Here I come. >> Okay. Here I come, baby. out. >> If a female is suspected of committing a crime and the police arrive at their residence with two male cops and a female cop, that is typically a sign that the police believe that they have enough probable cause to make an arrest. These police officers have likely seen some prior evidence, possibly video footage at the school, which perhaps led to their determination that bringing the female officer is necessary because the suspect is of the same gender, which is an efficient decision when proactively planning to make an arrest. Now, the state of Illinois does not have a formal stand your ground law. If someone is in public and can safely retreat from a potential fight, retreating is the best legal choice. You cannot claim self-defense if you are deemed the initial aggressor. In a verbal confrontation where two people are in your face, physical engagement by you, even if they started it verbally, could lead to you being labeled the aggressor. While you are not technically required to run away, a jury will evaluate your actions based on whether they were objectively reasonable. If a safe retreat was clearly available and you chose to engage in a fight instead, a prosecutor may argue your use of force was not necessary or reasonable. >> Our manager to the building, >> I said, you know, I'm going show him. >> Why you want to show her? cuz she in my face. And before I beat her, let me show her. Show everybody how this in my face. This her all in my face on my camera. Remind you this my car. They on my car. This is my car. IT'S NOT TO TALK. SHE GOT HIT. SHE HIT ME. THEY SPINNING MY FACE. THEY BOTH IN MY FACE. THEY ON MY CAR. Y'ALL NOT ABOUT TO GET DOWN ON ME. >> NO, Y'ALL not not. I'm sorry. In the state of Illinois, spitting on someone is considered a simple battery because it is intentional physical contact of an insulting or provoking nature. While you have a right to defend yourself, Illinois state law imposes strict limits. These limits are based on two dynamics, retaliation versus defense. The state of Illinois perceives punching someone after they have already spit on you, where there is no immediate threat of a second, more dangerous attack is often viewed by courts as retaliation rather than self-defense. If you hit someone for spitting on you, you could be charged with battery yourself. Illinois courts assesses whether a reasonable person in the same situation would have felt a punch was necessary to stop an ongoing or immediate physical threat. Illinois state law does not allow self-defense to be used because someone stands on your vehicle or spits on you. >> The what was the first interaction? I just want >> the first interaction was they spin in my face. So I said I'm I'm I'm like, "Okay, I'm be I'mma beat your ass." >> What you mean? I'm getting in my my my SPACE. IT'S NONE TO TALK. It was one of me. >> But they spitting in I'm talking about me talking in my face. Many believe that certain actions like spitting constitute fighting words that grant a legal right to fight back. Legally, however, fighting words are a first amendment exception that allows the government to punish the speaker. They do not provide a legal defense for a victim to commit physical battery. Socially, spitting is often viewed as the ultimate sign of disrespect, leading to an emotional or impulsive urge to fight. People often confuse retaliation with self-defense. But if you punch someone after they spit on you, depending on the state in which the incident occurred, you would likely be charged with battery or assault. While the spitter committed a crime, your punch is a separate criminal act. Courts generally rule that a punch is an excessive and disproportionate response to being spit on. If you strike someone after the spit has already landed and no further threat is imminent, you may be legally labeled the aggressor losing your self-defense rights. The right way to respond to this particular situation is to get away from the person to ensure safety. Call the police to report the spit as a criminal, assault or battery. If possible, do not wipe away the saliva immediately as it can be used for DNA evidence or disease testing. I am the prime analyzer.
