And anyone can refuse the sobriety test. However, in her situation, there is more than enough probable cause to arrest her without the sobriety test. The suspect is stumbling, speech is slurred, and the suspect hit multiple cars according to the witnesses. And the suspect admitted to drinking. She is pretty much cooked and doing a sobriety test will only make her overdone. >> I am Wait, >> going over here? >> No, I'm not going nowhere. >> I never I never agreed to do nothing. You got to You got to >> You have to give me the opport I have to read this to you. Okay. >> All right. >> You need to listen to me. Okay. All right. >> Okay. What is your name? >> You have my my paperwork. No, >> the other has it. Okay. You have been I need to be >> You have been arrested for drug while intoxicated New Jersey state statute 39450. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of the breath samples including the test results will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood or urine for independent. >> If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. Absolutely not. >> A court may find you guilty of both refusal and driving home. >> I know my right. So, absolutely not. If the court finds you guilty of the refusal, you will be subject to various penalties, including license verification of up to 20 years, a fine of up to $2,000, installation of an ignition into law, and referral to an intoxicated driver resource center. >> Absolutely. >> These penalties may be in addition to penalties imposed by the court for any other offense in which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath sample. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath test. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples, I will charge you with refusal to submit to breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit the samples of your breath? >> Absolutely not. If your answer is not acceptable, the law requires you to submit samples of your breath for breath test. Put me down. I need to >> If you do not answer or answer with anything other than yes, I will charge you a refusal. Now I ask you again, will you submit to breath test? >> No. >> Okay. All right. As she is refusing, I will be deactivating right now. All right. This cop is being foolish and antagonistic by asking the suspect the same question while receiving the same answer of refusal from the suspect. Then the cop mentioned that the suspect's test refusal answer isn't acceptable. The cop is completely out of line. Yes, the suspect had a potty mouth. However, she didn't resist nor cause any physical challenges to the police. So allowing her to use the restroom would be a fair choice. The suspect's choice in refusing a blood alcohol test was actually a wise decision. It's a complex decision with pros and cons, but refusing a blood alcohol test may improve your chances of winning a DUI trial by removing scientific evidence while potentially leading to longer license suspensions and other penalties under implied consent laws. However, police can often seek a warrant to draw your blood. So, refusing doesn't guarantee you'll avoid a test. So, always consider consulting a lawyer as the wiser choice depends on your specific circumstances, your location's laws, and your criminal history. Well, this concludes my analysis of this video, and I'll catch you on the next one. Peace. >> If you haven't subscribed to the Prime Analyzer channel, you are missing out on great content.
