This video that we are about to analyze was obtained by a non-affiliated channel called the on patrol body cam channel. Put your hands behind your back. Oh, I work at freeze. No. Stop. Put your hand behind your back. This woman was clocked doing 78 in a 55 in a decked out Jeep along a stretch of I75 in Baldwin County, Georgia. What began as a simple speeding stop quickly shifted gears. [Applause] for class A. No, [Applause] you good. Reason I stopped you. 78 55. 20 mph over the speed limit in nearly every state in America is an arrestable traffic offense alone. These speeding charges can result in large penalties and fines. I have a deputy that says otherwise. You want a radar check? Yeah, cuz in front of me right in front of me 93 radar check. You think you just lit it? I said how that if the car is in front of me right now. I think he told me I need to do one of that. That's cuz he got you. He know he ain't got me now. Everybody right in front of me. Everybody going 78. Driving with the flow of traffic isn't a successful defense against speeding. Nor does this excuse excessive speeding charges. He's running his radar. He's going to do accurate check for me. You have driver license. Accuracy check. So where 49? You didn't see it when you pass by? Yeah, I saw I know I was going on SA. Okay. You might didn't know I was coming for you when I turned around. Why don't I got you? All right, I'll be back. Don't do what? And why not? Come back. I'll be back. Heat. Heat. [Applause] All right. Cuz you told me a citation. What is it? You was speeding doing 78 and a 55. Is it your first ticket? Yeah. Why you lying? I ain't lying. Okay. You looked away when you lied. I'm lying. You forgot. All right. So, I was going to give you a warning, but you told me I better not come back. There is an extremely low possibility that the officer would have given this driver a warning. Warnings for driving over 20 mph are typically frowned upon by the departments of all officers as these speeds contribute to deadly collisions. I don't like first of all I was You don't know what I would do. I've been giving people warnings all day. Well, you told me I better not do something. So, sign here and then sign on the next one. I don't want to sign my No, you have to sign. No. sign. I don't think I'm going to say that. I don't want to sign. Signing a traffic citation isn't an admission to guilt. Simply signing a traffic citation only is perceived by the government as the individual signing, acknowledging, and agreeing to be in attendance at the court date scheduled. However, not signing a traffic citation can lead to an arrest. Well, you can argue that in court then. Your court date is January the 1st. Yep. next year. All right. Well, you don't have to. You can pay the fine. Fine. I'm not sign. I'm need for you to sign. I'm not signing 93. She refuses to sign. Hello. Coming around. Can you cut the car open? All [Applause] right. My lieutenant is on his way, so you can talk to him if you want to. Okay. Say it again. No, you you take your car off. Like I said, he's not going to get hot. You can roll down your window, but like I said, turn your car off. Turn car now. I I didn't ask that. I Okay. And I told you I'm not turning off. You can turn your car off. Like I said, and I said no. Okay. Don't [Applause] [Applause] want to step out. Step out. Step out the vehicle. No. Step out the vehicle. want to step out the vehicle. Like I said, step out. I'mma talk to the lieutenant. Step out your vehicle. I gave you order. Step out. Okay. Don't Don't worry about it. The driver is refusing all of the officer's lawful commands, and that increases the chances of an arrest. Typically, after refusing to sign the ticket, the officer has a lawful right to pull the driver from the vehicle himself and perform an arrest. As the interaction devolved to frustration, supervisory reinforcement made its entrance. Commands were met with commentary, patience was met with provocation, and this roadside exchange was veering straight into full-blown diva territory. Hello, ma'am. I'm reaching a tow. Okay. Can you do me a favor? Step out and talk to me. Yeah, talk cuz I'm asking you to step out the vehicle. Okay. Sit out. Yes, ma'am. I need you to step out the vehicle. Okay. Can you please step out the vehicle for me? [Applause] Oh, I work at a freezer. No one. You gotta damn 1095. Okay. Go back. Record by rotation. You got anything on you? Let me grab on to your phone here. I got my phone. Go your phone, man. Watch your foot. record by rotation. We'll charge her with obstruction. Mhm. Uh the speeding. Was it just the speeding you were writing? Yeah, that was it. Obstruction and speeding. Okay. And record by rotation for this. I can work on you if you want to start working on the booking sheet. All right. The driver was taken to the Baldwin County Jail and charged with obstruction of an officer, misdemeanor, speeding, 78 and a 55, window tint violation 1% tint. This arrest could have been avoided if the driver was aware that signing the ticket wasn't a plea of guilt. Most people aren't aware of the consequences of refusing to sign a traffic ticket. So, the best solution is that if you ever receive a traffic citation, just sign and fight the citation in court.
