Mhm. You need to see your ID. Okay. And if not And if not, you could be considered identity. Cuz New Mexico statute says that concealing of identity is a secondary charge. I would have to have been arrested or suspected of a crime. Right now, you hear just hearsay. Put the bike down. Watch my bike. Cuz I told you to put the bike down. Why are you stopping me right now? Because you're riding your bike with no light on. I'm riding it. I got to put the bike down right here. I do need to identify yourself. You're refusing to identify yourself. Have I committed a crime? I know. I've asked that. You're trespassing and you do have an open container in my private property, right? Where are you coming from today? None of your business. Okay, cool. Any weapons in the vehicle? None of your business. It is my business, actually. No, I don't have to answer any more questions. Yeah, you do. Are there any weapons in the vehicle? Here you go. Corrupt cops don't realize their mistake until it's too late. Whether it's pulling over the wrong person, flexing their authority on someone with real power, or making arrests that backfire spectacularly. Today, we're looking at officers who picked the wrong fight and faced unexpected consequences. Oh, sorry. Here, I can help you. Is there anyone else in here? Uh, no, it's just me. Okay. You mind just opening the door that way I can see? Uh, you trying to What you trying to look for? I just want to make sure there's no one else in there to start and then I'll talk to you at there's no one in there right now. Okay. Come out here and talk to me, then. Yeah. So, I'm going to be honest with you, though. We got a report that um you were seen walking into your dorm with alcohol. Okay. Is there alcohol in there? Uh I don't answer questions. What's your name and your badge number? Officer Purle, NMSU police. Title and name security officer. Uh security officer. Okay. Okay. This is a college law student who challenged the police and refused to identify himself unless they threatened him with arrest after he was suspected of possessing alcohol. Officers violated his Fourth Amendment rights and they definitely regretted doing that. Do you have an ID with you? Uh, I do. Okay. Can I see it? Uh, you suspect me of a crime? I do. Okay. What crime and how can you articulate it? Minor in possession of alcohol. We got a report that you walked in. So, it's like here they say they said thing. Okay. It's a Yeah. Right. It's like they said that he has and that that's how you're going to articulate it. So, we don't have to go down this route. If you want to if you want to go down this route, we can. Well, I really don't. But like you're I'm studying right now. I'm doing homework. Can knock on my door. I'm out here. I want to know what's on. You say that they they said that there's alcohol in this room. Okay. Or that they saw me going into this room and that there's alcohol in there. How can you articulate it though? Okay. So, that's why I'm here talking to you. Yeah. Okay. So, I still need to ID you. Uh, no. And then we need to go from there. You have to you have to suspect me of a crime. I I do. You you're you realize that uh cops in New Mexico don't have qualified immunity, right? I do that. I do. Okay. So, from from here on, just let's just be careful with what you about to do right now. You're saying that you want my ID, but right now you're not you or yourself can articulate a crime that I have committed. Okay. So, so I already explained to you why I'm here, why I need your ID. I know what you're here, but Okay. Is my ID gonna tell you if there's alcohol in that room? No, but I still need to identify you. My name is Joel. Joel what? Joel. I need your first, last name, and your date of birth. No, you don't. I do. If you don't want to provide that, you don't want to call officer Donovan or one of your supervisors here. Yeah, I can get a sergeant over. I then calling them because right now, this is not what you want to do right now cuz this is a violation of my fourth amendment. Okay. All right, let me let me get a sergeant over here. Okay. Yeah. Some states like New Mexico have laws about providing ID if you're legally detained. But the big question, are you truly suspected of a crime? If not, the officer can't just force ID. Hi. Name and badge number, please. Sergeant John Love Lace. My badge number is 212. 212. All right. Thank you. Uh officer said here that if I don't ID, I will be subject to arrest. Is that true? It's possible. Yes. Possible yes or no. I need I need that ultimatum or else I won't get my ID. Okay. So, technically right now, yes, you could be arrested. Could I need a yes or no? Like, I need you to tell me if you don't give me your ID right now, I'm going to arrest you. Why? Why would I say that to you? Because I need that ultimatum cuz right now you're asking. Yes. And I have the right to say no. Cuz you're asking. You're not. It's not a lawful order. I need you to make it a lawful order. Detained for suspicion of minor um in possession of alcohol. Mhm. We need to see your ID. Okay. And if not, and if not, you could be considered identity cuz New Mexico statute says that concealing of identity is a secondary charge. I would have to have been arrested or suspected of a crime. Right now, you hear just hearsay being arrested or suspected. You're being suspected of a possession on what? On what grounds? Okay. So, do you have any alcohol in your possession? I don't answer questions on what grounds. Okay. So, you don't have any alcohol in your possession? On what grounds? I don't answer questions on what ground. Yeah, that's her room, bro. I can help us. Nah, they are they're trying to go in, bro. They're trying to ID me and but nah. Okay. So, who are you talking to? I'm recording you. You're recording. Okay. If you want to hang out, if you want to hang out, you can. That's fine. Uh, so here's the deal. By saying could what we are trying to do is we're trying to be cooperative with you and have you be cooperative with us. Help us clear this matter up. Okay. I gave him my name, Joel. What's your last name? You don't need my last name and you do not need my date of birth. Unless you want to run me for Unless you want to run my name through your system. Are you trying to run my name through the system? You have warrants for your arrest. Is it? I don't answer questions. I don't answer questions. I'm asking questions. I don't. It's my fifth amendment. Is it or is it not? Okay. So, the question is is that like the officer told you, you're being suspected of having possession of alcohol underage. So, in that case, the easiest way to prevent this is for you to let us know. Either you had you got somebody saw you carry a case of beer. Do you have a case of beer in your possession? I don't answer questions. Okay. All right. Um, so the other the next the next step in this process would be would you give us consent to check your room? Nope. To make sure that you have no alcohol in your possession. I do not consent to any surges nor seizures. Okay. Very good. All right. Um, this is completely up to you how you want to play this. You could get a warrant or you could or you have probable cause. Go ahead. Right now, we do have reasonable suspicion that possibly a crime had been committed. We're trying to investigate that. Mhm. But we need to ID you or and if we do not if you do not present your identification, you can face a non citation. You're saying could I need you to say you will? I'm giving you the opportunity to No, I need that ultimatum. I will give you my ID if you say that I'm going to go get arrested if I don't give it to you. So you'll give us if we say that? If you say that. Yes, sir. Cuz that's already grounds for me to sit up litigation against you. So you're threatening to sue us? I ain't threatening nothing, brother. That's what you just said. It's not a threat. It gives you grounds to It's not a threat. It gives me grounds. Does it or does it not? I don't answer questions. Okay. So the easiest and simplest solution to this is for you to tell us your name, date, or Joel. Joel. White. Joel. Okay. By just saying Joel, there's a thousand Joels. I need a last name and date of birth for what you're going to run. I told you want my name for the report. I need to have your name and date of birth. I didn't even have to give you my first name for that report. You could literally put the citizen or the or the guy or the suspect. Yes, you can. Work like that. Yes, it does. I'm a lawsuit in here. You're not going to come over here and try to violate my rights. So, I'm not trying to violate your rights. I'm trying to be cooperative with you and you be cooperative. cooperate me and accept that I'm not going to give my ID unless I'm gonna I'm gonna get arrested. Say it and I'll give you my ID. Just say if you don't give me your ID, I'm going to arrest you. So you want us to threaten you? You want us? Yes. I want you to give me that ultimatum if you really want the ID. Threaten you. That's not how this is. Why? Because you know you can't. You know you don't have that ultimatum. You know you can't because you know that opens up for litigation. Okay. So, here's why we need your name and date of birth. I'm going to read you the law because you are a law student. Okay. Sean, according to New Mexico, it's all being recorded. Yeah, I know. But my body came running. So, I'm I'm going to use my my own. So, concealing identity consists of concealing one's true name or identity or disguising oneself with the intent to obstruct the due execution of the law. Am I obstructing or Yes, technically you are. with the intent to intimidate, hinder, or interrupt any public officer, which is us. Mhm. Or any person in illegal performance of his duties or exercise of his rights under the law of the United States. Okay. So, your investigation is investigating that I'm in possession of alcohol, right? That's exactly. Okay. If I don't give you if I give you my ID, is that going to tell you if I do or do not have alcohol in that room or is it just a way to find you with something? No. The ID is so that we can identify who we are talking to. If you wish to deny us access to that room, that is totally within your rights. I know. But you refusing to identify yourself to us by name and date of birth. Yeah. Full name. Mhm. Date of birth, that is concealing identity. Yeah. Okay. Okay. So, just tell me that if I don't give you the ID, you're going to arrest me. Just say it. Show us your ID. We need to see your ID or you will be arrested. Thank you. Got that, right? Yeah. Yeah. You got thatful for real. Why do you use that term? Cuz why the are you searching my leg? We're not searching. That's a That's a seiz of my identification. Is it or is it not? It's not a seizure. We just need It's a seizure of my identification. Yes or no? We just need to see who you are in order to I told you my investigation. Told you my name. Did I name your first name? What is my Joel? Not the legal name or what? Joel. What? He has my ID. Go look at it. Perfect. That's all we needed. Thank you. That's all we needed. Mhm. Let's go down here real quick, please. Am I able to go in my room? No, not yet. I'm going to get complaints on both of your And Chief Donovan is going to know about this. I'm He knows who I am. Chief Dunovan knows you. Chief Donovan knows who I am. Okay, perfect. All right. Up for real. Have a nice day. Yeah. And did you find anything with that ID, brother? Did you find out if there's alcohol in here or not with that ID? Huh? has consent. So that's fine. I didn't try. You wouldn't. So we're not gonna we're not going to argue with you. Have a nice day. Get the out of here. Well, this is actually a common area. So we're allowed to be go work. I you for something out of here. Yes, I got my ID for no reason, brother. Okay. Get the out of here. Have a nice day, sir. Have a nice day. Yeah. Byebye. Have a nice day. The interaction ended without any charges, but these officers got a quick law lesson from a teenager. What's up, my man? Come here. Come here. Oh, yeah. No. Put the bike down. Put the bike down. Watch my bike. Cuz I told you to put the bike down. Why are you stopping me right now? Because you're riding your bike with no light on. I'm riding it. I got to put the bike down. Put the light right here, dude. Put the bike down right here. Dude, no. [ __ ] Put the bike down, James. Turn around. Put your hands behind your back. Turn around. Put your hands behind your back. I'm You, dude. Get on the ground. James, this officer harassed this innocent citizen, violating his rights after the officer responded to a potentially suspicious bonfire near an apartment building. He definitely didn't know how it could backfire when the footage was made public on several channels. What have I done wrong? 562 King, get on the ground. What have I done wrong? I've not done nothing wrong. Get on the ground, James. I've done nothing wrong. Am I being detained? Get on the ground, James. Detained. Am I being detained? Subject stop. Am I being 425 willow white male? Help. Get on the ground, James. You are being detained, you idiot. Get on the ground. I'm on the ground. I'm a tas you dude. Get on the ground. Put the flashlight down. Am I being detained? Yes. For what? Put your hands behind your back. For what? Put your hands behind your back. What am I being detained for? For not listening. Drop that flashlight. Drop that flashlight. Particular reason that I committed a crime. Yeah, it is. You took off. Yes, it is. It is not. Yeah, it is. James, it's not. You still supervisor. You still Call your supervisor. Relax. No, I'm not relaxing. Call your supervisor. This harassment is going to stop. Shut up. Call your supervisor. I want you to call your supervisor. I am the supervisor. Dip right up. Amendment audit. Yeah. Try the fifth amendment. Shut up. First amendment audit. You have no reason to stop me right now. Yeah. None. You're riding your bike with no lights on. Right there in my hand. It's got to be on the bike, dip. It was on the bike. I just took it off. No, I just watched you right away when I rolled up. You didn't tell me to stop. There was no stop. I was doing nothing wrong. Yeah, I told you to stop right here. Nothing wrong. You have no crime I committed. 562 King detained. 29 on last person. James, call your supervisor. I want to see your supervisor right now. Shut up. I want your supervisor. What'd you ditch over here? I want your supervisor. I'd like your supervisor, sir. Okay. Well, I think he's down at the jail. I'd like your supervisor, sir. I need to speak to your supervisor now. This ain't happening. Yeah. You still on court conditions, James? I wonder. No, I'm not. No. Any court conditions? None. Huh? None. Under Nevada law, a bicycle at night needs a working front lamp. That's enough to stop you on a public street. But if you're on private property, it can get murky. Some local codes apply. Others don't. Zero. I've not committed a crime. You have no reason to stop. Yeah, I did. When I told you to stop. You like to stop your I stopped. When you told me arguing with me, I'm going to argue with you. I had to pull my taser out. You have no reason to stop me. Yes, I do. None. What? Yeah. You've not committed a crime. No misdemeanor, no felony. Yeah, James. It's called riding a bike without a headlight. You got a headlight right there. It's not on a bike, James. Your friend. Hey, I'm not on a bike. I'm in a parking lot. Private property. What are you doing here? You got any dope on you, James? No, I don't. Now what? I want your supervisor. Stand up. I want your super. I'm going to stand up. Where's your shoot? Face away. Put your feet apart. You got any weapons on you? Nope. Well, I don't know. Maybe something. I don't know. I doubt it, though. Maybe something. What? No, I don't know. I don't know. I got a lot of [ __ ] in my pocket. Been working on cars all day. You got a knife on you? Yeah. I know this. I have I'm being contained for no reason. I want to talk to your supervisor. I want to see your supervisor. What supervisor? Jame, you think we'reing call you? Yes. No. First amendment audit right now. No. Yeah. First amendment audit. You have no reason to stop me right now. You're in vi isolation of my first amendment right and my fifth and my fourth and my ninth. Your partner hands. Yes, sir. Face the car. Face the car. I want to see your supervisor. I just told you private property. I'm right here in my house. I live right there. What's your date of birth, James? 5. I got I have to answer your question. You do not under arrest. You are the subject of investigation. Yeah. For what? For resisting right now. What's What's my crime? For resisting. What's my crime? Yes. Resisting. I'm not resisting. Crime. Yeah. You stopped me for it. I told you already. Resisting. I already told Stop. I don't have to answer your question. Yeah, you don't have to. Okay. You're going to jail. Yep. You're going to jail, dude. What's that for our guy? I'm asking you some basic basic information. My name's James Gresham. You know my name. I asked you what your date of birth was. I don't have to answer your questions anymore. I guess I do. Huh? Yes. Because I'm being detained, right? Yes. 5.69. And this is an illegal stop. No, it's not. Yes, it is. Call your supervisor. I want to see your supervisor. James, you know how many times? You have no right cuz I'm on You know how many times you've been in the public property? I've not Do you think that maybe if you just answer a couple quick questions, but when you're rolling up here and then coming back? You told me I'd come back. So I came back. Yeah. And then I'm telling you to drop the bike. You're not dropping the bike. And then you push it. You're trying to tense up on me. My hand. I didn't do nothing on you. You did. I asked you why you were stopping me. I saw you pull up here. That's why I turned around to come back. All right. I knew you were going to come. How about that? Yeah, cuz when I roll up for this bonfire to do with me. You were there. I was just talking to them, asking them what's up with the bonfire. Oh, and they're barbecuing. Imagine that. Did you stop and ask about the fire? I didn't. You took off. Where's this going to be going? I wasn't I didn't have to stop for you. Just cuz you pull up don't mean I stopped my life. I have When there's a crime committed. No, I didn't commit a crime. I committed no crime. What was my articulate reason for? I already told you. Come here to stop me. I already told you there is no crime. I'd like to talk to your supervisor, sir. You don't have right now. That's fantastic. Yeah, you can want one hand. My first right now. That's right. They have it on body camera. First amendment has no articulable reasonable suspic. It's a right to stop me unreasonable. The first articulable reasonable suspicion. Sit tight, dude. Sit tight. Shut up. AR dudes. Sit tight. So, we're s we're sitting over there across the um at the subduge flames coming out. Thought the building was on fire. Roll up and then I'm like trying to ascertain what's going on. He off on the bike and but it ends up being inside a barbecue which I don't even know if that's legal. Depends on how it is. Yeah. Right next to the house coming up. that I up he's pushing his bike up here and then it just went downhill from here as it usually does. Yeah. I heard you yelling who he's going. Yeah. So now I'm debating whether uh take him, dude. Just for obstructing. Yeah. There's not really He's riding his bike without a light. Yeah. Now I'm like, well, is this private property? Like was it through here? He did. Yeah. It came from this side and went through here. So that's probably Tracy Gary's point, not his. What is your articulable reasonable suspicion? Property, man. Because what? What's because flight from the cops? A flight from who? I wasn't stopped. I know cuz you didn't give me a chance. What were you trying to stop me for? See what's going on with this fire? That has nothing to do with me. Okay. How do I know that if you're leaving? It's not my fire. It's not my house. live there. How do I know that when you take off? People live there barbecuing, right? You would have found out. Okay. Cuz they said about them, man. They didn't they didn't they they said they didn't know who you were. If the officer is within bounds to detain you, a legitimate infraction or investigating suspicious behavior. Not cooperating can lead to charges like obstruction or resisting. On the flip side, if the officer has no real basis, you might have grounds for a wrongful arrest claim. All right, James. You want a supervisor? There's one down at the jail. You're going to jail, dude. For what? Resisting. I'm not. Don't. What are you doing, dude? Face a car. I'm putting your feet apart. Go ahead. Miss me. I just went to jail. Watch out. Don't need my stuff. Mhm. Space. All right. Yeah. Fine with you. I didn't do nothing wrong. You don't listen. I do listen. I came right to you when you pulled up. You're the only one who was running at me, not me at you, bud. Yeah, cuz you're trying to get away, dude. I'm trying to get away. What are you talking about? Body cam. It is a [Applause] rap. All right. Oh. Oh, [Applause] no. Look. Duct tape. Yeah. Sorry. Have a seat. Mistake. Made a mistake, bud. Unfortunately, there are no court records or updates on this case, but the officer surely regretted his mistake. Hello. How's it going? Hey, it's okay. It's gone. I'm building this store right here. I'm just watching this. Okay. Yeah. You got stuff in there then? Oh, yeah. Okay. Um I just Okay. Do you have your driver's license with you? Uh what do I need that for? So, um I want to verify that you are supposed to be here. Um what kind of store are you guys working on? We're building a family. Okay. This female cop made the biggest mistake of her career by wrongfully putting cuffs on this man who was just there in his car on private property. The officer had no reason to even detain him in the first place. So I I'm a little confused. Um normally people don't have any problems identifying themselves cuz I want to I know I know you're doing construction here. You told me that you're that is that what it usually is? Nobody has any any problem. So the other thing is is you know it's after hours. It's kind of weird to have people, even construction workers, to be on site at this time of day. Yeah. Well, I've just had some problems with um um like people I've had other officers stop by and ask them to, but I've had people um throwing pipes at the door, going in the back, keep an eye on it. Okay. All that stuff. And I get that 100% because you know throughout the entire city there's burglaries and stuff that happen. So how can I verify that you are supposed to be here besides you having a key to that place? Uh I guess just come here during the day. Well I don't work daytimes. You work at night. I don't know. tell you that other than respecting you cuz you can't you can't give me a phone number. You don't want to give me a phone number and you don't want to identify yourself to me. Well, it's not that I don't want to identify you. It's just that have I committed a crime? I I don't know. So, yes, unless unless I can verify you are supposed to be here, then you are trespassing. Oh, this is trespassing. Yes, sir. That's Is that how that works? So, you're on private property? Yes. I don't know how trespassing works. Yep. So, if you're on private property, you're trespassing. Yep. Really? Mhm. I'm going to put my shoes on if you Well, just uh if you don't mind opening the door so I can really see what's going on down there. Does that make sense? Sure. Yeah. I see the wrench and stuff. So, yeah. All my all my tools are right inside that building, too. Okay. Oh, you got a little partner there. Oh, she goes everywhere I go. Oh, your lady. It's okay, baby. She's a sweetheart, too. So, and like I explained to her, I have no ill will, no weapons in the car. So, okay. Is there a reason you don't want to identify yourself? I'm a constitutional right advocate first and foremost. Second, I just build stores and I'm building I've been down here seven weeks building that one. So, I'm just watching. I'm just the Dollar Tree and Family Dollar. I'm just um uh uh making sure there's been some suspicious weird activity and there's been other officers around here. She's not going to come out, is she? Uh she might. I don't know. Okay. All right. So, sir, I am going to detain you. Okay. I do need to identify yourself. You're refusing to identify yourself. Have I committed a crime? I know I've asked. What's the crime? You're trespassing and you do have an open container in your vehicle property, right? Yep. So, I do need you to go ahead and turn around and transfer me 35. And I don't obviously consent to any s. Do you have a wallet or anything on you? I do not. Okay. Um, I know you said that when I asked you if I was committing in a crime, I know that you said, um, yes, I'm trespassing. That's not how trespassing works. And, and I know the owner really well of every one of these shops because I've been here so long, but also this property. And in order to be trespassed, and I hate that I have to tell you your job, that I actually have to be trespassed. So, if the owner trespasses me, which he's not going to, but say he did, then I'd have to have the opportunity to leave. And you know this. So, when's the last time you were contacted by law enforcement was my question to you, right? And I ask you the same question. There's no way that I should be in handcuffs right now, detained. First of all, I have not committed a crime. So, you can't tell me when you were contacted by law enforcement. I don't know. They've not contacted. They just came through and seen how I was doing when I was working. Well, that's completely different, right? Yeah. Okay. Was that daytime or night time? And daytime. Both. But I'm not answering any more questions and I'm not talking to you. Okay. So, and like I said, I've done nothing wrong. The officer needs specific articulable facts that a crime is happening. Being on private property after hours can be suspicious. But if the suspect has a legitimate reason, like construction or permission from the owner, immediate handcuffing is often overkill. So, how could we mediate this? Migate this for next. I'm not talking. You can do what? Say whatever you want. I'm not answering your questions. Check a sign. I mean, I answering question. No, I'm not asking a question. I'm I'm letting you know. I think it would be great if for any future reference, you know, if you could get I'm not I think it would be great if any future reference if you came up here and asked me what I was doing or somebody and I told and they told you I'm right there that you don't do this. This is this is taking away from my freedom right here. You have me handcuffed and you've been recorded since you pulled up and this is the this is wrong. Okay. Yeah. So, I would say probably and I'm trying to be respectful to you, but Well, it's kind of rude if you're interrupting me. It's kind of rude that I'm in handcuffs right now. You expect me to be happy? I'm not. The best thing that I told you before, the best thing you could do is just go about your way. I'm not breaking a law. I don't break laws. I've been doing this a long time. Well, I'm sorry. I'm trying to help you, but you're not helping me by handcuffing me. Are you kidding me? Can I say something? No, I don't want to hear your Okay. I'm sorry you feel that way. I'm sorry you have me handcuffed. I'm sorry to that. If you want to contact the owner of the property, go ahead. I can't tell you anything else. And yes, I know him personally. I'm building this 18,000 square foot. So, how do I get a hold of the owner? I got his number. Okay. Do you Can I get that from you? Hell no. Okay. Get it another way or just uh take my word for it. Or if nobody's made a complaint that I'm trespassing, go along your way. I'll be here though for three more weeks at least all times of the day and night. Or if you wait until 6:00, the superintendent will be here. It's okay, baby. So, whose car is this? I Sir, I don't answer questions. Well, it's not yours. I'm not the registered owner. I don't answer questions, sir. Okay. So, it's it's I haven't committed a crime. Yeah, you have. What? What crime? You're in a parking lot of a closed business. Nothing's open. Not a crime. And you are trespassing. Not trespassing. That's not how it works, sir. It's not. With all due respect, go ahead. That's not how it works. Trespassing. You got to be asked to leave if you are and if and and if given the opportunity to actually leave and you should know this belong in the stop. You could let me go which is the right thing. That's what you right now. You're violating my rights by having me in here and having me out here and I haven't committed a crime. But what you just did, that's garbage, man. Okay. I'm sorry you feel that way. No, that's the way it is, man. This is America, dude. I'm just sitting down in my car watching and you solicited a trespass. You don't think that I know the law, but I do very well. You can't solicit a a trespass. I bet I'm not even trusted and and I know the owner of this whole entire property very well. I deal with them every day. Apparently not cuz I spoke with the property owner of this property and he does not know you. Okay, whatever. Yeah, you can't. There has to be a complaint too on the other aspect. They are on. Yeah, they are. So, I'm going to remove the handcuffs and I need you to keep I need you to keep your hands. I know what to do. Quit giving me directives, please. I'm not doing anything unlawful. And I'll need you to keep your hands behind your back until I can relax. It hurts. We're not bad, are we? Look how nervous you made it. It's okay, baby. She sl better. It's all right. Ugly. Ugly. Ugly. Ugly. I like it. Oh, you got Are you sweet? Keep your hands behind your back for me. Yeah. I don't have to do what? All right. Mr. Since you know you're not allowed here. I'll be here tomorrow. Then the citations, including thirdderee trespass and open container that he was handed, were dismissed eventually, and he is looking to file a lawsuit against all the officers involved. You going to rode on the window? Why not rode on the window? Yes, may I help you? Officer North, McGomery County Council's precinct 5. The reason I pulled you over is your license plate is is obscured. I cannot see your license plate. Um, you're full of crap anyways because it's got my bicycle things on it. It still can't be covered. Yes, it's not covered. It is. But that's it's obscured. Legal. No, it's not. I cannot see your license plate. I cannot see your license plate. I'm sorry. Okay. So, it's obscured. Do you have your your license on you? Yes, I do. Okay. However, it's not obscured. Okay. It is obscured. You can call officer Simpson. Um, Sergeant Simpson, and ask. It is not obscure. So, me not being able to see your back license plate. Don't roll up your window on me. Oh, watch me. Okay. I was in an accident to begin with. Don't threaten me. I didn't threaten you. I said don't roll. Don't roll up your window on me. It was an accident to begin with. Okay, that that's all I said was don't roll your window up on me. Where's your license? Um, it's not obscured. Okay, you can read. We can we can agree to disagree. Where are you coming from today? None of your business. Okay, cool. Any weapons in the vehicle? None of your business. It is my business, actually. No, I don't have to answer any more questions. Yeah, you do. Are there any weapons in the vehicle? Here you go. Are there any weapons in the vehicle? No. Okay. Any illegal narcotics? I'm not answering any more questions. Okay, cool. Go ahead and hop out of the vehicle for me. Excuse me? Hop out of the vehicle. Excuse me. Go ahead and hop out of the vehicle. Um, say that again. Go ahead and hop out of the vehicle. No. Get out of the vehicle. I'm in the vehicle. Yeah, you are. Oh, no, I am not. Yes, you are. No, I'm not. Yes, you are. Okay. 8520, can you send me another unit? I have a occupant that's refusing to get out of the vehicle. I'm not getting out. Yes, you are. This officer initiated a traffic stop that had no legal basis from the very beginning, but she went on to illegally search the woman who knew her rights really well. All I asked was for you to get out of the vehicle. I am not getting out of my vehicle. I don't know what's in this vehicle. You're not telling me if there are weapons. I asked you if there are weapons. You said I don't have to tell you. You said I don't have to tell you. So for all I know is you have a firearm. There is no vehicle. There are no weapons in my vehicle. Uhuh. You said I don't have to tell you. Exactly. But I also told you there was no vehicles in my There is There's no weapons in my vehicle. Okay, cool. Oh, I do not have to get out of my vehicle. Yeah, you do. It's a lawful order. No, it's not. Okay. We you again, we can agree to disagree. I'm not doing anything wrong. There is no reason for me to get out of my vehicle. And I gave you my driver's license. Okay. But I again I'm asking you to get out of the vehicle and you're still refusing. Getting out of my vehicle. Okay. Well, we can either pull you out, call Sergeant Simpson. I don't need to call Sergeant Simpson. There is no reason for me to get out of my vehicle. I've not done anything wrong. So me asking you is a lawful order. No, it is not. Yes, it is. It is not. It definitely is a lawful order. It is not a lawful order because there is no reason for it. Okay. Hands on the hood. You have anything on you that's going to poke probably me? Pat you down for officer safety. No. Hands on the hood. That's not a pat down. That is my bra. It is a definitely a pat down. You We can argue all you want. I don't know why you are being so defensive. You are not patting me down. You are peeling up under my bra. Is Is that I'm allowed to? No, you're not. Okay. Where are you coming from today? Not your answer. Okay. Anything in the car that you're not supposed to have? No. Okay. Have you ever been in trouble with the law before? No. No. Except for that I got pulled over like um I went to jail for inspired inspection registration like a long time ago. Okay. So, there's nothing inside the vehicle that you're not supposed to have? No. Okay. Do you mind if I search the vehicle? Yes, I do. Okay. Okay. Stay right there. Do we have any canines, bro? No. Do we have any canines on your own? No, he's um so out on a traffic stop um for obscured license plate. Um she has like bikes covering her license plate. I can't see the license plate. Um when I told her that I wasn't able to see the rear license plate, she argued with me and says that it's not obscured. um this this and this, I asked her multiple times to get out of the vehicle. Um because when I asked her, sorry, hold on. Uh when I asked if there were any weapons in the vehicle, she said that she didn't have to tell me. And I said, "Well, it's for officer safety. Um this, this, and this." And finally, after asking her multiple times, she said, "No, there's no weapons in the vehicle." I then asked her, "Okay, well, do you mind stepping out? That way I know, you know, for my safety, your safety, everything's okay. She then uh rolled up the passenger window, said it was an accident, and then um she refused to get out of the vehicle when I asked her multiple times. It took four other officers to ask her verbally. We didn't have to physically remove her. Um but she finally got out of the vehicle. And then um as I'm patting her down, seeing if she like, you know, stuffed anything anywhere in her bra, she said that I was not doing a pat down, that I was illegally searching her. Um so I was going to see if if that's enough for um interference. Give me a second. I want to look at something. Okay. Okay. Here's here's where you're at. I'm with you. Technically, yes, you have the violation if you want to file it. However, there are some problems that will make you look terribly bad if you have to defend this case in court. Okay. The first one is the first one is this the statute that I wanted to look at is that bicycles and motorcycle racks attached to a vehicle in normal and customary manner cannot be used as a basis for obstructing a license plate. It's actually spelled out. It's actually spelled out in the statute. Okay. Even even with the bicycles on it. I'll read it to you. Um Subsection A7, which is obscured license plate, may not be construed to apply to a bicycle or motorcycle rack that is attached to a vehicle in a normal or customary manner. Now, that's problem number one. Problem number two, it sounds like she has a valid point about the search in saying that you patting her bra is not a pat down, it's a search. Um, so the long and the short of it is I would not do it, but if y'all really want to bite off that fight, yes, we'll file it. No, I mean, if I'm I'm going to go with with obviously what you say because I'm I'm calling you to get your opinion on it. Um, yeah, I mean, that's that's where I'm at. You could you could easily make out the case for interference with public duties for her refusing to come out of the vehicle for an extended period and requiring a number of officers to get involved. However, a defense attorney, in my opinion, is going to eat you alive with the other two issues at a trial on that case. So, I'll go whichever way y'all want to go, and I'm certainly happy if you want to talk to your sergeant about it and make a decision that way. No, no, no. I like I said, I I called you to get your kind of approval on on the the stuff that we got. I think is legally you're right. Morally, I wouldn't take that fight if I were you. Yeah. Okay. Um, I was under the impression that if we weren't able to see a a plate in the back at all, then it was obscured. Um, well, I read you the exact language and I mean, so you can see how you think it applies to your exact facts cuz you're you're looking at your situation live. I'm not. Yeah. No, I got you. Uh, yeah. I mean, I physically can't see the plate. So, like I legit had to go under the bikes as I'm pulling over the vehicle to see the plate. Um, like there's three bikes. Yeah. So, I'm giving you my pieces. So, yeah. Whichever way you want to go, sign with me. Okay. All right. Thank you so much. Take care. All right. Bye. We didn't get a response on any other That's you can discover. Were you want to speak with the sergeant or do you have any questions? Nothing. All right. Well, the sergeant's right here if you want to speak to him. If not, um you're more than welcome to go on about your day. Thank you. Um do you have any questions for me, for him? No. Okay. The interaction ended without further incident. There is no information available on whether the woman has taken any legal steps against the officer, but she could file a civil rights lawsuit, internal affairs complaint, and state law claims.
