Why am I stepping out of the car? >> Because Pennsylvania versus Mims. It's a Supreme Court case in the state of Illinois. Okay. It's out of the Supreme Court. Okay. Supreme Court of this country. It's a police officer says you have to get out of the car. You have to get out of the car. >> I have a warrant. >> I'm asking you to get out of the car. >> I'm asking you. No, I need shoulder surgery. Y'all don't override medical. I have surgery at 3:00 in the morning. They have MRA. They have lab. I cannot miss this surgery. Thank you. >> Okay, so my feet are planted on the ground. >> Get out of the car. >> Get out of the car. What is wrong with you? >> Cuz I asked you nicely six times. >> No, you didn't. You didn't even bring my passport back. What is wrong with you to leave? >> I am telling you I have to go to Car McClean County in Bloomington. You have to call them. No, I'm not. I'm supervisor. Supervisor. >> You think that's how it works? >> No, I'm calling a supervisor because I'm going tell you, you don't want y'all do not It's a law. I'm a nurse. Y'all do not override medical. Y'all don't. >> Now, it would be a great idea for the cop to inform the driver specifically why he wants her to exit the vehicle. If the cop lets the driver know that he is going to place her under arrest or whatever the reason for the order is, followed by informing the driver that she will be able to receive medical attention, then that might settle the driver's anxiety and make everything a little smoother. The driver refusing a lawful order to get out of the vehicle during a traffic stop can lead to a resisting arrest or obstruction charge. If the driver believes that she is about to be arrested while heading to a scheduled surgery, she should immediately inform the officer of her medical situation in which she did. While police have the authority to arrest individuals regardless of their medical appointments, they also have a constitutional duty to ensure you receive necessary medical care. >> Supervisor. >> You think that's how it works? >> No, I'm calling a supervisor because I'm going tell you, you don't y'all do not It's a law. I'm a nurse. Y'all do not override medical. Y'all don't. Y'all don't. You don't. You literally went past me. You passed, you sped over me. You got in front of a black car, got in a turn lane, and got the back over >> cuz you committed a traffic violation. Your license plates expired. >> It don't You pass me up. You should have been put your lights on. Do you really think I would be driving a car with expired tags on it if I don't need if it's an emergency? >> You got You have expired tags. I know, but I'm saying if I didn't have if I didn't have a valid reason to be driving in a thunderstorm with no clothes on to go to Bloomington, they just had told me I have to come because of trying to beat the thunderstorm. Do you really think I'll be driving this car with a expired tag from October? >> No. >> For real? >> What does it matter? You're driving it? >> No, it doesn't matter because I don't have no family support to take me. >> Okay. >> My grandma is 73 years old. Her license is done for. >> Okay. Well, your license is good. >> So, why the are you pulling me over for expired tag? >> Because Because you have an expired tag. >> 100%. Yep. >> Okay. I expired tag. You're gonna get out of the car and then we're going to confirm to see if Caswell County actually wants you. It's for a traffic warrant, so it's not a big deal. Okay? It's a traffic warrant, but if we have to take you out of this car, I guarantee >> No, that's what you want. You want to bust my windows out. You want to do that's what you want to do. >> No, don't over my I keep telling y'all y'all want to see proof of my appointment. What is wrong with y'all? >> We will gladly have you No, no, no. Passenger side. >> Which which whiching truck? >> So that gives you the right to do whatever you want. >> Shut up. Shut up and stop pulling on my mother. >> Let's go. >> You can pull on the left or the right all you want. Don't pull in the left. >> You got a wonderful attitude, you know. >> I don't give a y'all mother start off. >> Double check for >> check. Hurry up and and call the ambulance. >> Let's double up. >> Don't touch me. >> Lock it. >> I'm going to double. >> Technically, y'all not supposed to put my hands behind my back because my shoulders up. Put these mothering cuffs in the front. >> Yes. >> No, it ain't happening right now. Although the suspect had a lot of mouth on her, she did deserve to be handcuffed in the front after making it known that her shoulder is dislocated and requires surgery. And that's because police officers should and often do make accommodations such as cuffing a suspect in the front or using two sets of handcuffs if the individual has a known or apparent medical condition like a shoulder injury. That would make behind the back cuffing painful or impossible. The standard procedure for handcuffing is with hands behind the back for officer safety reasons as it provides greater control and limits the suspect's mobility. However, department policies often include exceptions for suspects with physical disabilities or medical conditions like this suspect. When an officer is informed of an injury or observe an injury, they typically consider cuffing in the front, using two sets of handcuffs, or using a belly chain. >> Lock it. >> I'm a double. >> Technically, y'all not supposed to put my hands behind my back because my shoulders up. Put these mothering cuffs in the front. >> Yes. >> No, it ain't happening right now. >> Okay. Well, call the ambulance. >> We're going to fix your >> Call the ambulance. No, my [ __ ] alreadyed up and y'all stopping this stupid parking lot. >> Stop touching this arm. >> What the? >> It's called a blanket hold. It's a tactical arm. >> That's not how this works. >> My rotator cuff don't even stop. Stop mother touching my arm. >> Stop moving. >> You're under arrest. You got to touch your arm. >> No. My p my cuffs go to the front. What the is wrong with y'all? >> They don't go to the back. >> Yes. No. My go that far back. What the [ __ ] >> Two cuffs on you. >> No, this hurts. What is wrong with y'all? That's why I want a bro now for Carl. And >> bring this to the front. >> Y'all don't give a Y'all just want to mother, don't y'all. Stop. >> Stop resisting. >> Listen, listen, listen. If I tell you one more time, stop grabbing my mother arm. >> You need to put your hands behind your back. >> Put your hands behind your back. You need to put your hands behind your back. >> Put your hands behind your back. >> Y'all mother doing it. Ain't y'all >> It's not bending. >> I'm not going to bend this cuz it's not going to bend out of place. >> Y'all trying to pop my [ __ ] place on purpose. Call the ambulance. >> All right, we'll get to that in a second. Okay. All right, get in the car. >> Get in the car. >> Call the ambulance. >> Get in the car. >> I have the right to request medical attention. >> We are going to get to immediate now. Call the ambulance. >> Put your leg in. Okay. All right. Thank you. >> White ass. >> Oh, yeah. There you go. >> Hi, Sarge. Hey bud. >> I stopped her for expired tags and then she had an ad from the jump. I came back and ran her. She had a warrant and she refused to get out of the car. We boxed her in. We were talking to her, waiting for a couple more people to show up. Crew showed up and we told her she had a warrant. She didn't want to get out of the car. She hopped out. We put her handcuff. She resisted us and now she's coming for an ambulance. Hey, I'm >> That was a disingenuous way of informing the sergeant of what occurred because the cop did not mention to the sergeant that the suspect was complaining about an injured shoulder, which would make it challenging for the suspect to merely allow a cop to forcibly restrain the suspect behind the back without some sort of resistance, which I would deem a necessary resistance. with an intention to minimize her pain. >> Hi, Sarge. Hey, bud. >> I snapped her for expired tags and then she had an attitude from the jump. I came back and ran her and she had a warrant and she refused to get out of the car. We boxed her in. We were talking to her, waiting for a couple more people to show up. Crew showed up and we told her she had a warrant. She didn't want to get out of the car. She hopped out. We put her handcuff. She listed us and now she's screaming for an ambulance. I'm going to go down Carl. No. >> No. >> Nah. She's She wanted to go to USF. Um stopped her for expired tags. Didn't want to talk to me at the car. She had a warrant. Wanted to get her out of the car. know about her yet? >> No, I'm going to go fill them in. You want to get her out, Cody? You guys, she hates me, so just try to get her out and I'll go film. >> Hi. >> Can we have a conversation real quick? >> Yeah. >> Hi. How are you guys? >> Waiting on you cuz that's where we're going to go. >> My body cam's on, but she's uh combative with us. She just doesn't like the fact that she's going to jail. Um apparently I'm the worst guy ever. Um cuz I pulled her over. She's complaining of shoulder pain. She said she was going to the hospital to get a surgery, but she had a warrant. So, and then she resisted us. So, all she has to do is get cleared for jail. If the jail clearance clearance for you, that's all we need. She's going to yell and scream at you and call you mean word. Just so you know. >> No worries. >> All right. Thank you. >> I'll go get the >> We're going to come in this way. >> Hi, ma'am. My name's Cody with the sheriff's office. Okay. You going to be cool for me? Can you take these cuffs off my shoulders, please? >> Okay. If we put them up front, are you going to behave? >> I am 200 lb with no clothes on. It look like I'm going to run. >> I'm just asking a question, man. >> What? I'm going to swing on y'all. >> I'm asking. >> I can't even lift my arms. >> Just asking a question. >> Can you take these off my shoulders? >> Okay. Hop out for me, please. >> I'm a traveler. I'm not going to catch a case with y'all. That is my nursing license. >> You're a nurse? >> Yes. No. >> Yes. Don't you think? All right. Please. >> Golly. >> All right, let's go. >> Can you take this off my shoulders? I'm dead serious. >> Okay, hold on. >> I will let them I will let y'all see my mic chart. >> Let's go in here. I'm not worried about your mic chart. >> Okay, give me a second. Chill. >> Hi there. Hi, >> I'm Nicole. I'm one of the nurses. Come on in here with me. >> Are you okay if they go from here to here or she wants to be cooperative? But we couldn't even get her to calm down. You want to do that? Go ahead. >> Okay. >> Jesse was against on your >> hates me. >> I was supposed to check in tonight because I pushed it up yesterday. >> All right. What was your first name again? And can you please make sure he I get my passport from your fellow officer that drove me here? Okay. >> Please. >> We will talk about that. You can go stand up. I will move your cuffs up front >> for for you. Your cuffs can go up in front of you. >> Yes. Yes, they can. Turn this. >> Okay. >> I have a suspicious person call. You almost finished up. I think should be around that way. >> Yeah. >> Okay. >> And my $600 trunk better, my silver $600 trunk would better be in my trunk cuz I seen them pull it out. >> Uhhuh. >> And I do band for Illinois cuz I'm a band nerd. >> Okay. >> They better put that $600. >> Like Illinois State. You buy it? >> Which one? >> Yes. No, I'm alumni. But >> Okay. >> They better put that $600. ISU. ISU or you >> ISU. >> Okay. >> And also play for Bradley. They better put that trumpet back. >> Okay. >> Well, the best part about your situation, ma'am, is all these are running. It's all on video. So, if something's missing, you will have a case on your hands. >> Okay. You know, put your feet on those. All right. What count? >> The suspect was arrested and charged with resisting arrest. I do not agree that the suspect was resisting arrest while the police were in the process of handcuffing her. I believe that when the suspect was given a lawful order to exit the vehicle and the suspect chose not to do so is when resisting arrest came into effect. Now the suspect mentioned many times that she is a nurse and this arrest will be challenging for her career especially if the arrest turns into a conviction because a resisting arrest charge can hinder her nursing license. But it doesn't automatically disqualify her. It's evaluated case by case by the state's board of nursing based on the conviction, its relation to nursing duties, time passed, and her actions to address it with a focus on patient safety.
