I appreciate you. >> Grabbing a police officer's arm can be considered resisting an officer and potentially lead to charges of assault or battery on a law enforcement officer. depending on the jurisdiction and specific circumstances. The key factor is that any action that a reasonable officer perceives as physical interference, obstruction, or an attempt to prevent them from performing their official duties can form the basis for a resisting charge. >> Understand that. Stop. You are a police officer. I appreciate you doing this. >> You're going to be detained at the moment. If you resist, that's a THAT IS A VIOLATION. >> RESISTING IDENTITY. That is my husband. We are married. We're arguing. >> Okay. You know what that's considered? Do you know what that's considered? >> The most violent. Okay, then. SO, I'M DOING MY JOB IN >> MY FACE. >> Not every heated exchange or argument qualifies as a domestic v charge. However, there are situations where an argument crosses the line into domestic v. Usually, this occurs when force enters the picture. It appears that no force was used in this situation. So, the suspect and the cop are wrong. However, the cops can pursue an investigation [clears throat] to make certain that this was not a domestic V. But to jump to conclusions and consider this as a domestic V based on a heated exchange is improper. >> Arguing that is my husband. We are married. We're arguing. >> Okay, good. You know what that's considered? Do you know what that's considered? >> Domestic violence. >> Okay, then. SO, I'M DOING MY JOB IN >> MY FACE >> CUZ YOU'RE NOT LISTENING. >> I have ears and I am listening to you and I appreciate I I so appreciate >> Stop talking. Professional standards in policing are high ethical, behavioral, and performance benchmarks police officers must meet, covering integrity, respect, fair treatment, and competence enforced through codes of ethics, training, and internal oversight to ensure public trust and uphold the law. This cop should not be in this line of work because he allows himself to react and become emotional based on the way others behave and that is unacceptable. >> So you so you have family members in law enforcement. I have four minutes. >> I cannot believe this. I cannot How far away is this from? Like, how far of an Uber is this going to be back? >> Keep it real. >> On that, I'm not sure. >> I want to press charges on. I I did not I did not disobey arrest. Nothing. I'm I'm going to I'm about to go to the academy next month. This is going to [ __ ] me up, man. I'm not allowed to get drunk on my honeymoon. >> The drunkness wasn't the problem. >> It No, it was because she was pushing me. I didn't do anything. I'm not the victim. My husband's drunk. I'm trying to get him in the hotel. Do not put your hands on me. I understand you're a police officer, but I went to school for this, too. You are not allowed to put your hands on me. You have no um there's no legal reason to do it. >> Well, >> you are very respectful and so is he. >> I'm going just explain the reason why >> she knows. You don't know what happened. And there's no >> And I get that he's up. I just want to get him in the hotel. >> The problem is, right, you guys are having this altercation in public, right? In an open setting and it's domestic. At which point, let me put this state of Florida, right? Different from New York cuz I know we deal with I deal with a lot of New York. >> I'm from New York, so you know, I know how that works. And like I said, I'm I'm about to go to the academy. I went to school for all this. >> I know. But New York is different from Florida. >> I go to the academy in a month. >> I know. But the uh So the the the laws are not the same for Florida than New York, right? I don't know how New York >> is a lot different. We would have been in our house right now. This would have been an appearance. >> Said New York has a lot more leniency in regards to certain things. Florida does not. They use domestic violence as a severity. >> But his hands did not touch me. >> Yeah. But listen, so once that happens and we realize it's domestic, we're now in charge of of a criminal investigation. any point in time during a criminal investigation when an officer is telling you to calm down, relax, and they're going to >> But the thing is, she was telling me to calm down, but she was screaming at me and being very disrespectful. And I know she's not allowed to put her hands on me. >> So, actually, she is allowed. >> She's not I I went to school for this. >> She's telling you, >> so New York law must be different >> during a criminal investigation. >> She just wants um brownie points and she must have a quota. >> You're not listening to what happened. >> It's true, though. I got four kids. Like come on, man. I didn't do nothing. My husband's a drunk [ __ ] He did what he did. I was trying to get him in the hotel. Why am I getting detained? Do you feel me? I I I know I know the rules. At least in New York. I know Florida is obviously super different. Every state, I'm assuming, is way different, but I I you know, like I I didn't do nothing. Why am I getting detained? Why am I going to jail? Is that the guy that was nice to me? >> Let's uh He's right here. Can I talk to him real quick? Can you roll my window? >> Not. She wants to talk to Matthew. >> I got the meanest wedgie and I can't even reach it. >> I understand. I I'm not trying to be like get out of my cuffs, but they're literally falling off my arm. They just came off. >> She took off her cuffs. I didn't take them off. They fell off. >> I swear to God, I didn't take them off. >> And just turn around for me. Let me get these on you again. I can't >> I just I don't understand why. I don't get it. I don't get it. I do not understand. >> All right, I'm going to go ahead and help them out. >> The faster I'll be right here. We can try the >> I want to go home. >> Hold on. >> Just do >> I don't understand. >> I'll send you a >> I'm not trying to >> I mean maybe. I don't know. >> Can we go? Cuz I want to get this over with. I'm so tired. [crying] >> [crying] >> I don't want I'm going to go home. >> First, are you banging? >> Yeah. Can we just go and get it over with? Man, >> that's what he's doing. He's got to write the report first. >> I need to call I need to call my mom. I need to talk to my kids. >> Yeah, they'll give you a phone call. >> No, like listen, man. You Excuse me. >> I'm I'm not trying to be funny, but it it's >> My wrists are small. I'm tiny. For your safety, girl. >> Yeah. >> Come on. I didn't have to say nothing and I did. So that's me being nice to the right cuz I got to take to the right. >> Stay roll this thing. Hold on. >> Come on. >> My arm was grab my arm right there. >> Thank you. >> All righty. Hang tight. Come on. The suspect was arrested and charged with resisting arrest without violence. Mommy's little girl wasn't charged with any domestic v charges simply because verbally arguing with your spouse typically isn't a crime. A resisting arrest charge, especially with a conviction, can absolutely disqualify you from being a police officer, as it shows a disrespect for law and authority. Though the outcome depends on the severity, misdemeanor verse felony, recency, circumstances, and your overall background with lying about it being an automatic disqualifier. Agencies look for honesty, good character, and no serious criminal history. So, a resisting charge needs careful disclosure and explanation during the extensive background check. Which means it is safe to say that it is never a wise idea to end up being arrested, especially if you are almost a cop.
