What's her name? What's her name? Right. Go for 1269. Copy. I WAS FOLLOWING SOMEBODY ELSE. I was following somebody else to the building. Okay, no problem. No problem. No problem. Okay. And tacos. Was it cigar wrappers? Yeah, yeah. Yeah, there's some like it was a bunch of weed in the Right here. Yeah. All right, so this is no longer an investigation This is no longer an investigation for a crash, okay? So, now I'm going to investigate for a DUI. You crashed into the building here. Okay, so listen. >> Okay, hold on 1 second. I'm going to give you an opportunity to speak. Let me read you your Miranda rights, all right? Are you familiar with that? Yes. All right. Ma'am, I cannot go to jail. You're not under arrest right now. You don't have handcuffs on. >> Look, I don't you from my auntie's house. All right, hold on 1 second for me. When that boy stabbed my cousin up, I remember you. >> listen. I'm going to give you I'm going to read you read you your Miranda. You got to let me know if you understand it or not, okay? I am required to warn you before you make any statements that you have the following constitutional rights, okay? You have the right to remain silent and not answer any questions. Do you understand? Ma'am, let me out from the arrest me. I'm reading you your Miranda rights. You have the right to remain silent and not answer any questions. Do you understand? Yes or no? Yes. You have the right to the presence of a lawyer of your choice before you make any statement and during and enduring questioning. Do you understand? Yeah. If you cannot afford a lawyer, you are entitled to the presence of a court-appointed lawyer before you make any statement and during any questioning. Do you understand? Remember you came to auntie's house? >> Ma'am, I need you to let me know if you understand or not. Any statement can and may be used against you in a court of law. Do you understand? Yes. Any statement you make must be freely and voluntarily given. Do you understand? Yes. If at any time during the interview you do not wish to answer any questions, you are privileged to remain silent. Do you understand? Yes. I can make no threats or promises to induce you to make a statement. This must be at your own free will. Do you understand? Yes. Okay. Go ahead, you can speak. Tell me what happened. Listen, ma'am. I didn't never want to drive this car, okay? Remember when you guys came to my auntie's house? The dude was stabbing my like he had a gun the the knife with my cousin. You I got a picture of everything of I seen you. >> I'll do you a favor, step back a little bit. Okay, whatever. But I I have the pictures of you and he was trying to stab my auntie and my cousin and I was I had a picture for you. I was only driving her to wherever her car was. She was going to drive me home. That was the only thing. It wasn't me. So, where are you coming from right now? From Palm Beach Lakes from her house. She was driving to Empire on 45th Street. Okay, so we're on 45th right now. Yeah, okay. She was driving from Empire to 45th Street, okay? I was supposed to just be me and her there and then she was going to take me to my house. Okay. That was the only thing. I don't know how I end up here. That was it. Other than that, I I was not trying to drive to hurt nobody. I wasn't trying to drive to kill nobody, no nothing. I was just helping her out to move her car from her situation to where she was at at that time of the place. That was it. That That That was it. It was nothing more, nothing less. Have you taken any prescribed medications tonight? No, ma'am. Have you had any drinks tonight? >> No, ma'am. Okay. All right, give me 1 second. [Music] I I did not kill your car. I did not kill your car. No, it's not. It went over there lady. I did not kill your car. I don't know what to do. Like you're telling me I can't pee. I'm telling you I got to pee. So, the driver being a good Samaritan decided to put a special coat of tire shine on the patrol vehicle's tires. But this particular special coat just isn't any coat. No, no, no, no. It was manufactured on scene, has a stench, and is courtesy of a long night of liquor, tacos, and weed. And then I asked you only pee in my car and my clothes. You told me no. I can't hold it. You're human. You're human just like me. All right. Pee on the front of my car. I'm done. I'm done. I'm done. No, you don't pee on the front of my car. I don't want pee or pee on my I don't have to pee in your car. I'll stay 10-12 with her. Oh my god. What does that supposed to mean? Cuz I take that as a threat. I'm not threatening you. I I didn't say nothing as a threat to you. You know you got your body camera on, right? >> That's my $20. I never said nothing as a threat to you. So, what did you just say? Nothing. What did you just say? Nothing. Exactly. I take that as a threat. Why? So, repeat what you just said then. Why? Why would I repeat what you just said? You being who I am, why would you say that as a threat? Because of what you just said. I never said nothing to make you feel like a threat. But I'm telling you you can't tell me how I take something. I'm sorry, baby. I'm sorry. I I didn't say All I said was I didn't I just heard it. Me and her sister were Don't step in the yellow river, she just peed. Hello. Yeah, so I'm already read her Miranda. This is the vehicle she was behind the wheel of the car. Um the wheel was on and then the the ignition was on. Okay, hold on. Let me hear what's going on. She passed out behind the wheel of the car. Um they gave her a sternal rub. She came to, of course. Um I already had to reach in the window to put the car in park. Yeah. And then turn the vehicle off. And then she finally came to. She climbed through the passenger to get out. Medics came, cleared her. Yeah, there was a there was a somebody a Don Julio in the backseat. Yeah, I already I already got him. It's called. Yeah, yeah. No, no, no, no, you're good. You're good. Listen, I've I've been trying to get it get it rolling. Get it rolling. I never even did anything to nobody. I'm a medical assistant. I don't really work here in a [ __ ] morning. And then I never did nothing to nobody. I was just trying to help other people out. That was it. And I got three kids at home. Yes. I'm I'm not irresponsible at all. That's the whole problem. I Listen, the thing was I was helping somebody else. Okay, somebody else was doing something to somebody else. I was just helping somebody else get to the car where they was at at Empire. That was it. I wasn't trying to do nothing to nobody, hurt nobody, or nothing. Okay, I gave her I read her her Miranda already. She already read me my rights. Oh, Taylor warning. I'm sorry. I I heard that. Tell me wrong. Tell me nobody did nothing. It turns to step out something. I don't understand. A lot of it. I'm hurting nobody. I wasn't supposed to be driving. I was supposed to be helping somebody move a car from someone else and and then they was going to take me home. That That was what the problem was. It wasn't nothing more, nothing less. I said right there. I was just helping somebody move their car from over there to over there. I don't know what happened after that, but that's it for me. I don't I'm not trying to be involved in nobody's [ __ ] or nothing. That was it for me. And if you want to check the kids in my purse to get me to that room where I'm supposed to be at, that's it. So, you going home to your kids or are you going to your >> I'm going home I have three kids. I'm going home to my kids. Okay, the person I was helping, they live there, too, but you know, it's Sunday. Everybody hanging out with a taste of weed. I was trying to make sure they get home right there and that was it. It wasn't nothing else. Quick question, did you pee on yourself or you removed your pants to I peed right here. She told me no, but I I didn't know what Don Juan had going on. No, I'm I'm just I'm just curious. You peed with your clothes on? I'm telling you she told me no, but I I just peed like Okay, you're not answering my question. I'm bending Did you pee with your stuff on? With your clothes on? I tell her like pull it down a little bit because I I didn't know what she wanted me to do. So, you claim to be a medical assistant, which means that you routinely handle body fluids as a part of your clinical duties. So, what would make your decision logical to choose to mishandle your own body fluids and urinate on a patrol vehicle? I'm telling you she told me no, but I I just peed like Okay, you're not answering my question. I'm bending Did you pee with your stuff on? With your clothes on? I tell her like pull it down a little bit because I I didn't know what she wanted me to do. That was it. It wasn't nothing more, nothing less. I was right here at this club again. Did you have anything to drink tonight? I did. How much did you have to drink? I only had one cup. One cup of what? One cup of Ruffino Don Julio. How big is that cup? It was just like what they give you at the Bro, I haven't been to the club in years. Things are different. So, how big is that cup? Show me. Give me an example. It was like a little um Styrofoam cup. Not even Styrofoam, the plastic cup. And whatever they give you, I don't think they give you a lot, but And you said you only had one? Just one. What time is that? Probably 2 hours ago. What time is it now? Yeah, it was about 2 hours ago. Okay. And again, I was helping somebody move their car from over here in Empire to I'm going to the ends of America right here um military. >> so but right now we're looking at the vehicle that's in the wall. I understand. So, like whatever you did prior, okay, whatever. Look at that. Following somebody, taking somebody home, you're in the wall. So, um No, that's that's It's not in, baby. It's open. No, we're We're still in the meeting. I see. Oh. Yeah. Perfect. Um so, you can just take a picture of that. So, because of some things that we're looking at, alcohol, you peeing here, there's a I I asked I asked her first. Hold on, listen. Are you willing to submit to a roadside sobriety test? What am I supposed to do? I am, but I asked her first could I pee and she told me no. She did. But because >> to talk about peeing. >> I asked her did she want me to pee on myself or You must be completely wasted to formulate a question such as, "Hey, do you want me to pee over there or pee on myself?" I asked her did she want me to pee on myself or should I pee right here? That was it. Okay, so you're willing to do the test? It's a It's up to you. I'm not forcing you. It's It's up to you. Yes or no? Mhm. All right. So, I'm going to read you something. It's called a Terry warning. All right. These exercises are voluntary. However, if you refuse to complete the test I have requested of you, I will have to base my arrest They're going to base their arrest cuz they're the primary officer. So, you're under >> Bro, I work in a doctor's office, so I cannot go to work. >> Please listen. I have an opportunity so I'm reading you something. So, Okay, well, do the test. Do the test. We're not going to go back and forth. I don't want to, ma'am. But I still have to read to you. Can we do the test? You want to do the test? I don't care. I don't I don't I Listen, ma'am. I I Listen. Can I tell you something first? No, because I'm trying to talk and you keep interrupting me. You said no at first you didn't want to do the test, so I'm reading you something. You still have an option, but I need to finish reading this and you won't allow me to. So, let me start over. Listen. Take it in and you give me an answer again, okay? Okay. Starting over. This is called a Terry warning. These exercises are voluntary. However, if you refuse to complete the test I have requested of you, I or the primary officer will have to base their arrest decision on what they have seen and so far. So, the fact that there's a vehicle in the wall, there is a bottle of some Don Julio in the back, the pee If you asked her, whatever, pee. And I believe you said you smelled alcohol in your breath. Correct. Okay. And your refusal can be used as evidence against you in court. Do you want to submit to a the standardized field sobriety test? Yes or no? It is up to you. We're not forcing you to. Um can I speak now? Yes, ma'am. Okay, listen, ma'am. Can I tell you something? Again, I was helping somebody out. I was supposed to be going right here to military in Okeechobee. Ma'am, are you going to Okeechobee? Do the test, yes or no? You You You want me to listen to you, right? Yes. >> I understand what you're saying, but can I can I explain what I got to say, right? NO, I'M I'M NOT ALLOWED TO EXPLAIN WHAT I GOT TO SAY? YOU YOU ALREADY EXPLAINED THAT. WE'VE already You already explained that. We already heard that. No, I'm not I have not explained nothing. >> It's on camera. You have. Okay, listen, ma'am. >> want to do the test? Yes or no? I don't care. Whatever you want to do. I I don't want to go to jail because I got to go to work tomorrow. I work for a doctor's office. I don't want to go to work tomorrow. I mean, I don't want to go to jail tomorrow because I got to go to work. So, it's up to you. Do you want to do the test, yes or no, ma'am? >> I don't care, ma'am. It's either a yes or no. >> I just want to go home. >> All right, this is your last opportunity. I want to go home. Whatever you give me, I'll go home. All right. Put your hands behind your back. Behind my back? THANK YOU. YEAH, YOU. THE ONE SITTING ON THE COUCH EATING CHIPS. Get your butt up and take your nutty professor finger and hit the subscribe button so you can see VIDEOS ANALYZED BY THE PRIME analyzer like this. I want to go home. Okay, I will do the test. I will do the test. I will do the test. >> we're we're past that point. No, I I didn't know what was going on. >> that point. I already read it to you. We're past that point. I I just want to understand. Please, I got to go to work tomorrow. Please. I got three kids at home. I cannot I I want to do the test. I want to do the test. She didn't even GIVE ME A CHANCE. I want to do the test tomorrow. Please, ma'am. I don't I didn't know what you was asking me. Can I do the test, please? Please. If you could just give me the test right now. >> to go ahead and start the test I started already. I've never been in trouble in my life, like that's why I don't understand what you're saying to me. That's what I'm saying to you. It'll help you understand. Can you help me right now, like I already went over it. Ma'am, please help me. Ma'am. Listen, I I was really helping somebody else. Not a cop but she's a walking officer. [Music] Okay. So, the driver was initially charged with a DUI with property damage and as a result of a plea agreement, the charge was reduced to reckless driving. And for those in the medical field, just to let you know, a DUI conviction can impact employment in the medical field by raising concerns about an employee's judgment, trustworthiness, and safety. Also, on the legal side of things, it is common for DUI charges to be reduced to reckless driving, often called a wet reckless plea. Though the likelihood depends on the specifics of the case, this is a frequent outcome of plea bargaining, especially for the first-time offenders with a low blood alcohol content and no aggravating factors like an accident. Now, for all of you who like to take some sips when you go on trips, just remember that some of the worst body cam evidence a defendant can have against them in court is the defendant in a drunken sleep, their vehicle smashed into a wall, and being caught urinating on a police vehicle. Well, that concludes my analysis of this video, and I will catch you on the next one. Peace. If you haven't subscribed to the Prime Analyzer channel, you are missing out on great content.
