Yeah, absolutely. What happened, guys? >> Nothing. This is my daughter. She's on her way home. >> Okay. What What happened? Why was there lots of yelling and stuff? >> They just had a little argument. So, I'm sending her home and that's my grandbaby in there. And then I'm going to have him take my car. >> Is that your daughter? >> That's your daughter? >> You You guys had the argument? >> Yeah, but we >> Okay, it's not a big deal. I >> I'm sending them home now. >> Okay. Anything got physical? >> No, we're good. >> Okay, >> sounds good. What are you guys yelling about? >> We got multiple calls. So, >> you got caught texting. >> They just got caught cheating. That's That's what it was. And it just escalated. >> All right. Hey, that's not a big deal. I'll just take your info, right? Quick statement. I'll get you guys on the way. >> Sounds good. Where'd you get the marks from? >> Huh? >> You got any marks on you? >> Not that I know. >> No. >> You see some? >> No, I don't see any. That's why I'm asking you. >> Yes, we're good. When police respond to a domestic dispute and observe visible marks or injuries, they typically follow a strict protocol designed to ensure immediate safety and preserve evidence. This protocol consists of immediate safety and medical care which involves separation and medical aid, mandatory or preferred arrest which involves probable cause, mandatory arrest laws and the primary aggressor. Evidence collection which involves photography and statements. legal protections which involve emergency protective orders and no contact orders. >> Right. Quick statement. I'll get you guys on the way. >> Sounds good. >> Where'd you get the marks from? >> Huh? >> This you got any marks on you? >> Not that I know of. >> No. >> You see some? >> No, I don't see any. That's why I'm asking you. >> We're good. Okay. >> Yep. We show up as in teams, right? >> We show up in teams. >> Can I have your ID? >> I don't have it. I got ID. >> Sounds good. This is like what you do. >> Now is your chance to grab a mouse or your finger and click the like button like you have never clicked it before. >> She didn't. >> She just You want to stay in the grass or you're not? >> She just like just take it too hard. Like I caught her. She didn't. You know how early cheat she didn't like. So I try to leave, not leave, but like I was trying to get my stuff so I can make her like so we can leave and stuff. But she not she wouldn't leave. She wouldn't leave. Boom. So >> you guys live here? >> No, we got a B&B here. So I can't I don't have no car. So I got to leave when she leave or leave when her mom. So I don't I don't have no car. She my transportation out here. So I was trying to leave when she leaves. She didn't want to leave. I just want to leave go home and be by myself and she don't have to be here. You know what I'm saying? But she >> Well, so what happened? >> Nothing. Like we just literally just arguing over it. Like she just scratched me. Just stuff like that. Just arguing over like nothing cuz she got caught cheating. She get mad. >> Were you physical with her at all? >> No, sir. I'm literally trying to move her away from me. You can ask her mother anything. I didn't touch her. Nothing. >> All right. >> Listen, you're not under arrest right now. I'm just going to read you your mander rights. That way you know. >> How old are you? >> I'm 18. >> You're 18. Okay. Like I said, I'm just getting a statement from you. That's all. All right. Just could you put the phone down so I can talk? >> Yeah. >> You have the right to remain silent. Anything you say can be used against you in court. together right at the time. How long have you guys been together? >> Since ninth grade. >> Since ninth grade. >> And that's the dear child that you guys have in common. >> Okay. >> Um, >> we had we had many occupations, but like >> not like not like your volume is still low. >> All right. So, you guys were here today. >> Yeah. >> All right. What happened? >> Literally. Okay. I woke up. I checked the time on her phone cuz my phone dead. >> Okay. >> And I see a dude text her. I just asked her. I'm like, "So, we cheating?" You know how girls get they get offensive like blah blah blah blah blah all this and this. Then I try to talk here like boom he'll just take me home cuz I have no transportation. I want to go home. >> Where's home at? >> We live in the same house. >> Where in Fort Myers? >> Generally a case qualifies by law as domestic if the parties are intimate partners, co-parents, household members or family members. Now that the cop has obtained knowledge that the two involved in this potential domestic v case are intimate partners and household members, the cop has established a qualifying relationship. And the cop knows that if any evidence or statements point to a physical altercation, the perceived primary aggressor will be arrested despite the victim's wishes of a no charge per Florida statue 741.29. Then I try to talk to her like boom, he'll just take me home cuz I have no transportation. I don't want to go home. >> Where's his home at? >> We live in the same house. >> Where? >> In Fort Myers. >> Okay. Why you guys have Airbnb here? >> Oh, because her mom birthday. >> Okay. We stay night couple night. >> Yeah. >> And then I woke up like, "Do you text anybody?" She like, "Yo." >> How did you see the text? >> Oh, cuz my phone's at. And I like I had to use her phone to see what time it was. >> You went through messages. >> No, I didn't. I just turned her phone on literally and then it said she was texting somebody. So boom. I'm like, "You take me home?" She like, "No." She getting mad. I keep asking her, "Can you take me home? Can you take me home?" She's like, "No, no, no." That's really what happened led up to it cuz I kept asking, "Can you take me home? I don't want to be here." They got no station. She brought me here and her mom. >> I have no other way home. So, I called my people. They couldn't come get me. So, I just I needed somebody to take me home. I didn't want to be here at all. >> Okay. So, what led up to that in front of my baby either. >> What led up to the physical aspect of everything? >> Cuz I cuz I wanted to go. I kept asking her, "Do you want Can you take me home? Just take me home. I don't want to be here." Cuz she obviously got caught telling me to do. I don't want to be here. So, I just want to go. I don't want to be here. And then >> she just got mad through the phone. >> She threw the phone or you threw the phone? >> She threw the phone. The phone is broken, sir. >> Okay. So, she she throws her phone. Were you guys inside or outside? >> She was inside. >> Inside. Yes. >> All right. So, you said you tried to like leave. >> She just Yeah, she just she was just grabbing me. Start just scratching me and stuff, but I was just trying to get her off. I didn't touch her. None of that. >> So, you're walking away. How did she grab me? Like, how? >> She just She just grabbed me like she like, "Don't call me on my name. Don't call me out my name." >> I'm like, "Bro, I just want to go home. I don't want to be here. I told you this." >> Okay. So, then how'd you end up with the scratches on your back and on your stomach? She I'm telling you she was just like grabbing me like I'm I I'm telling you I'm trying to push her off me cuz I don't want to touch a female. >> Were you walking away? Were you >> I was trying to I'm telling you I do not want to touch a female. >> Yeah. I'm asking these questions. I'm trying to be discouraged as possible just cuz I wasn't I just needed like crazy in front of my baby like >> Where was your child when this was happening? >> My child was in there her mother her mother was trying to control her too but >> it was just too much going on. >> So you're trying to walk away. She's grabbing you trying to force you. Her mother got a baby so she can't control her like >> and you're doing evasive maneuvers trying to get out out of it. >> What are you trying to do, sir? >> Okay. >> Did you hit her at all? >> No, sir. I did not hit her. >> How did she obtain those injuries? >> I don't know, sir. I'm trying to pull her off of me. So, like when I mean she's on me, she's on me. So, I'm trying to pull her off of me. I don't want I don't want these on me. I don't want that, sir. I'm trying to pull her off of me. Like, my baby's right here for that [ __ ] Like, >> yeah. Have you guys been physical in the past? >> Not like this. We did arguing, but we never been physical like this. I just wanted to go home. That's it, bro. >> Okay. >> All right. Um, >> she she get she get mad at words and I don't touch her. She get mad at words. I say cuz like you're cheating in front of my face. So I said something like it's not like you feel me? It's not physical. I'm just telling you like that's what it is. Like I can't. >> Okay. And um so when you're trying to leave that's how she got her injury. You're trying to push her off and push her away. That's the only That's the only reason why she got angry there because I'm trying to get off of her. >> Someone There was something that mentioned of her running outside. What made her run outside? >> She ran outside to throw my phone. She threw my phone. You can check the camera. She threw my phone outside. She ran. She We was in the house. She took my phone and threw it. >> Okay. And your phone's broken now? >> Yes. It's broken. I can't I was on the phone. My sister, my mom, I can't even get in contact. I'm just trying to get home. That's it. I'm trying to >> Why Why did she break the phone? >> Because she's mad. There was another reasoning. She got caught cheating. All right. Hey, you want to just talk to me? >> Yeah. >> Okay. Very good. You okay? Do you need EMS? >> No. >> Huh? You sure you don't want EMS? They come check you out. All right. So, the argument started about cheating. >> I guess you woke up and saw somebody on my phone. Would you both cheat? you know how they talk about. >> Um >> um I guess he I was already distancing myself from him cuz he already kept coming by saying slick stuff like after he found out I already told him in the message I even said I picked the blade. >> After that he just kept coming in and out making slick remarks and I'm just trying to ignore him. I'm I'm on the phone with my sister trying to ignore this man. So after that it just take place like he wanted he wanted to go home like he wanted me to drop him home. We already came out here for the Airbnb but he wanted me to take him home but I already said like we just woke up at 12:00. It's already hitting 1:00 where >> um Fort Myers. I said I don't feel like going home. >> Is that on your ID? >> Um it probably is probably Lehi cuz my ID is old but it should be Fort Myers. Okay. No. >> Okay. >> Um telling him I didn't want to go home. What's your address? >> So I come out the living room sitting there putting on my baby clothes cuz she just got to pull my mom. He's sitting on the couch. Mind you, he's drinking liquor already. >> You could tell bring the out the truth in people. He's drinking liquor cuz he can't smoke. So he had to do something else to cope his pain. I guess >> the cop might be laser focused on the potential domestic v investigation. However, there are other possible crimes that are at play here as well. The female subject just provided the cop with the statement that the 19-year-old male subject was allegedly consuming alcohol in the same residence that her mom, who is an adult, resides in. In the state of Florida, an adult can be arrested for allowing a 19-year-old to consume alcohol in their presence. Unlike some other states, Florida has no exception that allows minors to drink under parent or adult supervision, and adults can face criminal charges under several statues such as selling or giving alcohol to a minor, openhouse party law, and or contributing to the delinquency of a minor. In the state of Florida, the legal age for purchasing and possessing alcohol is 21. So, I am curious to see if the cop will even catch the alleged potential crime that this female subject has mentioned in her statement. >> I come out the living room sitting there putting on my baby clothes cuz she just got to pull my mom. He's sitting on the couch. Mind you, he's drinking liquor already. >> You could tell bring out the truth in people. He's drinking liquor cuz he can't smoke. So, he had to do something else to cope his pain, I guess. >> Okay. >> So, um he's sitting there. He was like, "That's why you taste like that. That's why you've been tasting so weird." Just basically like calling me out my names, calling me, saying I'm ran through, saying I'm that. Just making me feel bad about myself. So, of course, the words touched me and I threw my hand on him. >> So, my mom was trying to stop us, but I was still throwing my hands on him. So, he he didn't touch me at all. He was just trying to like jack me up, push me off of him, type, but he didn't put his hands on me. >> Okay. When you say push push you off of him, did you come on to him? Did I come on to him? Yeah. >> We was already like this. Like this. >> Oh, you don't have to do that. >> But that's how we was. So, I'm trying to give you the picture. >> Okay. >> So, we was like that. So, I already threw my punch, but he already he grabbed and pulled my braid on my head. My [ __ ] is scalped. I already know. >> Um, so that's when I was punching him cuz he pulled my braid on my head. So, of course, I'm going to throw a punch and I continue throwing punches at him. So, he has a knot on his head. So, that's when he just yanked me by my shirt and grabbed me like this. That's why my shirt is ripped. >> Okay. >> And then, yeah. That's when my mom put us in the car and it was just time to go home and then that's when you guys came. >> Okay. You obviously have marks all over you. >> Me, >> right? Yeah. >> You got any marks on you? >> Not that I know of. >> No. >> You see some? >> No, I don't see any. That's why I'm asking you. >> We're good. >> You got any marks on you? >> Not that I know of. >> No. >> You see some? >> No, I don't see any. That's why I'm asking you. >> Yes, we're good. >> You obviously have marks all over you. me, >> right? Yeah. >> So, does he? So, >> probably cuz my junk is like sensitive, but you could go ahead. Yeah. I mean, I don't want you pulling down your shirt too much, but you got a couple scratch marks there. If you could just hold that. >> Just give her water. >> Yeah. You have anything on your hands? Can Can you go ahead and put your hands together for me like this? Turn them around together. Okay. What you got on your legs? >> Just that. Well, >> this. >> Yeah. I don't know. >> How did you get that? >> I don't know. >> Can I get your other foot, please? You approached him and he started hitting you, swinging, or >> when I approached him, we was already arguing. I guess when I >> At what point did it get physical? >> When he just kept calling me out my name. >> He was saying that he was saying nasty stuff. people saying nasty stuff like it's very personal and probably bring somebody's >> gratitude down and me as a female >> you know I love been together for a long time and I told him like even her dad did stuff like that I don't like that as a female don't say stuff like that >> who's this >> oh that's my boyfriend >> okay >> he don't got another day he just >> No he just got here don't even know >> okay >> he hasn't even his first day yet Okay. >> So, >> so did did he just kind of piss you off and off until you came over and hit him? Where'd you hit him first? >> Um, his eye. >> Right in his eye. Right in the eye. >> You know him or not? >> That's when he pulled my braid out. It just got more cuz he pulled my braid out. >> After you hit him? >> Yeah. >> Okay. All right. >> Not going to lie, officer, I don't know if I do have anger problems, but I really tried my best cuz I'm trying to change for my daughter. But >> right, >> he already know what type of buttons to push, >> right? >> And I literally was trying to hold I I kicked I was trying to hold my >> I didn't mean to hit him. Like I have been together. >> We've been together 5 years >> since freshman. That's why you keep asking just like our policy, right? >> Because it's an investigation. >> All right. All right. >> In the state of Florida, all right, we have no choice but to prosecute for domestic violence. You guys been together 5 years. You have a child of common and you currently live together. Those are all the criteria that meets for domestic violence. Okay? Whether you choose to cooperate or not, right now we have no choice but to sit to to separate you guys from the situation. It's out here for now. >> The female suspect was arrested and charged with misdemeanor battery by intentional touch or strike and resisting without violence. A person can and frequently does receive a misdemeanor charge in a domestic v case. While domestic incidents are taken serious, they are not always prosecuted as felonies. The classification depends on the severity of the incident and the defendant's criminal history. However, if someone is convicted of domestic v at age 19, it can have immediate and lifelong collateral consequences that extend far beyond court-ordered fines or jail time. Because a person is just beginning their adult life, these barriers can significantly alter their trajectory in education, career, and basic civil rights. I am the prime analyzer.
