Welcome to the Prime Analyzer channel. This is what you can expect from this channel. An analysis of videos. That's correct. This is not a reactionary channel. You can expect great commentary and last but not least, [music] an education. Now, it's time to analyze this video. >> What's up, y'all? >> Bro, okay, we got sit at the restaurant. I say I'm going to pay for the food that I ate >> and then they pull they bring over a margarita and we didn't touch it. So I'll pay for the food we ate. I'm not paying for no margarita that we didn't touch. >> Okay. Did you get the manager involved or the manager? But he don't want to listen. >> He talking about she getting disrespectful. >> Yeah, I'm not getting disrespectful. >> The bartender the the waitress they just >> he not paying for it. So just listen paying for it. >> I'm coming up here to you. I say I'm going to pay for the food I ate, right? >> Yeah. >> And then he talking about >> you got to pay for the margarita. No, I don't have to pay for the margarita cuz I didn't touch it. >> I told her I told her that you have to pay for pay for the food that I ate cuz I already ate. >> That's how it works. That's not how it works. I don't care how much you order. Half of what you order. >> That's the manager. I don't know what he on, but I'm talking to you. He >> Give me I'll be over there in a second. >> Yeah. I'm talking to you. >> I'm paying for the food I ate, right? >> I'm not paying. >> So, you already you already paid? >> I already ate the food. He don't want to give me the ticket. He paid for anything? >> No, cuz he don't want to give me the ticket because I don't want to pay for the margarita that I didn't pay for. >> He don't want to give us the ticket. >> Yeah, he already told me. Look, look. Officer. Officer Hagen. She already told me she was going out here to smoke a cigarette. Her last cigarette. Look what I got. A black amount. I don't have no cigarette. I have a black amount because I have no cigarettes. >> I can pay for the food. >> We come out here. Last time we came here, we did the same thing. >> Just tell them to give me the ticket. I'm not paying for no margarita that I didn't drink. >> Paying for that. >> We did the same thing. >> So, just give me my ticket for the food I ate. >> I'm not paying for no margarita that I didn't drink. So just give me my ticket >> for the food. >> I'm not paying for no margarita. >> How are we going to drink a margarita, bro? For food. >> So they order food and they order drinks. >> And then they ate half of the tacos and then decided they didn't want the third taco and the margarita that they ordered. So they told the waitress, "We're not paying for it because we don't want it no more." But it's already on the table. Something that has already been made or or ordered that has to be paid for. >> Of course. And I >> Where's the uh where's the ticket at? Just go grab the ticket. See if I can get the car. We'll pay. Get the hell out of here. >> My thing is the way he's speaking. He's over here. I know where y'all work. Y keep theres. So like >> Yeah, I'll give him trespass to you. So >> Okay. >> You order it? >> No, she said she think she wanted it. I said I think I wanted it and then they bring it to >> like that's I mean it's >> this is exactly why I do not use the word think in the context of a final decision because saying I think can be subjectively perceived in certain conversations. For example, if I were to say to a dealership salesperson that I think I want this red car, the salesperson would most likely believe that my determination isn't final. However, if I were to mention to a waiter that I think I want this margarita, that could be interpreted by the waiter as if I have made a final decision. This is an example of when colloquial phrases may lead to misinterpretations. But where the customer went wrong is when she did not immediately inform the waiter that she did not order the margarita. The customer allowing the margarita to stay on the table for the duration of her consumption of the other food isn't a proper way of conducting business. And the customer should be charged for that drink. >> Did you order it? >> Ordered it? >> No, she said she thinks she wanted it. >> I said I think I wanted it and then they bring it to >> like I mean it's it's a bar right there. >> I'm not paying for you order. >> Come back over here, please. >> Hey, >> so my concern is just that what's coming out of their mouth now is not what they >> Man, you got your ID with you? >> Yep. >> Let me take a peek at it. Now is your chance to grab a mouse or your finger and click the like button like you have never clicked it before. >> It's not what they >> Ma'am, you got your ID with you? >> Yep. >> Let me take a peek at it. >> I'm not paying for [ __ ] that I didn't drink. That's point. But >> ma'am, you ordered it and you >> I don't care. I said I think you got your ID on you. >> You don't need my >> We do cuz you're involved in this. He calls a disturbance in here. Okay, but you're still involved. So, we need to please >> because you got to go in the report. >> I'm not paying for [ __ ] >> Well, if you don't pay for it, you're going to jail for theft services. Okay. >> No, I'm not going to jail for >> Okay, we'll find out about that. >> Yeah, we'll find out about it. Call your sergeant. >> I'm the sergeant. Give me your ID. >> Nope. I need a supervisor over you. >> He's He's not here, so I'm the best you got. >> I mean, >> yeah, you got your ID on you. >> Yeah, [snorts] but you got to let me check my own bag. >> I'm not checking your bag. I have to ask for your ID. Oh, I just don't like you walking up. >> I'm just trying to get up here. >> I'll give you my ID5 her >> since she says she ain't paying for nothing. >> No, I'm paying for the food that I ate. >> You going to pay for your ticket? >> Yeah, the ticket. That's what I told him. >> That's what I thought. Give him your ID. >> You have ID, sir? >> Anyways, you was the first one here. >> He's a sergeant, though. >> He's a sergeant. >> Yep. >> Got your ID on you? >> Yeah. Basically, you're causing disturbance. >> No disturbance. >> Do you have an ID? Yes or no? >> Yes. I just said yes. >> So, where is it? >> Obviously, it's in my bag and I >> Okay, so please go get it. >> Don't get scared for me. Grab my bag. >> If I'm telling you to get it, get it. >> All right. Scared. >> Okay. >> Don't care. Don't care. It's about It's about what you think in your head. Y'all making this really difficult for no reason. >> So I got to pay for >> over $40. >> Over $40 that I didn't >> that you ordered. >> No, cuz I said I think >> it's one thing if it's wrong or something like that. You ordered it. You >> I said I think that I'm >> your ID. I don't know what you think this is. >> I know where my freaking wallet is. >> I don't need no lights. >> Let me see. >> I don't need no light on what you think. >> I'm not [ __ ] bro. I'm not I'm not retired. >> Are y'all going to give me my >> So don't get retired with me. Here's my >> Rico that I'm paying for take it to go. So >> I'm not going to take it to go. >> You can't take it to go. So this is Doug though. >> All right. >> It's Douglas though. >> Yes. >> So you going to pay for it now? >> I already >> Looks like you ain't getting the margarita. So >> Well, I'm not paying for the margarita. I'm not paying for that. I didn't drink >> traffic, please. >> What's on the ticket? >> $43. >> Okay. She pays $43 and we're good. Go ahead. >> Right. >> Stop. You're being ridiculous. I can tell you that. >> I'm not. >> The best thing I can do is just sit here and let us get do what we got to do. Then you can go on your way. >> My girl, I followed her out here. Bro, the hell >> she came out here to smoke a cigarette. We don't walk out on no bills, bro. The logical way for this couple to appropriately handle this situation is to pay the entire tab to avoid a theft of services charge and take the matter up with the upper management of the establishment by phone later. And I say by phone because I'm sure that these two will be trespassed at some point. So, we're going to go settle up the bill, pay the $43. Settle up the bill and give him my up to y'all. >> Okay, let me talk to him. >> Look, listen. The first time I tried to talk to you, you got up, you grabbed your cigarette and you came outside. So then I spoke to him kindly. I told him to speak to you because I was not going to get in between it. >> And then you opened the door, you told him, "Get up or you not at him?" And he got up, grabbed his book back and y'all both dipped off. So that's when I said, "Matter of fact, I'm going to go ahead and just call the cops." I didn't want to in the beginning. In the beginning, I was trying to be nice to you guys, but you guys are being disrespectful. You don't want to pay for something that you order. So I don't want you in my establishment ever again. So please pay your bill and don't come back. >> It's that simple. >> No, I'm not paying for the margarita. I'm paying my food. >> Just came here to freaking enjoy the time with my girl. >> That's all. >> Guess y'all didn't enjoy your time. >> She just didn't want the margaritas. What the hell? What the hell can I do about it? >> I mean, I can freaking pay for it, but I mean, I'm just saying. >> They They want to You got an extra You got an extra freaking partner trying to get smart with me and [ __ ] >> You're being smart. You know how easy it is just, hey, sir, here's my >> Yeah, but I'm just I was just saying >> how easy that super easy, right? >> You're making it difficult. We're not making anything difficult. >> No, but I'm just saying, bro. You know, it's online, bro. You know it's online. >> People make the wrong move, bro. You know, sometimes [ __ ] happens, bro. I don't want to make the wrong move. >> That's all. >> I'll pay for the margarita. >> I will pay for it. >> Talking about we paying for the margarita that we didn't drink. >> Hey, don't curse out here. >> Damn. Don't curse. >> Why? Why can't we curse? >> No. I'mma give him the money. >> I'mma give him the money. >> Nope. We're going to jail. >> I'mma give him the money. >> Nope. We're going to jail. >> Oh, I'mma give him the money. Sir, >> we're going to jail. >> I'mma give him the money. You can back up. >> I'mma give him the money. >> Hold on. Stop this video. Subscribe with all notifications on to your number one analyst, the Prime Analyzer, and you can be one of the first to watch me analyze videos like these. >> No, I'mma give him the money. >> Put your bag down. >> I'm going to give him the money. >> Nope. We're going to jail. >> I'mma give him the money. >> Nope. We're going to jail. >> Oh, I'mma give him the money, sir. >> We're going to jail. >> I'mma give him the money. >> You can back up. >> I'mma give him the money. Go with her. >> No, I'mma give him the money. >> We're past that. >> Wait, hold on. >> I got the money. >> Can I talk to >> this? Can I talk to you dumb? >> This [ __ ] is Bro, >> can I talk to you? >> Give me your arm. >> Okay. >> No, you're not. >> Bro, your voice. >> Ow. Ow. >> You can let go of this stuff. >> Okay. >> Put that in that bag. I just said I for the freaking margarita. >> Quit moving. >> I'm out here, man. >> Just came out here to smoke a cigarette. >> All right. >> Ow. I got a bro. Ow. >> Bro, she got a freaking >> Ow. >> She got a fractured pelvis, bro. >> Cool. All right. Go ahead and take her to the car. All right. Let's go. >> Wait. Sergeant, >> walk to the car. >> Can I talk to you? >> Nope. We're done. You're going to jail. >> No. I paid the $43. >> We're not worried about paying. Walk. >> Can I just pay? >> Yeah. Please. >> Yes, you are. >> No, I'm not. >> Ma'am, either walk or we will help you walk. >> Thank you. >> This is not disorderly conduct. >> I'm not drunk. >> This is not disorderly conduct. You don't have to be >> uh grabbing grab two CT forms when you go down there, too. >> This is not disorderly conduct. >> Not disord. >> Let's go. >> Can you talk to me? >> Nope. We're past that. >> Please. >> Okay. >> Yep. >> Hold on. Can you please please please cuz my leg? >> Your leg? What? You've been walking fine. Are you going to pay for the meal? >> What? >> If if y'all let her out of hand. >> That's not how that works. Are you going to pay? Yes or no? >> If If >> No, bro. Y'all y You going to pay for the meal that y'all bought? Yes or no? >> Girlfriend, y'all are arresting. >> Are you going to pay? Yes or no? >> Cooperate. Cooperate with >> Are you going to pay? You guys are rushing the whole meal. Sir, >> the male subject could have been a rational thinker and deescalated this situation. While this situation was between the restaurant and the customer, the male subject could have took a leadership approach by using his $20 that he claims that he has and covered the margarita to merely eliminate the dispute, file a complaint with the business later and possibly the police would have never been involved. >> Have the money for the margarita. This is a date with my girlfriend. So, the ticket's 40. What? $43? >> Yes. >> You don't have You don't have $43? >> No, I only have $20 in my >> So, you can't pay for the meal you order. >> Oh, you guys are arresting the whole meal. >> Okay. >> You guys are arresting the whole meal, sir. You guys are arresting the whole meal. I just said I >> Why is she walking? Walk. >> Ma'am, go to the car. >> My [ __ ] >> So, now you can't walk. >> My hip hurts cuz I have a fractured hip. I will pay $43 and I will leave. >> Do you need medical attention? >> Yes, I will pay $33 and I will leave. >> That's not the question. But I know. >> Then you proceeded to mother and say this, that, and that out here, which we're not going to do. >> Sit down. You're hurt. Sit down. >> Yeah. >> If you're so hurt, you need to sit down. >> I wanted to show you that. >> I don't need to see anything. And then I told him, >> can can I take it all? Okay. >> Cuz I didn't want it right >> for $43, right? >> Okay. >> And then I mean I could pay $43. >> Yeah. Your boyfriend's doing it right now. >> Can you You're the sergeant, right? >> I am. >> Can you please Sergeant? >> Nope. Sit down. You're going to jail. >> Please, Sergeant. >> We're going to jail. It's unnecessary. >> Talking about a disorderly conduct, bro. It's It's not a disorderly conduct. >> It is. She was She was calling the scene. She tried to be nice to try to be nice to you about it and told you to go get the money and talk with her. And then the moment she opened the door and told you to get get up, you grabbed your bag and that's why I said I'll call the cops. >> I got up and come out here and talk to her. >> Everybody wants to >> I tried to be nice. >> Everybody wants to be So >> listen, man. Anytime you call a scene in this establishment anywhere, it's city ordinance. It's just, you know, disorderly conduct. If you start using vulgar language, cussing people out and you're yelling, everybody can hear you. It's conduct. City ordinance. Go to jail. >> There's a difference. We're all adults. We got to act like adults. >> Sergeant, I was going to pay for it. >> That's fine. I'm not worried about you paying for it. >> Sit down. You're If you're so hurt, you need to sit down. >> Now, even though the suspect's language is unnecessary and foolish. I do not find her actions to be disorderly conduct. Yelling and using profanity in public can be disorderly conduct, but it depends heavily on the context, your location, and if it crosses the line from annoying to truly disruptive, threatening, or provoking immediate violence. The suspect is merely using some profanity, and that is a constitutionally protected act. >> Sit down. You're If you're so hurt, you need to sit down. >> I'm trying to tell you something. >> No, sit down. I have Don't you have kids? >> I do. Sit down. >> I have three. >> Okay. Well, you shouldn't be out here acting a fool then. >> I'm not. Can you listen? Please. >> Okay. >> Can you listen, >> Sergeant? >> Yes, ma'am. >> Listen, please. Sergeant, >> what is there to listen about? >> Can you listen? Cuz I'm paying the $43. I don't want >> You're not going to jail for theft of services. You're going to jail for disorderly conduct. >> Disorderly conduct. I'm not a surgeon. Please. Yes, ma'am. >> I'm not. I'm not. >> 3:44 25 the transport. >> I'm not sit down. >> Either you sit here or you sit in the police car. >> Sergeant, >> what's your name? >> My name is Sergeant Bergos. >> Sergeant Bergos. >> Yes, ma'am. >> Sergeant Bros. You just >> She's tied up with 226 at this moment. >> That's fine. Sergeant B. Sergeant Ball on Road with movement. No signs of distress. >> Sergeant, >> just hang it up and call it back. If they're code for, you can close it out. >> Sergeant Burga. >> Sergeant Burgos. >> Burgos. Yes, ma'am. >> Okay. I was coming up here, right? I >> You told me your story already, dear. I know. >> I came up here to eat >> and then I said I was talking to them. I said, "Do I have to pay for the margarita if I don't drink it?" >> And they said, "You have to pay for it because you already ordered it." And then I said, "I think >> I said I think >> that I want it." >> That [ __ ] is so good, bro. >> I agree. I agree with you. >> Obviously, you think I want it. >> My god. You think you think I want to do this? I don't want to do this. It could have been so much simpler. You pay for what you order. You pay for what you order. Oh my god. I tried to tell you to speak to her because she was she was acting >> sitting there talking to me. I was still sitting there trying to eat my taco and you were like, "Matter of fact, I'm still going to call the cops." >> The moment she told you to get up, >> she didn't never tell me to get up. No, she didn't. I was sitting there talking to you the whole time. >> Okay. All right. >> I was talking to you the whole time. >> Okay. >> She didn't even tell me to get up. >> That's why you told me not to follow you to your car, right? >> No, I just said don't I just said don't follow me. I'm going to go talk to her. Calm her down. >> All right. That's fine, man. Like I said, I try to be nice. Stop, bro. >> I I don't care, dude. It's an establishment. You got to pay for what you ordered. >> You got to pay for what you ordered. It's just that simple. >> But then you got to look at from their house, man. When you get up and you start walking out of the business, they don't know you're going to go smoke a cigarette. They think you're walking on the bill. >> I don't know if we pay for the bill. We pay Do we pay for it at the table or do we pay for it at the counter? >> You pay for it at the table. It's not your first time here, man. I >> Yeah, this is my second time here. >> Yeah, I saw you last week. >> I paid for it at the counter last time. I sat here. >> You don't pay at the counter. You pay with your wages. >> I know, but I sat out here and drunk my margarita last time. Yeah, but last time you didn't you didn't do this. You didn't cause a scene. >> Really? It wasn't you. It was It wasn't you until she walked out and then it started being >> You told me she was going to walk out and smoke a cigarette. I said, "Wait on me to finish my taco first." >> You started walking out here and said, "Don't follow me." And then started saying all this crazy stuff about aggressive. Y'all was trying to get aggressive. >> Nobody got aggressive. Y'all was on the phone. >> No, I'm talking about you, bro. >> It was you, my guy. You're just acting different now because the cops are here. >> Yes, sir. >> So, I can pay the 43. >> You are. That's what your boyfriend's doing right now. >> I'm just saying. >> I'm not worried about you paying. The paying part's done with. >> Sergeant, I'm sit down. You got kids, right? >> You need to sit down. Yes, ma'am. I do. >> You got kids, right? >> I do. You got a fivemon old and a and a threemon old and a four and a foury old. >> Nope. My baby's a year and a half old. >> I do. And I'm just telling you, I don't want this. I just >> Okay. >> I don't want this. I just I can I told him that I was >> Sorry. >> Yes, sir. >> I just told you pay the bill. >> That's great. >> I'm talking to him. Need >> That's great that the bill's paid. So, you're So, we're not going to jail for the services. That's awesome. >> Oh, thank you. Come on, man. >> Thank you, >> bro. We didn't We didn't know, bro. Come on. We didn't know that cussing in in public was a disorderly conduct, bro. >> It's pretty common sense. >> It's not just cussing. It's >> cussing people out and yelling and just causing a disturbance, >> bro. Look, >> instead of being adults about everything, >> bro. Come on, bro. I just had a kid with her, bro. >> Congratulations. That's >> Oh, bro. But I'm saying, bro, I'm trying to get We're trying to We're working on getting them back, bro. >> Okay. Well, we're done. We're where we are. Okay. >> Bail her out from the Douglas Police Department for >> Yeah. >> Y both getting crimly trespass from retail. I can't come here. Okay. Can't come back here ever again. >> I don't care about that. >> That food was good. I'll never come here again. It's other Mexican restaurants. >> There's about 10 different ones. >> Okay. Anyways, >> this is just Bro, we were just trying to talk. >> You should just told us no profanity. >> I told you. We told you multiple times. >> No, you should have said or disorderly conduct. You should have told us, >> man. I literally just told you to lower your voice and start cursing and stuff where y'all got to go jump for disoly conduct and cussing. No, you did. You're fine. You're not in cuffs, are you? >> Okay. >> Well, she was going over there was I don't mind. >> I mean, you were having a one-on-one. >> I'm just saying >> it's a ticket, man. So, she's basically she'll go to the police department, get booked in for disy conduct. You'll be able to get her bonded out, >> bro. Call my business, bro. >> I'm [snorts] quiet with that. >> How do I get locked up for some? What did I do? >> Exactly what you're doing right now. >> I'm not doing nothing. >> You sign these real quick. No injuries. They aren't blocking the roadway. I'll get you in a second. >> You can It's probably recorded on the phone call, but he was just saying all crazy stuff like I don't know. But he was saying that he knows where we work and just just crazy stuff, man. >> Well, he has a CT now. So, if he shows back up, he goes to jail. It really started with her and he was being calm and I tried to get him to talk to her. >> Then the moment she told him to get up, >> that's why I was like, I'll just call the cops and then if you guys can't figure it out. >> Yeah, it's absurd. Over what? $10 margarita. There's one more on that one. I'll bring you back your copy when I sign it. >> You need to sit down. >> My leg is numb. Yeah, >> I'm not talking to you. >> I'm not talking to you. >> That's what happens when she >> I don't care. I'm not talking to you. >> I don't care. >> You can actually do yourself a favor and go on that side over there. >> Just go over there, Neato. >> Go over there. >> Neato, go over there like he said. >> Talk to him over there, please. >> Go over there. >> Thank you. >> Not down. making everything worse than what it is. >> Answer the phone. >> Making everything worse than what it is. >> Can you pull my shirt up? I haven't even drunk. >> Just cuz you're claiming you're not drunk doesn't have anything to do with you being disorderly. >> I'm not I'm not even drunk. Nothing. >> Okay, that's >> I'm not paying for [ __ ] Well, if you don't pay for it, you're going to jail for the services. Okay. >> No, I'm not going to jail for >> Okay, we'll find out about that. >> Yeah, we'll find out about it. >> It was at this moment when the suspect challenged the cop regarding not going to jail if she didn't pay, which in my belief accelerated the cop to want to arrest her for something. The cop didn't charge the suspect with theft of services and disorderly conduct. The way that the law is written doesn't match a theft of service charge, although I believe the suspect should be only charged with theft of services. And in the wrap-up, at the end of the video, I will elaborate on how and why I came up with this determination. >> So, you're going to jail for disorderly conduct under the city code? >> Um, you can't come back here. >> I'm not even drunk, sir. I haven't even drunk. >> Just because you're claiming you're not drunk doesn't have anything to do with you being disloyal. >> I'm not I'm not even drunk. I got Hey, I got >> I know, but I'm still trying to [ __ ] you because >> talk to them or they're leaving and you're going in that police car. >> What do you mean y'all just pulling on me when I got a fractured hip? >> Okay, talk to those two people. >> What's going on tonight? >> Bro, they over here goddamn >> I don't care what's going on with them. Down past the quick trip. >> 258. Bro, you know how I stand here trying to talk to you, right? >> Go ahead. >> 1091 to the PD. Try them out. 440. >> You heard me. >> What was that? >> You said you trying to talk to you, right? >> Yeah. But this >> I wasn't pay like I did not touch the at all. You can go back. They can do the cameras and everything, bro. I did not touch it at all. Only thing I touched is a >> So, the suspect was arrested and charged with disorderly conduct. I do not agree with the suspect's charges because the suspect's actions doesn't fit the definitions of the charge. In Douglasville, Georgia, disorderly conduct laws are enforced under both Georgia state law and the specific ordinances of Douglas County, Douglasville, which generally align with the state code, but can have some local variations. In Douglasville, a person can be charged with disorderly conduct for various actions, including acting violently or tumultously towards another person, causing fear for their safety or property. This element doesn't fit the suspect, using fighting words that are likely to provoke a violent reaction or breach of peace. This element doesn't fit the suspect. Using obscene or profane language to or in the presence of someone under the age of 14 that threatens a breach of peace. This element doesn't fit the suspect, creating loud noises that disturb public peace. This element is constitutionally protected depending on time, place, and manner. This element doesn't fit the suspect. Disrupting activities at places like houses of worship or hospitals. This element doesn't fit the suspect. Now, after thoroughly reading the theft of service charge definitions in the state of Georgia, even that charge doesn't quite fit the suspect's circumstances either. In order for theft of services to apply, deception and intent are the two main elements that must be present in this particular circumstance. The state must prove you used trickery or had the intent to avoid payment from the start. And those two main elements, deception and intent, do not exist in this particular case. The suspect clearly didn't intend to leave the restaurant. And the suspect clearly made it known that it was the margarita, one item on the tab that she did not believe that she was responsible for paying. The suspect's failure to immediately with the key word being immediately inform the waiter that she didn't order the margarita would have solved the issue without any further problems. Because a person that intends to steal food or dine and dash will not deliberately leave an item uneaten and complain about not wanting the item. That is illogical to believe and that does not fit the characteristics of a dying and dasher nor theft of services. However, once the suspect was given the tab to pay and then the police came and the suspect was given many warnings to pay the entire bill and the suspect refused multiple times, that would constitute a theft of service charge at that particular moment.
