I come with the wrong ID3. >> What's going on? >> Can I help you? >> Yeah. No, she gave my >> Don't worry about it. Yeah. >> All right, we're good. >> It's nothing that silly. All right. I just like had an argument with somebody. >> How much you had to drink? >> Nothing. Just one. >> Just one. >> Yeah, I could do the test. >> Okay. >> In the state of New Jersey, a police officer can suspect you of a DUI and initiate an investigation even if they only see you standing outside of your vehicle, yelling on the phone like this driver. because you could be in what the state of New Jersey considers as actual physical control of the vehicle with keys in hand. Creating reasonable suspicion of impaired driving, though proving the actual driving part becomes the prosecution's challenge using other evidence like witness statements or your own words. So, New Jerseyy's laws on DUI focuses on the suspicion on individuals in actual physical control, not merely actual driving. >> Somebody, >> how much you had to drink? >> Nothing. Just one. >> Just one? >> I could do the test. >> Okay. >> I'm not worried about it. Here you go. >> Is the car in your name? >> Yes, it is. I have everything. >> Just get all the info, the registration insurance. See what I got? No problem. He doesn't have the insurance on it. >> No insurance on it. >> No, but I do have it. >> Come over here. >> Yes. >> You said you had one drink tonight. >> Yes. I got with the wrong guy. >> Hold this. >> That just what happened. >> All right. Just put your feet together, arms down at your side. >> Okay. See a tip of my pen. >> What I want you to do with your eyes and your eyes only. You're going to follow the tip of my pen. You're going to keep your head straight. You understand? >> Yes. Okay. Keep your head straight. >> Yes. I swear to you, I'm just like a party. >> Keep your head straight. >> Head straight. Follow your eyes. Okay. Almost done. One more. >> Okay. Do you want to do the rest or you want me to do it? >> I'll watch you. Okay. What do you guys think? >> Come over here. >> I'm just in the What the heck? >> My man, I got to use over here. So, just go over there. I'm not interfering. >> Okay. >> You want me to come over? >> Yep. Just come over here. You see this straight line here? No. No. Off the curb right here. All right. What you're going to do is you're going to take your left foot, put it on the imaginary line. Take your right foot, put it directly in front of your left foot in heel to toe manner. Okay. You can get into that position now. >> Other way. Right foot in front of the left. >> Okay. You're about to be arrested. >> Now is your chance to grab a mouse or your finger and click the like button like you have never clicked it before. >> Other way. Right foot in front of the left. >> Okay. >> You're about to be arrested. You're interfering. You're about to be arrested. >> Walk away. You're allowed to watch. You can record anything you want. Open your mouth again. You're under arrest. >> I'm sorry. So, like I said, left foot on an imaginary line, right foot in front of the left. >> Yeah. Here you go. >> All right. Stay in that position. Don't move till I tell you to begin. You understand? Thank you. When I tell you to begin, you're going to take nine heel to toe steps down this line. All right. You're going to look down at your feet. You're going to count your steps out loud. It's going to look like this. One, two, three. You're doing nine. On your ninth step, leaving your lead foot on the line, take a series of small steps with the other foot. >> Right. Okay. >> And then take nine steps back down the imaginary line. 1 2 3. Again, count your steps out loud. >> I'm turning around. >> Just like I explained. Do you understand the test? >> Yes. >> You may begin. >> Okay. >> Ready? One. >> You said you understood. Yep. >> What's that? >> You got to do the test. >> All right. But you didn't count. You didn't count. You didn't count. Let's count. Let's count. Right. And then I'm turning around when I >> following the instructions in a field sobriety test is highly significant. The test are specifically designed as divided attention test to evaluate a person's ability to multitask both physically carrying out directions and mentally remembering them. Simultaneously, failure to follow the officer's instructions exactly can be interpreted as a sign of impairment and used as evidence of intoxication in a DUI or DWI case >> and then I'm turning around when >> as I as I explained >> that I'm not counting. I'm not counting. >> Okay. Is that the end of the test? >> I'm counting. No, I'm not counting. >> Okay. >> You're counting, right? >> As I explained in the test. >> All right. Well, I'm not counting. >> Okay. No problem. We're going to go back over here. >> All right. Let's count. >> Nope. We'll do the next test. >> All right. >> All right. Feet together, arms down at your side. When I tell you to, you're going to raise one leg either leg of your choosing. >> Okay. >> Approximately 6 in off the ground, foot parallel to the ground, and keeping your leg straight. Okay? It's going to look like this. While you're in this position, you're going to count out loud. 100 1,002 1003 until I tell you to stop. If you put your foot down, >> 1002,00 Okay. >> Okay. If you put your foot down, no big deal. Pick your foot up and continue where you left off. Do you understand that? >> Keep it up until you say >> 6 in foot parallel to the ground. >> Counting your your >> 100,00 1,002 1003. >> So you say >> till I tell you to stop. Do you understand? Now >> hold on. You may begin. >> All right. So, right. I'm not understand like >> But don't you understand? >> I've been through this. >> Okay. >> So, >> I just told you raise your leg. One leg. Either leg of your choosing. >> 6 in off the ground. Foot parallel to the ground. >> 6 in off the ground. >> Yes. And count out loud. >> One 100,0021. >> Put your foot back down. >> Okay. 1,002. Right. >> No. >> And then All right. But I never did this. >> Okay. >> Bear with me cuz I'm not >> One more chance. I'm not drunk. Like >> Okay. These aren't very hard. >> All right. But I've never been through this. >> Okay. >> I'm nervous. Like there's never >> one foot. >> Okay. >> 6 in off the groundh 1,002 until I tell you to stop. >> Okay. Okay. Okay. So, right now, >> go ahead. >> Okay. 1,001 1,002 1,003 1,004 >> Pick your leg up. 1,005 >> like this. >> No. >> No. Like I went down without you saying >> I told you until I tell you to stop. >> Wait, wait, wait, wait. I'm not like I'm not >> All right, you can stop. All right, just turn around. Put your hands behind your back. hand like that. >> Yep. >> Hold on. Stop this video. Subscribe with all notifications on to your number one analyst, the prime analyzer, and you can be one of the first to watch me analyze videos like these. >> I told you until I tell you to stop. >> Wait, wait, wait, wait. >> I'm not like I'm not. >> You can stop. All right, just turn around. Put your hands behind your back. Like that? Yep. Are you serious? >> Yep. >> Why? Suspicion of DUI. Are you serious? >> Yeah, I'm serious. I'm call for >> I never been through this before. Are you serious? >> Yeah, I never been through this. >> Okay, it's not the end of the world. >> Oh, I mean, >> keep your Keep still. Keep still. >> I never >> I never been through this. >> So, okay. I'm not arguing with you. We're not fighting. >> I just never been through this before. I know what you're doing. >> You're under arrest for DUI. >> For DUI? >> Yep. >> Are you serious? >> All right. So, we have to come back. >> I had a little bit of drink. >> Okay. Well, you failed the test horribly. >> How? >> Cuz you did bad. Let's go over here. >> All right. Come on. Just relax. >> All right. No problem. I'm not fighting you. Okay. Like, >> okay. >> All right. No problem. >> Do you have anything in the car that you need? >> Not at all. Not at all. >> Okay. You have someone that can come get you at our headquarters? >> Um, what what have like >> car is getting impounded? >> Okay. >> Okay. And I need someone that's sober to come pick you up. >> Okay. Can I get my Can you >> I'll grab it. Yeah. What do you need? >> My phone. >> Your phone? >> Yeah. >> Anything else? >> No problem. >> Okay. Watch your >> This young man is asking if he can take the car. I already explained to him it's part of protocol. The John's law. The car has to be towed and he's saying no. >> I I I've had it happen and seen it happen that evil driver. It could be parked. >> Not happening. >> Try to tell you. >> But under what protocol? >> John's law. >> We just explained to you John's law. No, but tell me the exact total. >> John's law. If somebody is arrested for DUI, >> it's a state law. We have to impound. >> In the state of New Jersey, John's law mandates that law enforcement impound the vehicle of someone arrested for driving while intoxicated under statute NJSA394-50.23, 23, preventing the impaired driver from immediately getting back on the road and reducing further DUI risks. A law named after John W. Elliot, a victim of a drunk driving crash. The impoundment typically involves a mandatory waiting period, often 12 hours. And this law also creates responsibilities for vehicle owners who loan their vehicles to intoxicated drivers. John's law. >> We just explained to you John's law. >> No, but tell me the exact code of >> John's law. If somebody is arrested for DUI, >> it's a state law. We have to hand >> What? No. >> What do you What do you want to What do you need to understand? What What What's >> No, man. I I I've been through this situation before and I've had officers and I've seen it happen to friends. I've had it happen to myself. >> When I was 20 years old, I got a DUI. I'm 28. I just turned 28. That's what my whole celebration was about. >> Okay. >> Are you the owner of the car? >> No. >> Then I can't release the car to you anyway. >> It's not releasing it. Yes, it is. I've had an officer themselves drive the car and drive and park it on the street. You're in Rochelle Park. This is how we do it. car. >> If you have a problem with that, talk to the governor and the legislature cuz this is our job and this is what they tell us to do. >> I'm not losing my job for a car so that she gets released and then crashes the car. >> My man, maybe that's how they did it. I'm I'm That's probably how they did it where you were. >> No, I I understand. I >> It has to get told. >> I'm not trying to impede anything or trying to like make you guys do anything outside of the realm of your job. I just like >> Does Gorman know >> Does Gorman know it's a 450? >> No, not yet. Okay. >> I just told the contact. You probably know >> 57. I have one under 450. >> Like that. It was just that she's going to go through what she's about to go through. And I thought >> Okay. Someone sober that can come pick her up. >> I can do whatever test you want. >> I'm not doing tests on you. I didn't see you driving. We have to bring her back and do paperwork. Where do you live on Oak? >> My family lives on. >> Okay, good to know. >> What's the law? >> She's got uh weed in her purse, but she's going to She's going to blow over. Yeah, >> she almost hit me, dude. She was parked in the middle of the road. >> I saw her peel out, but >> and then she peeled right by my car with the lights off and then I saw the other car. >> I had a feeling, but I was like, I saw you over there. I never even >> I'll be transporting one adult female my location. Police headquarters truck 8 starting 17056.0. I'm not even giving you a hard time. >> Guys, you know that's it. I'm not giving you a hard time. You wouldn't let me off. You want to give me a warrant, fine. You know, you want to take my car, fine. But by treating me like I'm so criminal and like I'm a mother, like I I don't like trouble. You treating me like I don't have to me like I did something wrong. Like you treating me like get away like I'm in the wrong neighborhood and I didn't do nothing wrong. I was just out with the wrong guy. That's it. And now look at me for going out on day with wrong guy and I'm being treated like I'm a criminal. I didn't even do nothing wrong. Like if you think ahead of I'm driving intoxicated, fine. But then you tying me up like I'm up. Who's >> you are like I'm tell you that you a nice guy like if I got to get back in your seat fine but I'm not giving you a hard time is back in your seat no problem >> who's who's the owner of that car >> who's the owner but you treated me like I'm [ __ ] I didn't do nothing wrong. I went out with the wrong guy. That's what happened. >> You almost hit my patrol car. >> Dude, okay. I'm sorry. They give me a ticket. >> You You're getting a ticket. You're under arrest for DUI. >> Like I'm a criminal. I didn't do nothing wrong. >> You're driving under the influence. >> That's the car. Take it away. Fine. >> Okay. >> But you treated me like I'm like why? Because I'm Puerto Rican. Like >> what the is the problem? You could have took me a piss in the spine when you treated me like I'm a cook. I never been locked up like this in my life and you treated me like I'm some like like I did something really up and I just went out on the date with the wrong guy. That's it. I never been locked up in my life. >> Five ending. >> Keep going. 17056.8 >> 350 >> I never did anything I followed every rude I'm so criminal. >> If I'm rude for doing my job then I apologize. >> Feel good. That's what it is, right? You feel good. I hope you >> This was your wife. You wouldn't this way. >> Oh, here. >> You think I want to be doing this right now? >> I did not say I would have cooperated, but you treated me like I'm a criminal. I would have cooperated with everything you said when you had your bag. No problem. I went out with the wrong guy tonight. That's how that happened. I went out to the wrong guy, the wrong neighborhood. My heart is I just had a fight with him and he left me. He left me and you guys got me. But I wasn't going to hurt nobody. I was 10 minutes away from my house. Just be careful. >> I'm not doing anything. Just whatever you want me to do, I'm going to do. >> Okay. Can you step out? I'll help you. >> I don't need help. >> Just be careful. We're going to go up these steps right here. Just be careful. All right. Go ahead. Second door on the left. Right here. You could just have a seat right in the right. Hold on. Hold on. Over here. Over here. You can come right here. Okay. I'll take the cuffs off you. All right. >> All right. Can you turn around so I can take the cuffs off you? And I'm going in the like. >> Okay, hold on. If you stop turning, I'll take the cuffs off. >> You guys are cheating like some criminal. >> This is [ __ ] up. >> All right, hold on. Stop moving. >> Sorry. >> I'm not even trying to fight you guys. >> I'm not trying to fight you either. >> I'm doing my job. >> In my life, you guys cheating me like this. >> Just do me a favor. Hold on. Hold on. Can you take your jewelry off for me? >> Yes. >> Why you cheating? this like what's the problem you do? >> Take a couple deep breaths and we'll talk. All right. I need you to just Yeah. Can you talk to me before like I never give you a hard time. You treat me like this. >> Take a deep breath. >> All right. What do you really want? >> Your rings. Your necklaces. I mean like this is crazy. Why are you treating me like this? >> I'm not treating you like anything. Take a deep breath. >> Why you couldn't just tell me like, "Okay, we've taken your car. We think you're intoxicated, but you guys are treating me like >> I'm not treating you like anything. >> Just take a deep breath. We'll get through this and then you can go home. The The easier you make this, the faster." >> I'm not making it hard for you. >> But you don't let me talk, so you just keep cutting me off. Sorry. All right. Can you just take those things off and I'll talk while you're doing it? >> Listen, >> the way you were. All right, let me talk cuz you have a 21-year-old. >> All right, so relax. You're going to go home. >> I am. But why you >> Can I talk? >> Yes. >> You literally haven't let me say more than two words. >> Okay, listen. In New Jersey >> or in any state, >> okay, when you're observed driving, >> Yes. >> and you fail field sobriety test, you get arrested. Okay. >> For DUI, >> in New Jersey, it's not a crime. Doesn't go on your criminal record. It's a traffic ticket. Only reason you get put in handcuffs is because you cannot be responsible for yourself at this point. I have to become responsible for you. In the state of New Jersey, a standard DUI driving under the influence isn't on your criminal record because the state classifies it as a serious traffic offense, not a crime like a felony or a misdemeanor. So, it's handled in municipal courts by a judge, not a jury, and appears on your driving record permanently, but not your criminal history. though repeat offenses have escalating penalties and can become criminal. >> Okay, listen. In New Jersey >> or in any state, >> okay, when you're observed driving, >> yes, >> and you fail field sobriety test, you get arrested, >> okay, >> for DUI, >> okay? >> In New Jersey, it's not a crime. Doesn't go on your criminal record, it's a traffic ticket. >> Only reason you get put in handcuffs is because you cannot be responsible for yourself at this point. I have to become responsible for you. I have to release you to someone that is sober that can come and get you. We have to take care of some paperwork. The faster and more cooperative you are. >> I was with the wrong guy. >> Okay. >> Happens. >> I'm just nervous. I never been. >> All right. I'm not treating you like a criminal. >> I'm not treating you like a bad person. Okay. We all have bad nights. Yes. If you had a daughter or a niece, also the problem. >> Can you take those things off while you're talking? >> Yes. >> I want to get you out of here so you can go home. >> I want to get out of here, too. >> All right. So, I need you >> to listen to the lines. >> All right. So, I need you to help me help you. >> Can you help me? >> I I can't take those off. Just take a deep breath. Relax. We'll get you out of here and you'll be on your way. This is a dating. >> So you have three kids. >> I have three kids. 21 20 19. >> I never thought I would be right now. >> It's not the end of the world. It's not a big deal. >> It's embarrassing. >> But there's no one out on the road. >> It's still embarrassing. I don't want to go through this. >> All right. Well, the whole reason my brother's top >> Listen, the whole reason that we >> I love Can I talk? Yeah. >> The whole reason that we even had an interaction with you is because somebody was screaming on their phone on Oak Street, which was you. >> Yes. [clears throat] >> So that's why we came. Okay, let me finish. So we came to investigate what the loud noise was. As I'm driving up to you, you peel out. You're parked in the middle of the road with your lights off. And then when I start to pull up towards you, you peel out and almost hit my car. So, you have to understand I'm not doing my job if I don't go and check on you. >> Okay. So, then when I smell the alcohol and you you failed field sobriety, that's why we're here. I have no ill will towards you or anything. >> Yeah, you are. We're the wrong >> I hear you. Trust me. Guys are jerks. But >> I'm >> But by you screaming on the side of the road, why do you That's why we're there. If you were just quiet. >> I'm being disrespected. >> I know. >> As a woman, >> I hear you, but we're not the ones. >> You of course you got to understand. You know, you cop, you know, but this mother like it's a date. >> I hear you. >> You're not going to understand. That's okay. I'm going to follow the rules. This is so embarrassing. >> Nothing to be embarrassed about. We all make mistakes. >> Just Can you hand me those? I'm going to put them over here. No. Just >> I don't need you. >> No. No. No, >> this is supposed >> all this stuff. I'm going to give it back to you. I just I got to take it out of here. >> It's so nasty. But where is that? I get caught and he doesn't. >> Who was the other car that was there? >> I don't know who the [ __ ] is the guy, but I know he's his friend. >> His friend >> is of course. >> All right. So, what we have to do is we have to take care of some paperwork. I got to wait for my partner and then uh depending on how you answer, put you on the on the breathalyzer and then we'll get you a ride home. >> All right. Do you know anyone that you can call to come get you? >> But >> the guy that was there, was that your cousin? >> Yes. >> Okay. Was he drinking? >> Yeah. I just >> Okay. >> I mean I need for me to call somebody and get my phone. >> Yeah. Yeah. I'm going to give you your phone. Don't be embarrassed. >> Whoever you're going to call, do you know where do you know where they live? The person you're going to call the one guy. >> No, no, no. The person you're going to call to come get you. Where do they live? >> It's I don't know. I don't have nobody. I'm like the black sheep of the family. That's me. >> Well, I just need someone to come get you. A friend >> right now my phone. >> Okay. So, like I said, once we get through the the 20 minute I have to wait 20 minutes before I can do anything. All right. All right. I just have to read you your rights. Okay. You have the constitutional right to remain silent. Do you understand that right? >> Anything you say can be used against you in the court of law. Do you understand that right? The right to the presence of an attorney during the questioning. Do you understand that right? If you cannot appoint an attorney, one will be appointed for you prior to any questioning if you so desire. Do you understand that right? You have a continuing right to exercise the above constitutional rights at any time during the question. Do you understand that right? >> Yes. >> Uh not not criminal. No. >> That's why I said you're you're freaking out. >> It's not a big deal. >> He was in my [ __ ] >> I hear you. >> How would you feel? >> I get it. You give a a chance on the first date. >> Well, you got to weed out the bad ones to find a good one, right? >> It's on the right. >> It's not on your It's not on your criminal record at all. It's literally a traffic ticket. But like I said, because it's DUI, we have to bring you in. Otherwise, it's the same thing as getting a traffic ticket for a tail light out. It's it goes on the same record. So, it's not like you have to go to employers and say, "I have a criminal record." >> Now, other states, you'd be screwed. >> I'm just >> I hear you >> situation. >> I'm I'm so used to going to stay home today. >> I'm so used to >> I'm used to women taking their frustrations out on me. While the residents of New Jersey who are DUI first offenders get to enjoy getting a DUI only on their driving record and not on their criminal record, the auto insurance companies will not allow them to avoid significant high premiums for receiving a DUI because a DUI in New Jersey, even if treated like a traffic ticket, will significantly raise your vehicle insurance rates for several years because insurers see it as a major risk, potentially increasing cost by over 100% as it goes on your driving record permanently in New Jersey and signals a higher chance of future accidents. If you get a DUI conviction, you can expect a big jump in premiums right after the conviction, and rates stay high for years, though some insurers re-evaluate after 3 to 5 years, and rates may decrease if you maintain a clean record.
