Welcome to the Prime Analyzer channel. This is what you can expect from this channel, an analysis of videos. That's correct. This is not a reactionary channel. You can expect great commentary and last but not least, [music] an education. Now, it's time to analyze this video. Step out the car. Step out. >> STEP OUT. >> WHY? >> Cuz I asked YOU TO. >> NO. >> YES. >> For what? Step out. >> No. >> You want to get You want to get locked up >> for what? >> Right now, I've been resisting as you step out. >> I'm detained, but you never gave me a reason. You pulled ME OVER, THEN YOU HONKED YOUR um siren cuz I'm backing up. Did you want me to stop on this side of the road? No, we're not doing that. >> STEP OUT. >> STEP OUT. >> FIRST OF ALL, CAL THE DOWN. >> I stepped out. >> This vid's contagious. Click. Don't hate it. Show me what you got. No, we're not DOING THAT. >> STEP OUT. >> DOING THAT. >> STEP OUT. >> FIRST OF ALL, CALM THE DOWN because I GUESS YOU STEPPED OUT. >> NO, GET YOUR SUPERVISOR. >> Sorry for no here. >> You got >> You got the right one. CUZ YOU WERE DOING TOO MUCH. You were following me and then you >> You know why? YOU KNOW WHY I was You know why I was following you? >> Why? >> Because you I saw you at least do at least four unsafe lane changes. >> Because I did MY BLINKERS. I WAITED AND MADE SURE THAT WAS >> uncooperative driver. Hey Siri, call phone. >> Make sure I have my lawyer on the phone. >> That's fine. >> Yeah, it's fine. I don't know why it wouldn't be. >> Okay. Um, you got one chance. Step out of the car or else I'm going to arrest you >> for what? >> Resisting arrest. I I by by the Supreme Court said a police officer can have you step out. >> Breathe. Calm down. >> Because I'm not going to do anything to hurt you. So, calm down. >> You have to step out of the car for any reason I deem necessary. So, yes, a driver must step out of the vehicle if a police officer orders it during a lawful traffic stop. But I totally disagree with how this cop exited his vehicle and immediately started throwing directives towards the female driver to exit her vehicle. No matter how the female driver was driving prior to this stop, I believe that the cop could have and should have allowed this traffic stop to be a traditional traffic stop. However, the US Supreme Court has ruled that officers can order a driver out of a vehicle during a lawful traffic stop for safety reasons and refusing to comply can lead to an arrest. >> I'm down. >> You have to step out of the car for any reason I deem necessary. >> So, first thing you did was come up to me. >> No, no, no. You're not dict You're not dictating. No, no. First of all, you started screaming at me through the window. So obviously a lot. >> What am I doing? Explain to me what am I doing? >> Three times. You want me explain it to you three times? >> The person you're trying to do that when my partner gets >> I would like for your supervisor to come when I >> Once your supervisor comes, I will listen to him or her. >> Okay. >> Or it or whatever they when I get when my backup officer gets here, I'm going to pull you out and I'll put you in handcuffs. >> And then when you put your hands on me, I'm make sure it's recorded. Cameras on. >> Yeah. Cops love to turn their cameras off when it's for them. >> Listen, you're going to be under arrest. >> Mhm. >> Okay. >> Can we fast forward that part? You said we're going to wait for your person to come. What are we doing until then? >> Because I don't have any weapons on me and I know you're >> I'm I'm going to place you under arrest. You're going to be under arrest. Okay. You know why? >> Yeah. Let me actually make sure I have your bag. >> All right. My bad. >> Okay. It'll be on the paper cuz that's beautiful. >> Okay. >> So, reason I stopped you. >> Multiple unsafe lane changes. >> No turn signal. >> Oh, that's the tag is also suspended for no insurance. So, you get a forew. >> Oh, that's awesome. Yeah. >> Good. >> So, you want to step out? >> No, I won't wait. >> Okay. Well, >> you can stay right there. I'm not going to pull off. You want my keys, too? >> You want to take the keys? >> Okay. >> It's going to be the tow truck. >> Okay. >> Okay. >> I'm have fun with you and baby. We going We going to have a day. >> That's all right. So, all this >> That's awesome. I love that for us. >> I love that for us. >> So, how's your day going other than this? >> Well, I'd rather not be dealing with this right now. >> Me, too. Huh? But you decided to stop me. Well, that's because you're driving in unsafe manner. >> That's not accurate. >> This cop cannot formulate a structured sentence to save his life. I'm not certain if that is how he operates daily or if his lack of being articulate is due to the transpiring situation. However, this female driver is articulate and she can run circles around this cop with her communication skills. The female driver is purposely using her intelligence to get under the cop's skin. And believe me, it's working. This cop is extremely angry inside. And I believe if the body cam wasn't on, this situation wouldn't require another police officer. >> So, how's your day going other than this? >> Well, I'd rather not be dealing with this right now. >> Me, too. Huh? But you decided to stop me. >> Well, that's because you're driving an unsafe manner. >> That's not accurate. >> That's cuz you're driving in an unsafe manner. You might not think it's accurate, but you come to court. >> Hang up. I know. I already said that. Turn my musical. That's okay. I know. >> I'm over here near where live. This Royal Farms up near Bear. I have a um some type of cop here and he's talking about he will take my car. >> I'm going to pull around. We're going to detain her. >> First of all, you're not going to pull me out because I said I'll wait. Don't touch me. I said I'll wait. >> Listen, I gave you every opportunity. I give you every opportunity. >> And I stated to you, I'm going to wait till your friends come. Don't touch me and I'll >> get out of the car. Get out of the car. I'm not moving. >> Move. Hands behind your back. >> Hold on. Stop this video. Subscribe with all notifications on to your number one analyst, the Prime Analyzer, and you can be one of the first to watch me analyze videos like these. >> Get out of the car. Get out of the car. I'm not moving. >> Hands behind your back. >> PUT YOUR HANDS BEHIND YOUR BACK. >> DON'T PUT YOUR HANDS ON ME. I said I was GOING TO >> GET OFF ME. >> Then move. >> Punch me in your FACE IN TWO SECONDS. OKAY, >> I GOT THIS. WHAT'S the problem with so important? >> Get on the ground. >> Thank you guys. >> Get on the ground. Didn't have to do that. >> Get on the ground. >> Give me a second. GRAB ON my foot. >> Let go OF MY FOOT. >> LET GO OF HIS [ __ ] FOOT. >> We got to stay back. Stay back. Stay back HIS FOOT NOW. [screaming] GET OFF THE FOOT NOW. You don't get >> I got this one. You got this one. >> The other one, right? >> Yep. I got this one. >> Stop resisting and give your arm. GIVE YOUR ARM [screaming] NOW. >> NO. IF I TURN MY FACE, I'LL GET IT ON CAMERA. It's on camera, ma'am. We're all on camera, >> are we? >> Uh, yeah. >> Cops turn on your camera. >> Are you talking to me? >> Didn't have to be like this. >> INDEING APPROACH ME AGGRESSIVE AS YOU ARE AND IT'S A FORCE TO GET A LITTLE GIRL LIKE ME DOWN. I DON'T EVEN WEIGH 200 LB. THIS DIDN'T HAVE TO BE like >> y'all lucky I'm handcuffed BECAUSE IF I WASN'T Y WASN'T on duty do that >> oh yeah >> I'm have fun with you baby >> and then you punch me in my Oh honey >> that's what happens when you don't >> you shut the make me turn your head and shake I don't need to make it. I'm not in cuffs. You have a great day. I am you guys. >> Okay. Take that. >> Stay on your side. Stay on your side. So that you can breathe. >> Cuz if I die, then my door will be. >> Listen, we're not playing this game. All right. >> Get off your back. >> Stay on your side. >> Why are you doing this? Get in the car. Get in the car. >> Get in the car. >> Let's get her to like car as [ __ ] >> Two seats. Take the uh take your back. Please stop playing these games. I can't even do this. This is fun. Three cops. >> You You're not supposed to do this either, >> honey. I'm going to land back three. >> Only 150 to three. [clears throat] You want to buckle me while you're down there? >> Absolutely not. I don't want you all my We have to Can you knock the off? No. You're disgusting. Knock it off. >> You got kids in there and this is how you want to act. >> Okay. How about you just get in the car? >> Put your feet up. >> Music, please. >> Put your feet up. in the car. I swear to God. >> Someone get the door. >> Ready? Hey, >> just shut the door. Watch out. It's fine. Just shut the door. >> So, the driver was charged with two counts of offensive touching of a police officer, resisting arrest, and disorderly conduct. The driver was also charged with several traffic violations. This situation led to an administrative investigation to determine whether the officer's actions were within policy. And additionally, the division's use of force review unit is conducting a use of force analysis, including a detailed video examination. Also, the Delaware Department of Justice, Office of Civil Rights and Public Trust have been referred about this incident as well. Okay. Now, yes, a police officer can legally punch someone in the face, but only if the use of such force is objectively reasonable and necessary to control a situation, protect themselves or others, or effect a lawful arrest when a person is actively resisting or posing a threat. The legality of a punch to the face depends entirely on the specific circumstances of the encounter as evaluated under the Fourth Amendment's reasonleness standard established by the Supreme Court. And as you might know, I am the prime analyzer. And that was my analyzation of this video. And I will catch you on the next one. Peace.
