Our GM came to the window and he even said, >> "I he just told him his photo trying to cash him out, get him out the way." So, he pulls up then he come inside talk about I'll beat y'all costing where the [ __ ] at. D we all looking like this is Wendy's. her mad calling the store broke all that. He comes to the door. He like I know you. Mariah, I know you. First of all, Mariah is my sister. She look like me, but that's not me. I'm I don't know what beef y'all got. They got to do with me. So, I came to the door and I'm just like, I'm not Mariah. I don't know what y'all got going about. You come up to this uh car, I'm I'mma shoot you. I'm shoot you. Waving a gun in my face. So, I go in and close the door and I call my sister. I'm like, do you know this man? He's literally waving a gun in my face. in the parking lot. >> D. If the male suspect truly waved the firearm like the female suspect is claiming, then he has committed a crime called aggravated menacing, which is a charge for those who think that they are avoiding a charge because they didn't specifically point the firearm at another person. Displaying a firearm, even without pointing the firearm at someone with the intent to cause another person to believe they will cause serious physical harm to that person, is still a crime. Now, the female victim mentioned that the male suspect waved the firearm in her face and instead of contacting the police immediately, she contacted her sister to confirm if the suspect and her sister truly knew of one another. It is foolish of the victim to choose to prioritize, calling her sister over the imminent threat that was actively occurring. So, I go in and close the door and I call my sister. I'm like, "Do you know this man? He's literally waving a gun in my hand in the parking lot." >> He was right here. Right here. The cop is trying his best to extract information from the female suspect and get her to admit that her boyfriend, the male suspect, displayed his firearm. Under Ohio law, a firearm is considered concealed if it is not in plain sight or is hidden in a manner where ordinary observation would not reveal its presence, even if only partially covered. Ohio has some specific and some might say tricky ways of legally defining how to carry a firearm in a vehicle. Ohio has less flexibility for long guns. However, I will only focus on the handguns because it relates to the suspect's situation. In Ohio, you can generally have a loaded handgun in your vehicle without a permit due to its constitutional carry status, but it must be accessible and not concealed if you lack a license. And you cannot have it loaded and accessible if you have no permit and are transporting it unloaded in a case. So, it's tricky. You must understand the distinction between concealed and open carry rules in a vehicle because it's legal but with many caveats. >> If he says the gun isn't his, you're in command and control of the car. Now, unless the male suspect has untreated cataracts that have led to severe vision impairment or total loss, I just cannot fully grasp how he could confuse these two females. I mean, one looks like a female version of Andre the Giant, and the other is nearly half her size. Now, it bears repeating, especially since the female victim continues to mention that idiotic statement. It is completely foolish to contact your sister with the intent of having a conversation based on the recognition of a suspect who is currently threatening you and waving a firearm in your presence. It's almost as if the female victim cares more about her sister's knowledge of the male suspect than her own safety. >> But I never apologize. When he seen go, he stopped the car right there and got out and started walking inside. She dropped she hopped in the driver's seat and then she tried to pull off. You do it for justice. >> You know, we have the male suspect was arrested and charged with aggravated menacing and being a felon in possession of a firearm. And his girlfriend, the female suspect, was released from custody after questioning. In the state of Ohio, a person with a prior felony conviction found in possession of a firearm faces a thirdderee felony charge which carries severe penalties. The separate charge of aggravated menacing is generally a firstdegree misdemeanor but can be elevated to a felony under certain circumstances. I suggest that the female victim reconsider her priorities and contact the police first if she ever is involved in a future incident like this. And if the male suspect is found guilty, I recommend that the female suspect leave her boyfriend if he operated as suspected because that is the behavior of someone who is an emotional wreck. The female suspect thought everyone other than her boyfriend in the situation was doing too much, as she stated, which is either denial or delusion. I am the prime analyzer.
