So, um, I end up hearing somebody talking and I'm looking through the, if you see the little windows right there, it's like a little crack. I can see from where I'm at. I see a man standing right here. >> So I'm like, "Oh, they're probably looking at the dog." But I'm like, >> "That's his company." You get what I'm saying? So I come out. I'm like, "What the [ __ ] you got going on?" I see her with the dog bowl that I had right here where you're standing. I see the girl that came out of the house. She's right there. >> Right. And I'm I hope they have cameras. She's right there. And um she has the same dog bowl. My dog bowl right here. >> Right. And I'm like, and I see her I see her like about to grab my dog with the dog bone. >> So I'm like, "What the I'm snap. What the do you got going on?" And he's, "Oh, it's not like that. We thought the dog was for I just started coming around over here." >> You guys been coming here. You see a pink cage. You just walked past the pink cage in the dog bowl. That's where you got her dog bowl from. It didn't have no water in there when I let her out. How the does it has cold water in there? Cuz that water runs hot. So you didn't get it from there. So that mean you seen her. You grabbed a dog bowl. You went somewhere to get the cold water. Came back and tried to get the dog. That's common sense. And you instead of putting it back where you got it from, you went over there >> and try and I'm catching you cuffing my dog. The amount of illogical thinking and statements that this female has provided in a time span of only a few minutes is terrible. I know that the female subject is proud of owning an alleged $6,000 dog because she mentions the price of the dog to the police with passion. However, having a $6,000 dog while complaining about crackheads lording on your property that you only, and I quote, stay but don't live at is complete foolery. I mean, you have crackheads gathering outside as if they are auditioning for a sequel for The Night of the Living Dead and you are boasting about the price of your dog. But it might be a good thing that the crackhead was around because >> you see a pink cage. You just walked past the pink cage in the dog bowl. That's where you got her dog bowl from. It didn't have no water in there when I let her out. It didn't have no water in there when I let her out. It didn't have no water in there when I let her out. If the crackhead didn't get involved, the female subject's $6,000 dog might have transitioned because the $6,000 dog owner failed to put water in the dog's bowl. And based on the female subject's statements, it seems as if this loving, caring, and just a truly exceptional crackhead traveled to another resident's yard to put cold water in the dog's bowl and returned with the water and also with a primary intention of checking on the dog's well-being. >> You went somewhere to get the cold water, came back and tried to get the dog. That's common sense. And you instead of putting it back where you got it from, you went over there >> and try and I'm catching you gra cuffing my dog. So I am snapping at this point. I'm upset. I'm crying. I'm calling the landlord. I'm on the phone with uh the lady. He's not supposed to have no company at all. Um if you want to meet that type of company, don't have them here. Meet them somewhere else. The landlord done already told him the landlord is already on the way. >> Now, nearly all apartment and residential leases have guest policies because they define the difference between a visitor and an unauthorized tenant. protecting the property from increased wear, utility cost, and potential legal issues if a guest overstays and claims residency. These policies typically limit overnight stays, define consequences for violations, and hold tenants responsible for their guests behavior. Usually, the tenant is the primary contact. Guest should ideally communicate through the tenant unless it's an emergency or the guest is essentially living there at which point they are often considered a tenant and should be introduced to the landlord. So, in a nutshell, I believe that the female subject is lying about not living at the residence because she claims to be in contact with the landlord on issues that only a tenant is in charge of discussing with a landlord. >> The landlord done already told him the landlord is already on the way. >> Did Did you guys have an altercation where you had a stick or a piece of metal? >> No. >> Okay. He's got welts across his arm from he's saying some type of stick or pole you struck him with when he knocked on your door. >> No, I did not hit him at all completely. And he said that last time. He said that he called my landlord and I can call Miss Jamie and let you guys know. He called the landlord and said, "Oh, well, they're beating on me. They're holding me hostage." He got scratches everywhere. He has bruises everywhere. >> And he's like, "They're holding me hostage. He already got it." Um, >> what's a what's your phone number? >> Do you see all Do you I Do you see scratches and other thing? Everything else that's on him. >> What neighbor saw this? >> Um, it's a it's a boy. So, I heard her yelling and stuff and then I came outside and she was like, "Bro, he just they just tried to steal my dog, my $6,000 dog." I'm like, "What's going on that he just keep on talking?" He like just just disrespected her. She like, "I let you stay here. The the rent man told you you can't be having them coming back and forth and stuff, but >> he just keeps doing it." And >> did you see him hit her at all? >> Oh, no. No, I didn't see I didn't see anybody hit anybody. I didn't see him hit her. No, >> she didn't have a gun. >> No. No, she didn't have a stick. >> No, she didn't have a stick. Now, for some reason, he was he was like he was like, "So, so so, so what? You're going to shoot me? So, what you going to shoot me?" But >> you heard him saying that? >> Yeah, that's what he was saying cuz she was telling him to go to the back of his house, but he kept on coming up here. And I'm like, "Bro, just go to the back." And then he just like, "What you going to shoot me? What you going to shoot me?" She I'm like, "No, fam." Cuz she didn't have no weapon or nothing, fam. And she was like, "I got people in the street that like do this. like for you to be having these people come in here and taking my stuff and she was like how you punched a hole in the wall and stuff like that. >> Okay. >> But no, I didn't see a stick or a gun. >> Hi, Mr. Roberts. >> What? I have to as a police officer, I have to meet a threshold of probable cause and I've met that threshold. The way the call came out was that he called you had a wooden stick or something like that and hit him with it and brandished a gun. So that cooperates what the call came in as. Okay. That's why you're like this. That's that's the answer. Okay. There's no we'll we're doing our own investigation. >> So he knocked on my door and attacked me. >> You didn't mention any of this. The suspect was charged with one count of aggravated battery with a deadly weapon and one count of aggravated assault with a firearm. In the state of Florida, aggravated battery with a deadly weapon is a very serious secondderee felony carrying significant penalties including up to 15 years in prison alone. Now, I do agree that there was enough probable cause to arrest the suspect, but I do not believe that there is enough proof beyond a reasonable doubt to get a conviction for neither of these charges. My belief is based off of the lack of evidence and the statement from the witness. The witness continuously mentioned that he did not see a gun or a stick on the suspect. Looking at this from a logical standpoint, the suspect doesn't have one injury or wound on her, and that isn't typical when someone is harming someone else, especially a male. I'm not saying that it couldn't occur, but it is a high possibility that when someone is defending themselves from the injuries that the victim has, they would fight back in some type of manner. that would at least leave some type of injuries or evidence on the suspect as well.
