I pulled this over for no reason. >> No, I didn't. >> For what? >> Your headlights out. >> My head. >> This traffic stop was improperly performed and the police did not have any probable cause to search the driver's vehicle. Because if the cop didn't put his lights on to initiate a traffic stop, as this cop just admitted, then this traffic stop would never be legally considered fleeing and eluding. So, this cop is being deceitful. Furthermore, a cop is legally required to have a primary charge for a traffic stop to be legally valid and probable cause to search the vehicle. So, if the cop claims that the driver's headlights being out was the primary reason for the traffic stop and the driver didn't flee, then the cop doesn't have a probable cause to search the vehicle to find the weed that he claims the driver is going to jail for. The marijuana would be a secondary charge in this particular traffic stop, but the police never have claimed to have smelled the marijuana as a legal reason to search the vehicle. But what did happen is the cops performed an illegal search of the vehicle and never asked for permission to search the vehicle and put the subjects in an illegal detainment to carry out an illegal search. >> Lucky I don't get you for swing looting. >> Yeah. >> I know you are cuz I have my sirens on. >> You're lucky you're not. And attorneys fight for suppression of evidence and fruit of the poisonous tree, which can also result in a case dismissal because of lack of probable cause and or consent to search the vehicle. Yes, there are illegal items inside of the vehicle. However, there is a certain legal process necessary for those items to be admissible in a court of law. Also, the driver is making a brilliant decision by not speaking to the police, especially after being mirandized. >> You read me my rights. Need your shoelaces or your shoes? >> So, the male suspect was arrested and charged with narcotics violations, narcotics equipment violations, and driving with a suspended license with knowledge. And the female suspect was arrested and charged with criminal traffic offenses and possession of marijuana. In many cases, especially traffic stops, police must have a primary charge, a specific valid reason for the stop to issue a citation. A secondary charge is an offense that can only be cited after the driver has been pulled over after the primary violation. For example, an officer can't legally stop a vehicle for a secondary offense, like a seat belt violation alone. However, if they stop the vehicle for a primary offense like speeding, they can issue a ticket for both the speeding and the seat belt violation. Now, it was absolutely cringeworthy watching that female officer opened the door of the K-9 vehicle with the intention of the suspect sitting inside. It was incompetence at its finest and could have resulted in the K-9 dog accidentally biting the suspect. I mean, for the cop to believe that it is a wise idea for the suspect to sit with the K-9 in back shows another level of foolishness. Also, a good attorney would eat this case up and the suspect would be wise to have hired one. Now people, if you are out there trapping in your vehicle, make sure that you do not violate any traffic laws to lower the possibilities of being involved in a traffic stop.
