on Thursday March 31st 2022 at approximately 1:34 a.m. New Mexico State Police Officer rundo Luan III was out on patrol on Interstate 40 eastbound near mile poost 165 in Albuquerque when he observed a vehicle traveling westbound in the eastbound [Music] Lanes the driver passed officer Luan and continued westbound in the eastbound Lanes officer Luan made a u-turn and attempted a pit maneuver but it was [Music] unsuccessful [Music] go your head get off the [ __ ] car turn up the truck turn up the [Music] truck get out of the vehicle now get out of the vehicle now [Music] dri [Music] [Music] hospital got you straighten this leg up we're going to keep this one bent you're going to stand up with me all right one two [Music] three stand up I just got out of the hospital with surgery with my going to get your wallet okay um I just got out of surgery yesterday for my thumb was is infected and I just drove out to get some meal coming for all under the driver was identified as 41-year-old all you injured in any way um I just got out of surgery from the hospital and I've been taken hold on okay Mr greenling stated he had consumed medication that was prescribed to him about 2 hours before along with consuming four bottles of alcohol about 6 hours prior walk over here try and go get some food stand up real quick yeah stand up yeah I can do bring your left in leg in first okay put I'm about to tell you something yes sir very important you need to pay attention Okay yeah you have the right to remain silent anything you say can and will be used against you in court you have the westbound in the wrong way you see my lights IED stopping you passed me you almost went head on with several other vehicles I had to use my vehicle to you know make contact with your vehicle to stop you well like I said listen hold on Mr GRE yes sir what's going on tonight where you coming from uh I just came from my home and as I can show you well it's how much have you had to drink tonight Mr greeny nothing listen you I'm smelling a very strong motor of alcoholic beverage it's very strong you're stumbling all over the place you're driving the wrong way that's ridiculous I had my did you take sir four four of them when did you take uh when I was prescribed them and about 2 hours ago I had four so you had four 2 hours ago yes okay anything else no no alcohol no okay so what's this odor of alcoholic beverage meeting from your breath as I'm talking to you right here why is this so strong and only getting strong every time you speak I don't know um I drank when I came out of the hospital you drank when you came out the hospital when was that and that was like 6 hours ago 6 hours ago what did you drink uh I drank uh um about 99 apples 99 apples how many did you have four four of those as well okay so four drinks a 99 apples 6 hours ago 6 hours ago and then four is that correct correct okay listen to me I'm about to tell you something important you are under arrest for driving under the influence of intoxicating liquor and nor drugs the New Mexico act requires you to submit to a breath test to determine the alcohol content of your blood after you take our test you have the right to choose an additional independent test if you choose to take this additional independent test you have the right to re B te range for physician a licensed nurse a laboratory technician or technologist who is employed by a hospital position of your own choice to perform additional chemical test the cost of this additional test be paid by law enforcement agency which is New Mexico State Police do you agree to take our test no some I cannot force you to take our test but if you refuse you will lose your Mexico driver license or nonresident operating privilege for one year if you are convicted in court of driving W by the influence you may also receive a greater sentence because of your tested do you understand I'm sorry say it again I cannot force you to take our test but if you refuse you will lose your New Mexico driver's license or non-res operating privilege for one year if you are convicted and quot a driving wall under the influence you may also receive a greater sentence because you refuse to be tested do you understand yeah do you now agree to be tested no I will Contin your actions to refuse to be tested this time as well as you're going to be charged with aggravated DWI do you understand um and if I agree to be tested then you go into a machine and I'll let you know what happens after that yeah let's go ahead you want to provide a breath sample sure okay do me a favor Mr Greenley can you open your mouth for me please yeah do you have anything in your mouth that you eat drink or smoke no anything on your person that you eat drink or smoke I smoke uh cigarettes 147 go and sit back Mr greenling was transported to the Albuquerque State Police office where he provided a breath sample the testing machine indicated his blood alcohol content level was. 23 which is almost three times the legal limit Mr greenling was transported to the Metropolitan Detention Center on charges of aggravated DWI first offense reckless driving driving on the wrong side of the road and resisting evading or obstructing an officer refusal to stop Mr greenling later accepted a plea deal which dropped all other charges as long as he pled guilty to the DWI charge Mr greenling was ultimately required to complete a first offender program which he successfully completed in 2023 I have no idea honestly um over
