun on his hip a short time later state police officer Kim Sanchez who is at the state police office in Roswell spotted the truck officer Sanchez pulled behind the truck and conducted a traffic stop near the intersection of West 2 Street and Avenue A Street in Roswell New Mexico d hello Sarah how are you officer Sanchez New Mexico State Police so the reason I'm making contact with you is somebody had called you in and said that he observed like large trash bags fall and that it had like large amounts of marijuana pretty much no yeah so that's my reason of contact okay um do you have your driver's license so I know who I'm talking to yes okay get back do you have large bags of trash um trash bags back there no ma'am I don't okay do you know know anything about you pulling off to the side and you dropping a package and picking it up or anything like that I just I stopped about 5 miles back okay and let him use the bathroom as a big gravel area okay but no I didn't throw anything out yeah I guess somebody called you in so that's why we're making contact with you okay okay okay you need my insurance sure 34 so clear for Texas deal 34 F the driver was identified as 53-year-old Don Wester where are you heading to Mr Wester we're coming here to Rosell from Texas or uh okay I went through a divorce I've moved up to Oklahoma recently okay so that's why my insurance is in Oklahoma okay just come out here to visit just to see the aliens on I don't have 10 so you guys were you're moving from Oklahoma to Texas or for to here no no we're just out here visiting me and the dog oh okay okay just to get away and he's saying no he's not going to give me permission to look in the back of the vehicle okay and he might have a gun I don't see it yet his name is Mr Wester I'll go on this side yeah be careful cuz he rolled his window back up okay hello yes sir how are you I'm good how are you good can I see your hands okay so we're going to ask you to step out of the vehicle okay I'm not going you're not going to step out not right no no so we're just going to ask you to step out please okay you're not under arrest or anything we just need to talk to you do you have any weapons in the vehicle you can talk to me right here do you have any weapons in the vehicle no I do not okay so step out of the car please you can talk to me right okay so this is your last chance to step out or we're going to have to remove you so it's your choice sir I just want to talk to you it's a lawful request and you have to step out of the vehicle if you have any weapons just tell me now no I don't have any weapons okay okay obstructing so just grab everything out of his pockets I've asked you multiple times I asked you multiple times to get out of the vehicle that's not you are under arrest no uh nothing that's going to harm me poke me stab me anything no uh weapons of any kind nothing like that correct so I'm going to let you know what's going on we had an nominus call that weed fell out of your truck you had a gun on your hip and that's why we stopped you so Anonymous person called I asked you multiple times exit the vehicle which you didn't so now you're under arrest for resisting okay that's what's going on okay like I told her I stopped and left my dog out to use the bathroom down the road all okay so what is the reason for not stepping out of the vehicle when I because requested multiple times you have to get out of the vehicle when a law enforcement officer asked you I explain that to you you have to it's a lawful order I don't get the big deal I don't know why you just no you didn't you didn't drag me out of the car it doesn't matter it doesn't matter I did get out on my own I asked you multiple times and you did not you wrote the window up on me so now you're under arrest and I let it back down too when I got out of the truck my window was all the way down sir I have to ask you multiple times okay want them in Sanchez's uh no no all right so everyone to walk to the back of the officers requested a canine from Roswell Police to see if the dog detected an odor of Narcotics yeah I'll wait till I'll wait till they come and the dog out that way I can get a just that way the dog doesn't interfere with my dog yeah yeah but he's he I was talking to him doesn't want to look at you he's he's nervous and she asked for consent already and he said no she asked him for consent right off the bat like after talking him for a little bit he said the dog it's a pit that he said the dog was friendly but I don't know you're always friendly to the owner yeah all right yeah so and then know what I mean like I because what it sound like it dropped out of the bed while he was driving he pulled over to go pick it up unless he was fidgeting with his stuff and accidentally dropped it while pulled over on the side of the road so that's what the caller said yeah but he didn't want to step out where you on the property said okay we're going to break it he's like okay I'll ask uh ask the name of the person that's going to pick up the dog and then ask where his phone is okay Hey sir what's the name I think you said it was your sister that was going to pick up the dog right mhm what's her name does it matter I'm going to run it to them so so they can contact her cuz we're going to need to know where your phone is also my phone's in my truck it's in your truck we're at in on the bed but same back passenger door back pass so both both rear doors the seems is what she's alerting on so if I had to guess it's probably something might be in the back seat okay I did I saw a black bag and our doger to we either yeah that's what I told Sanchez I was like I don't their dogs on alert to weed so I mean I would doubt it if he alerts but you never know he could have you know what I mean yeah have anything so we we proof our dogs also weed so like every now and then we'll do our trainings we'll throw some weed out just to make sure that they're not alerting on oh that's good it's just it's just cuz you know everybody a lot of people smoke weed so you have your legal stuff he just wanted me to let him know that if he pulls it like that it could mess up the office where a search warrant was sent off to a judge a short time later the judge sent an approved search warrant back the officers searched the truck and located 9.62 lb of marijuana in the bed of the truck in black trash bags 51,6 15 under the rear seats in a gift bag approximately 1.5 o of cocaine under the rear seats in a black zipper bag and a stolen 38 revolver on the driver's side floorboard in a red bag Mr Wester was charged with distribution of synthetic cannabis trafficking Controlled Substances possession of drug paraphernalia receiving stolen property and resisting evading or obstructing an officer
