I'm not >> Put your feet in or I'm going to force you to put your feet in. >> Call my attorney. >> A police officer can generally legally detain the person to investigate even if the officer did not personally witness the person hit the vehicles. [snorts] The constitutional standard for an investigative detention is reasonable suspicion, which is lower than probable cause. The officer needs a particularized objective basis for suspecting that the person was involved in criminal activity. Multiple witnesses saying something like, "We personally saw that person driving that car and striking multiple parked vehicles can provide substantial grounds for reasonable suspicion, particularly when the witnesses independently describe the same person, vehicle, conduct, location, or sequence of events. The witness's firthand observation is especially important. >> I have my right to call my No, I have my right to call my attorney. I have a right to call attorney. I appreciate your cooperation. >> Thank you, babes. Babes. H >> I haven't been called that in many years. I'm a dancer. >> You're a what? >> Dancer. >> A dancer. What kind of dance? >> Adult. >> Huh? >> Adult. >> Adult dancer. Okay. >> Saying I'm an adult dancer, is not evidence of a DUI. And being an adult dancer obviously doesn't establish impairment. But volunteering it can unnecessarily broaden the conversation. It could lead to additional questions about where the person works, whether they were working that day or night, whether alcohol was served there, when they left, or what they consumed. There is also a practical concern about bias or assumptions. An officer should evaluate the person based on objective DUI evidence, not occupation. But because officers are human, volunteering personal information unrelated to the investigation can potentially introduce assumptions that otherwise would never have entered the encounter. >> I appreciate your cooperation. >> Thank you, Bates. >> Thanks. Hm. >> I haven't been called that in many years. >> I'm a dancer. >> You're a what? >> Dancer. >> A dancer. What kind of dance? >> Adult, >> huh? >> Adult. >> Adult dancer. Okay.
