Are you able to walk over here? >> Yeah. In the >> Well, no. I just want to get on the sidewalk. Oh my god. All right. Talking to you. I'm getting some signs of impairment. Okay. Can I check your eyes real quick? Really? I want I'm I want to give you every chance to say that you're fine. Okay. >> So, can I check your eyes real quick? >> This is what we're going to do right now. >> Some law enforcement officers do believe they should not be stopped or ticketed for speeding and other traffic offenses. This expectation is rooted in an unwritten, deeply enriched culture known as professional courtesy. Under this unofficial practice, officers frequently extend leniency to fellow offduty or out of jurisdiction police caught committing minor traffic infractions, expecting the same treatment in return. This explains the distraught look on the offduty deputy's face because her expectations are not being met. >> This is what we're going to do right now. >> I I don't have a choice. >> You don't have a choice? >> No. >> And you pulled me over for going 10 miles over the speed limit. >> You were going more than 10 over the speed limit. And it's not just speed, it's also how you were driving. >> No, look, >> 10 miles over the speed limit. >> I'm not going to argue with you. I mean, unfortunately, we're past that. I want to give you every opportunity for you to show me that you're okay to drive. And I really hope that that's the results we get. Okay. But at this point, I can't just look the other way. That's where you're at right now? >> Yeah. Can I check your eyes real quick? >> This is how you're doing it. >> Really? >> Yeah. >> I don't have a choice. >> It's the same for anybody else. >> No. Yes, you do. I >> I can't treat anybody any differently. >> Yes, you would. >> No, I >> I wasn't in other people's lanes. >> Okay, I'm not going to argue about that other dash cam video and all of that. Okay, that we're past that point right now. The point is you were stopped. You're showing signs of impairment. I want >> No, I'm not showing. >> Okay. All right. I want to give you every opportunity to show that's not I want to ask. >> Uhhuh. >> What signs of impairment was I showing? You've got bloodshot, watery eyes, you have n I want to know. >> Okay. >> Pulling over. Pulling over. What was the signs of impairment? >> Because I do not have bloodshot and watery eyes because I have contact lenses in my eyes. I have contact lenses in. >> I'm not trying to argue with you. Okay. I want I'm hoping that you can show me that you're that you're okay to drive. Okay. But I have to go forward with this. I have to at least investigate. >> No, no. I just want to know. I explained to you you smell very strongly of alcohol. Your movements have been very slow and fumbling. You have a very ded facial expression. All these are signs of of impairment. Okay. Again, if you're good to drive, perfect. But that's I have to I have to investigate that. >> I am showing what exactly? >> You have bloodshot, watery eyes. You have slurred speech. You have a strong >> But I'm wearing contact lenses. >> Okay. You have a strong odor of alcohol coming from your breath. >> But I'm wearing I have >> Okay. All right. As I said, I'm just conducting investigation at this point. I want to give you every opportunity. You're saying that you're that you're fine. I want to give you every opportunity to show me that. >> There is no way in No way in >> Okay. Can I check your eyes real quick? Just make sure that you're okay. >> You're going to check it? No. >> Are you I want to give you some opportunity to participate in some field sobriety tests. Is that something you'd be willing to do? And if I wasn't willing to do that, >> look, I want you to get I want to give you every opportunity to show me that you're okay to drive. >> So, you're saying that if I'm not willing to do what you're telling me to? >> I'm saying I'm getting signs of impairment. >> Where? Where? >> I I explained it to you already. Okay. >> No. Say it again. >> I've explained it to you multiple times. >> You You said that, but it's not impairment. >> Okay. Well, if you if you tell me you're not impaired, that great. I want you to give me I want you after show me that I'm impaired. >> Okay. Can I check your eyes real quick? >> And then what after that? If you're going to check my eyes, what after that? >> It depends what I see in your eyes. >> Okay. So, it depends off what you're seeing my eyes. >> But after that, it doesn't mean anything. >> Well, it's just one step at a time. Right now, I just want to check your eyes. >> No, I don't I don't want to see in my eyes. I want to see after that. >> Okay. After it's it's it it's a building process. Okay. It's not a one test determines everything. test. >> Do you are you wearing contacts right now? You said >> I am wearing contact lenses and I cannot take them out. >> That's fine. You don't do you have blindness in either eye? >> I don't know. >> I mean, can you see the this light? >> Yeah. >> All I need to do is just stand with your feet together and arms down at your sides with your eyes. Careful. >> That is That's too fast. Too far away. Far. I can't see. >> You look all the way up. As far as your right, you got to go. Your eyes should go as far up as they can go. >> Can't see anything overnight. >> At this time, I give you the opportunity to participate in two more fields of gravity test. Is that something you'd be willing to do? >> You think that I'm impaired right now? >> After eyes. >> So again, there's two additional tests, the walking turn and the one leg stand. Is that >> I'll do all of the tests. >> Okay, perfect. Um, hang out with him. I'll be right back. Now, why is she doing this when I live right there? She doesn't care. He wants to people over. >> I'm pretty sure that's not what she wants to do. >> So, in the sense of being a deputy >> Mhm. >> with her doing this, what are what are your thoughts? >> What do you mean >> in in the fact of me acing this or not? It doesn't matter, right? >> No, I mean that's that's the point of this, right? If you're you don't show signs of impairment while you do it, it's better for you. That's why we give you that option. >> I'm still going to be perfect for this. >> There you go. >> All right. We're going to step over here and you want to come down to this end. Now, it's totally up to you, but I would suggest take your shoes off. Need help? All right. What I'm going to do is put your left foot in the line, other left. There might be two separate sobriety tests needed because the cop in charge of the sobriety test instructed the offduty deputy to put her left foot on the line. And then the onduty cop mentioned the other left foot, insinuating the offduty cop didn't clearly raise her left foot as she did. Improper instructions by a police officer during a field sobriety test can absolutely be challenged in court. Standardized field sobriety test rely heavily on strict administration protocols to be considered scientifically reliable. When a police officer deviates from these protocols, the validity of the entire test comes into question. As much as I believe the offduty cop is allegedly plastered, the onduty cop has compromised the test by failing to distinguish left from right herself. >> All right. What you do is put your left foot on the line. All right. What I want you to do is put your left foot in the line. Other left. And then you can put your right foot in front like this. Standing heel to toe. arms out your thighs. Yep. Just stay in that position. Don't move till I tell you to begin. Now, when I tell you to begin, you're going to take nine heel to toe steps down the line. Okay? It's going to look like this. 1 2 3 and so forth. End of the ninth step. You're going to keep your front foot planted. You're going to step off of your back foot. 1. 2 3 4 5 6 7 8 9 You're not 100,00 1,002 We're counting your feet. 1,003 1,004 1,005 1,006 100,00 having them in mind. Do you want to talk to me now? Sure. >> Okay. So, where are you coming from tonight? >> I am coming from downtown Sydney. >> Okay. What time do you get go downtown? >> I work downtown at about 700 p.m. >> Okay. Um, do you come from your place? >> Yeah, I live at Bugs Are Eating Me. >> Okay. Um, I put my shoes on. >> Yeah. So, in your downtown, where'd you go to downtown? Do you remember any um place where you can buy, >> you know, you know what I'm talking about? >> Do you remember what it's called? >> I don't remember. But you can buy a couple pieces. >> Okay. >> Where else did we go? Do you remember what a couple pieces of what you're saying? >> Like like pictures. >> Okay. >> For apartment complexes. >> Okay. >> But lamps. >> Yeah, lamps. No, we were just trying to piece furniture together. Um, what time is it right now? Without looking, if you had to guess. >> Uh, 12:00. >> Um, how much did you have to drink while you were down there? >> I didn't have anything to drink. >> Okay, here's the thing. We both know you've been drinking. Okay. By telling us complete lies, like I know that you're not me. Okay. So, I know you had something. Do you remember where you had drinks? How much did you have? Okay. >> So, why do you smell like alcohol? >> I do not smell like alcohol. Okay. >> I smell like pigment. >> That's not pigment. That's very strong alcohol. >> H Okay. And I mean, you're a deputy. You know about Okay. That's caused by alcohol. So, how much do you have to drink? Anybody? There anything you want from the car? cell phone or anything? >> Sure. >> What? Like just your cell phone? >> Do you have anything else you want? >> Um, my wallet. >> Where is that? >> It should be in the passenger seat. >> Just that just your wallet in your home. You have a weapon? They're having a verbal conversation about the apartment. According to a reliable source, the offduty deputy aka suspect was arrested and charged with DUI after submitting two breathalyzer test. The results indicated she had a blood alcohol level of.206 and.29 nearly three times the legal limit of 08. The offduty deputy was immediately terminated from the sheriff's office.
